Schedule a Public Hearing for Mats Mats Beach Homeowner's
Assodation, Water 8: Effluent Line Franchise
Statement of Issue:
The Mats Mats Beach Homeowner's Association has applied to Jefferson County for a
non-exclusive franchise for water and effluent lines within County Road rights-of-way
located in Section 33, Township 29 North, Range 1 East. These lines will convey water
and effluent from three individual parcels to be developed for three separate single-
family residences to a parcel with a large off-site drainfield area. The Jefferson
County Environmental Health Department has received an application for this septic
system.
A Franchise for a Water System was granted to the Mats Mats Beach Homeowner's
Association (Resolution 02-04) on January 12, 2004. This Franchise will rescind and
replace Resolution 02-04.
Attached is a public hearing notice for a Board of Commissioners public hearing on the
Franchise Resolution at 10:00 AM on May 23, 2011.

Significant franchise terms and conditions:
In accordance with RCW 36.55.040, upon application to the County legislative
authority for a franchise, it shall fix a time and place for hearing the same and shall
give public notice at the expense of the applicant.
Fiscal Impact/Cost Benefit Analysis:
All costs related to the advertising costs for the hearing notice and the installation,
maintenance and repair of the utilities under this Franchise shall be the responsibility
of the Applicant.

Recommendation:
The Department requests that the Board schedule a public hearing on the Franchise
Resolution at 10:00 AM on May 23, 2011 and direct the Chair of the Board to sign the
attached public hearing notice. The notice will be published in the Leader on May 4,
2011& May 11,2011.
As per the requirements of RCW 36.55, public hearing notices will be posted at three
locations in Port Townsend.

MATS MATS BEACH HOMEOWNER'S ASSOCIATION
FRANCmSE FOR WATER & EFFLUENT LINES
Notice is hereby given that the Jefferson County Board of Commissioners will conduct a public hearing on
Monday May 23, 2010 at 10:00 AM in the Commissioners' Chambers at the Jefferson County Courthouse,
1820 Jefferson Street, Port Townsend, Washington, to take testimony concerning a proposed Resolution
granting a nonexclusive franchise to the Mats Mats Beach Homeowner's Association to construct,
maintain, and operate a water line and effluent line within County Road rights-of-way located in Section
33, Township 29 North, Range 1 East. These lines will convey water and effluent from three individual
parcels to be developed for three separate single-family residences to a parcel with a large off-site
drainfield area and well. The franchise would authorize these lines to be located in the following County
Road rights-of-way: Mats Mats Beach Rd, Bayview Dr and S Bayview Dr.
Copies of the proposed Resolution are available at the Commissioners' Office at the County Courthouse,
1820 Jefferson Street, Port Townsend, Washington. Copies may also be requested by calling the
Commissioners' Office at (360) 385-9100 or emailingjeffbocc@co.jefferson.wa.us.
Comments on the proposed Resolution can be made at the public hearing or by letter to the Jefferson County
Board of Commissioners at PO Box 1220, Port Townsend, W A 98368 or by email to
jeftbocc@co.jefferson.wa.us until 4:00 PM Friday November 19,2010.
