CONDITIONS for Building Permit# :BLD12-00100
1.) Substantial progress towards completion of the project shall be performed within two
years of issuance of the shoreline permit.
2.) All construction shall occur above (landward of) the ordinary high water mark (OHWM).
No portion of the project may be built below or over the OHWM.
3.) The applicant shall adhere to all Hydraulic Project Approval (HPA) requirements.
4.) The applicant shall contact Margie Schirato with Washington Department of Fish and
Wildlife at 360-427-2179 to ensure compliance with HPA requirements.
5.) Any damage to the proposed structure shall be repaired or removed as soon as
practicable. At the end of the useful life of the structure, the stairs will be removed as
soon as practicable.
6.) Tree removal to construct the stairs to the shoreline is not allowed. The stairs shall be
constructed to avoid tree removal.
7.) The decision by the hearing examiner set forth herein is based upon representations
made and exhibits, including plans and proposals submitted at the hearing conducted by
the hearing examiner. Any substantial change(s) or deviations(s) in such plans,
proposals, or conditions of approval imposed shall be subject to the approval of the
hearing examiner and may require further and additional hearings.
8.) The authorization granted herein is subject to all applicable federal, state, and local laws,
regulations, and ordinances. Compliance with such laws, regulations, and ordinances is a
condition precedent to the approvals granted and is a continuing requirement of such
approvals. By accepting this/these approvals, the applicants represents that the
development and activities allowed will comply with such laws, regulations, and
ordinances. If, during the term of the approval granted, the develoment and activities
permitted do not comply with such laws, regulations, or ordinances, the applicant agrees
to promptly bring such development or activities into compliance.
