Box 1487 Port Hadlock, WA 98339 Summary of Proposal: The application requests preliminary short plat approval to divide approximately 10.3 acres of Rural Residential 1:5 zoned property into two (2) lots for residential use. Potable water is proposed by a 2-party well. Sewage disposal would be provided by individual on -site septic system. Lots would receive access from a shared approach off of Hwy 20, a State Highway. Property Location: Parcel Number 902243042, in Section 24, Township 29, Range 02 West, WM, having a site address of 480 Hwy 20, Port Townsend, WA 98368. It is referenced by the Assessor's Tax Parcel Number 902243042. Site Description: The parcel is mostly undeveloped and forested, with the exception of a gravel driveway and building pad. It is located on a gentle to moderate inland slope of Discovery Bay. The northern boundary runs parallel to Hwy 20. The surrounding parcels to the North, East and West are zoned Rural Residential 1:5. The southern boundary abuts to a parcel zoned Commercial Forest CF-80. Findings of Fact: Based on the information on file, available mapped information, applicable local and state policies and regulations, and available records maintained by Jefferson County, the Administrator finds as follows: 1. A short plat application (SUB2022-00028) was deemed substantially complete on August 15, 2023. The purpose of this short plat is to create two (2) single family residential lots. 2. The proposed short plat is categorically exempt from environmental review pursuant to WAC 197-11-800(6)(d). 3. A Notice of Type II Application was published in the Port Townsend Jefferson County Leader newspaper on November 15, 2023. The Notice was posted on the property on November 15, 2023. The applicant, agencies, and all property owners within 300 feet were notified by mail on November 15, 2023. 4. Testimony: No verbal or written testimony was received from the adjacent properties or interested parties. 5. Agency Responses: a. County Public Works Department: Written comments dated December 7, 2023 are hereby incorporated by reference. b. County Health Department: Written comments dated November 17, 2023 are hereby incorporated by reference. c. Jefferson County Assessor's Office: Written comments dated October 25, 2023 are hereby incorporated by reference. d. Discovery Bay Fire Chief, Willy Knoepfle: Written comments dated December 18, 2023 are hereby incorporated by reference. 6. Pursuant to ]CC 18.35.140, an application for preliminary short plat approval must demonstrate consistency with all the provisions of ]CC 18.35.130. a. The proposed subdivision conforms to all applicable county, state and federal zoning, land use, environmental and health regulations and plans, including but not limited to the Jefferson County Comprehensive Plan and the provisions of this code, including any incorporated standards; Staff Comment., The Comprehensive Plan designation for this property is Rural Residential. The zoning designation for this property is Rural Residential 1: 5, requiring a minimum density of 5 acre per lot. The proposed short subdivision is subject to the policies of the Jefferson County Comprehensive Plan. The applicable policies are discussed below. The following goals and policies of the Comprehensive Plan apply to the project, which relate to land use compatibility, transportation, and environmental duality.' • Land use: The parcel is 10.3-acres and zoned Rural Residential one dwelling per five acres (Rural Residential 1:5). The lots will be served by individual on -site septic systems and a 2-party well. The proposal is consistent with the Comprehensive Plan Policies LU P-1.9, LU P-6.1, LU P-10.1, and LU P-15.1. • Transportation: Jefferson Transit currently does not have a transit stop near the subject parcel. Children housed within the Chimacum School District will be bussed to the school campus. The proposal is consistent with the Comprehensive Plan Policies TR-P-1.5, TR-P-2.5, TR-P-4.2 and TR-P-4.9. Environmental Quality: The proposed short plat is located outside of critical areas and their associated buffers. Slight/moderate landslide hazard area is the only critical area identified on the property. Each lot is served by an individual on -site well and an individual on -site septic system. There are no drainage ways on or near the parcel, stormwater will be reviewed at the time of development. The proposal is consistent with the Comprehensive Plan Policies EN-P-1.1 and EN-P-2.2 • Utilities and other public services necessary to serve the needs of the proposed subdivision shall be made available, including open spaces, drainage ways, roads, streets and other public ways, potable water, transit facilities, sewage disposal, parks, playgrounds, schools, sidewalks and other improvements to assure safe walking conditions for students who walk to and from school; Staff Comment: The lots will be served by a 2-party well. Water quality and quantity information on the potable well must be submitted, reviewed, and approved by Environmental Health prior to final approval. An On -site Sewage Disposal Permit was issued on February 15, 2022. The Environmental Health sanitarian had no additional comment on the proposal. Jefferson Transit currently does not have a transit stop at this location. The proposal would require children be bussed to and from school due to distance to the nearest school, therefore sidewalks are not required. The parcel is accessed off Hwy 20. The parcel has an existing WSDOTAccess Connection Permit (Permit Number ACP-60499) and a General Permit (Permit No. 60498) for maintenance purposes. The modified lot configuration as submitted on December 12, 2023 will no longer require the construction of an internal access road. No road improvements are required. The East Jefferson Fire & Rescue did not require any fire apparatus improvements The proposal meets this criterion. e. Approving the proposed short subdivision will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff Comment: Approving this short plat will serve the public use and interest as each lot is now developed providing one additional housing unit in Jefferson County and meets the Comprehensive Plan Density of Rural Residential 1: 5. Public health, safety and general welfare will not be compromised as a result of this short plat. Each lot will be fully developed with construction of a single- family residences, 2-party well, and installed, approved, and finaled septic systems. Hwy 20 already serves the parent parcel. Jefferson Transit currently does not serve the site and children attending the nearest school will be bused to and from school. The proposal meets this criterion. Notwithstanding the approval criteria set forth in this section, in accordance with RCW 58.17.120, as now adopted and hereafter amended, a proposed subdivision may be denied because of flood, inundation or swamp conditions. Where any portion of the proposed short subdivision lies within both a flood control zone, as specified by Chapter 86.16 RCW, and either the 100-year floodplain or the regulatory floodway, the county shall not approve the preliminary short plat. Staff Comment: The proposed short plat is not located within a flood plain, flood way, wetland or any associated buffers. The proposal meets this criterion. Action Taken: Based on the preceding findings, the application as proposed has satisfied the above criteria. Staff recommends Approval with Conditions of the Type II Short Plat application. SUB2022- 00028 is hereby preliminarily approved with the following conditions to be addressed prior to final approval Conditions of Aooroval: Main Conditior. This preliminary approval is for a Two Lot Short Plat only. Final approval is subject to all conditions and review by County Commissioners.
