Subject: Failure to Obtain a Hulk Hauler License
Dear Mr. Anderson
On February 3, 2011, a member of the Washington State Patrol provided our office with a
complaint stating that on January 11, 2011, the trooper conducted a business inspection of
Peninsula Auto Wrecking located at 4711 South Discovery Road, Port Towsend, WA.
A review of the wreckers monthly reports revealed that in 2010 you dropped off 30 vehicles at
the wrecking yard. The titles for the majority of the vehicles were not titled in your name. This
type of activity requires a hulk hauling license. A review of the Department of Licensing Master
Licensing records show that you are not licensed as a hulk hauler.
RCW 46.79.010 (4), states:
(4) "Hulk hauler" means any person who deals in vehicles for the sole purpose of transporting
and/or selling them to a licensed vehicle wrecker or scrap processor in substantially the same
form in which they are obtained. A hulk hauler may not sell secondhand motor vehicle parts to
anyone other than a licensed vehicle wrecker or scrap processor, except for those parts
specifically enumerated in RCW 46.79.020(2), as now or hereafter amended, which may be sold
to a licensed vehicle wrecker or disposed of at a public facility for waste disposal...
RCW 46.79.120, states:
Unlicensed hulk hauling or scrap processing — Penalty.
Any hulk hauler or scrap processor who engages in the business of hulk hauling or scrap
processing without holding a current license issued by the department for authorization to do so,
or, holding such a license, exceeds the authority granted by that license, is guilty of a gross
misdemeanor.
