I’m filing a formal objection to the wrongful closures of Public Records Requests #26-112 and #26-110 on March 24, 2026, and April 1, 2026, respectively. The agency’s administration
of these requests constitutes bad faith, constructive denial, failure to segregate records, and wrongful withholding under the Washington Public Records Act (RCW 42.56).
1. Constructive Denial and Delivery Format Violation
My original March 1, 2026, requests established a clear mandate for records to be provided as direct email attachments (PDF/WAV/MP3/CSV/ZIP) without portal links. Despite this, on April
1, 2026, between 10:42 AM and 4:29 PM, the agency issued 43 individual emails under PRR #26-110. Every single communication utilized embedded NextRequest portal links, violating the
requested format and denying the fullest assistance required by RCW 42.56.100.
Between 10:42 AM and 4:29 PM on April 1, 2026, the agency released installments #24 through #65. At 5:32 PM, the agency issued a final notice closing request #26-110 as fulfilled, asserting
that 60 CAD reports and associated audio were produced. Closing this request without providing files in the mandated, technically feasible electronic format constitutes wrongful withholding
and a failure to promptly furnish records under RCW 42.56.
2. Failure to Segregate Records
Pursuant to Nissen v. Pierce County, the agency possesses an affirmative duty to conduct an adequate search and properly segregate public records. The agency has engaged in a continuous
failure to segregate responsive information. While releasing files responsive to Port Townsend Police Department cases on April 1, 2026 (including PTPD:2026:1001, PTPD:2026:994, PTPD:2026:952,
PTPD:2026:941, PTPD:2026:940, PTPD:2026:915, PTPD:2026:787, PTPD:2026:744, and PTPD:2026:738), Jeffcom 911 simultaneously released specific Jefferson County Sheriff's Office (JCSO)
cases into this same batch under PRR #26-110. Specifically, JCSO:2026:1732 was released at 3:31 PM, JCSO:2026:1982 at 3:40 PM, and JCSO:2026:2058 at 3:46 PM.
This follows the agency's actions on March 24, 2026, between 10:09 AM and 10:16 AM, where it released Installments #1 through #15 under PRR #26-110, comprising over 120 audio files and
PDFs that were responsive to PRR #26-112.
3. Inadequate Search and Statistical Contradiction
On March 24, 2026, at 10:22 AM, the agency issued a notice under PRR #26-112 asserting no records existed regarding Security Services Northwest (SSNW) at 515 Sheridan Street, 615 Sheridan
Street, or the QFC/Public Health buildings. Two minutes later, at 10:24 AM, the agency wrongfully closed PRR #26-112 as fulfilled.
However, the agency's own Director's Report, dated March 26, 2026, explicitly documents that over 4,600 Law Enforcement calls were processed between January 1 and March 20, 2026. It
is a mathematical and operational impossibility that zero records or computer-aided dispatch contacts exist for a commercial surveillance trailer at these specific locations during
a period encompassing 4,600 processed calls. This statistical contradiction confirms an inadequate search.
4. Wrongful Withholding, Over-Redaction, and Failure of the Brief Explanation Requirement
On March 24, 2026, at 10:16 AM, the agency released an installment accompanied by a 16-point exemption list. The agency executed highly targeted redactions, specifically removing Social
Security numbers and VINs from Case #2026-8654, and Driver’s License numbers from Cases #2026-8505, 2026-8527, and #2026-8654. The agency also invoked RCW 42.56.240 and RCW 42.56.230(9)
for E911 database information, explicitly labeling files 7.pdf, 8.pdf, and 9.pdf as redacted.
The agency's 16-point list fails the "brief explanation" requirement of RCW 42.56.210(3). Supplying a generic menu of exemptions without a specific, itemized redaction log linking each
redaction to its statutory justification is unlawful. Furthermore, under the Nissen standard, the agency is required to properly segregate exempt from non-exempt information. By issuing
a blanket 16-point exemption list to suppress crucial metadata for the specific February 9 and 10, 2026, contacts, the agency has failed to meet this burden. This over-redaction and
failure to properly segregate constitutes a wrongful withholding of public records in bad faith.
The administrative closures of #26-112 and #26-110 are legally invalid. The agency must immediately reopen both requests, conduct an adequate search that reconciles the 4,600-call volume,
properly segregate the cross-agency files, and produce all wrongfully withheld records and metadata as direct email attachments accompanied by a legally compliant redaction log.
