Dear Commissioners:
The decision of the Hearing Examiner on the preliminary plat application for the Pleasant Harbor MPR in Brinnon noted that, although many in the community would want to see the developer
post a bond to assure the project proceeded in accordance with its obligations, the county code does not grant the authority to impose a bond. He noted that other types of projects
can require bonds, but not the type of land use decision at issue here. From that he inferred that the county has deliberately chosen to not require or allow the consideration of a
bond as a condition for a land use project to proceed.
I propose that the county modify its code to permit the requirement of a bond for any type of project that imposes potential environmental or other risks if the developer or proponent
does not comply with its obligations.
