Commerce to initiate Growth Management Act rulemaking to implement recent housing-related bills
The Washington State Department of Commerce is exploring an update to the administrative rules concerning the Growth Management Act (GMA). Intent for rulemaking <https://links-2.govdelivery.com/CL0/h

(CR-101) was filed on June 30.
This rulemaking initiative seeks to implement recently enacted legislation regarding housing, permitting and other land use considerations, including:
* Residential development in commercial and mixed-use zones (SB 6026, 2026);
* Detached accessory dwelling units (HB 1345, 2026);
* Density bonuses for religious organizations (HB 1859, 2026);
* Shelter, transitional housing, emergency housing, and permanent supportive housing (HB 2266, 2026);
* Permit review processes (HB 2418, 2026);
* The Housing Accountability Act (SB 5148, 2025)
* The Parking Reform and Modernization Act (SB 5184, 2025);
* Transit-oriented development (HB 1491, 2025);
* Middle housing in Limited Areas of More Intensive Rural Development (LAMRID) (HB 2269, 2025);
* Land use permitting workloads (SB 5611, 2025); and
* Local permit review processes (SB 5290, 2023).
It may also include updates based on recent housing element Growth Management Hearings Board case findings related to land capacity, adequate provisions, and implementation of comprehensive
plans. In addition, this initiative may include rules to:
* Convert LAMIRDs to urban growth areas;
* Clarify WAC 365-190-040 and improve language regarding errors in designation of resource lands;
* Clarify WAC 365-196-305 concerning protection of tribal cultural resources;
* Correct the table provided in WAC 365-196-443 concerning requirements and deadlines for jurisdictions adopting a climate element;
* Provide consistency changes within WAC 365-196-443;
* Update WAC 365-196-840, regarding concurrency, to align with RCW; and
* Reorganize language consistency within WAC 365-199 for improved usability in conjunction with any new sections added.
