To the Board of County Commissioners,
Please include this correspondence in the public record and meeting packet for the Board’s next regular business meeting.
I’m writing to bring to the Board’s attention a persistent issue regarding the Public Records Administrator’s failure to adhere to BOCC Resolution 68-21 and the Washington Public Records
Act (RCW 42.56).
Despite the Board’s official fee schedule (Resolution 68-21) specifically authorizing and pricing "attachments uploaded to email," the Public Records Administrator is currently withholding
available records to mandate the use of a third-party tracking portal (GovQA) as a condition of disclosure.
I have formally refused consent to this tracking-based delivery method for privacy reasons. However, the Administrator continues to refuse the "Email Attachment" method authorized by
this Board, despite proving that such a delivery is technically feasible for the electronic records in question.
This administrative obstruction creates an "unreasonable barrier" to public access and introduces unnecessary legal and financial risk to Jefferson County—a risk the County has already
realized in past litigation such as Belenski v. Jefferson County.
I urge the Board to ensure that County staff follow the Board's own adopted resolutions and provide requested records via direct email attachment as required by law.
