SUBJECT: Petition to Vacate a Portion of Mumby Road

Principal petitioner James Burnell and Andrea R. Vitalich have requested that the County vacate the
western terminus of Mumby Road Right -of -Way approximately 184 feet in length and 16 feet in average
width ("Subject Right -of -Way"), primarily abutting tax parcel 021-202-012. Details regarding the
establishment, condition and usage of this Subject Right of Way along with findings and
recommendations regarding the proposed vacation are provided in the County Engineer's Report Exhibit
20. The Principal Petitioner is the current owner of record for tax parcel 021-202-012.
A remote public hearing for the proposed vacation, to be conducted by the Jefferson County Hearings
Examiner, is scheduled for Friday March 27, 2026, at 10:00 a.m.
In accordance with Jefferson County Code ("JCC") 12.10.050,1 e-mailed notice of the petition and
upcoming hearing, including a request for comments on the proposed vacation on February 24, 2026 to
applicable County Departments and other appropriate entities. The following day, February 25, 2026,
additional notices were mailed where email addresses were not available. Adjacent Property Owners
(APO's) within 300 feet of the Subject Right of Way to be vacated were mailed notice of the proposed
vacation February 24, 2026. Notifications to APO's are documented in Exhibit 5 and Exhibit 6 shows
the 300 foot buffer from the Subject Right of Way. Exhibit 9 shows notifications sent to agencies and
providers.
Initial inquiries from East Jefferson Fire -Rescue and Jeffcom 911 raised concerns regarding emergency
ingress/egress, tsunami evacuation routes, and potential impacts to the addressing of nearby structures.
Specifically, the Fire District noted a previous incident where an ambulance became stuck and sustained
damage due to existing road conditions. However, following clarification that the proposed vacation is
limited to the western terminus (184 feet x 16 feet) serving only the petitioners' properties, would not
constitute a physical change in the roadway and that access to existing residences at 421 and 564 Mumby
Rd will remain unaffected, these concerns were resolved after this clarification. No other concerns have
been received to date.
February 26, 2026, I posted both ends of the Subject Right of Way with public notice boards. I have also
arranged for notice of the public hearing for this case to be published in the Port Townsend Leader the
weeks of March 11, 2026 and March 18, 2026. A separate exhibit will be submitted confirming the
notices were published as scheduled.
