8 JEFFERSON COUNTY, a political } Case No.: 06-2-00348-8
9 subdivision of the State of Washington ORDER DIRECTING ISSUANCE OF
10 Plaintiff, 2017 WARRANT OF ABATEMENT FOR
vs. } 890 OLD HADLOCK ROAD
11 MICHAEL ANDERSON, ) HEARING: January 26, 2018 at 1:00 p.m.
12 Defendant }
13
14 BACKGROUND
15 This Court previously has determined that a public nuisance exists at certain real property
16 located in unincorporated Jefferson County at 890 Old Hadlock Road, Port Hadlock, WA, real
17 property also known as Assessor's Parcel Number 901-112-013 ("the Subject Property").
18 In March 2011, the Court issued a permanent injunction against Defendant Michael Anderson
19 ("Mr. Anderson") prohibiting him from "[d]epositing or leaving at or bringing or hauling [to the
20 Subject Property] any solid waste, including but not limited to junk vehicles, vehicle hulks, vehicle
21 parts, tires and/or any other personal property which fits within the statutory definition of solid waste."
22 ("2011 Permanent Injunction").
23 In June 2012, the Court held Mr. Anderson in contempt for violating the 2011 Permanent
24 Injunction.
25 On November 2, 2012, the Court issued an Amended Permanent Injunction Granting
26 Continuing Jurisdiction (`.`2012 Amended Permanent Injunction") against Mr. Anderson with the same
27 prohibitions as the 2011 Permanent Injunction and granted continuing jurisdiction to enforce the 2012

Amended Permanent Injunction. A history of the decisions, findings of fact and conclusions of law
against Mr. Anderson are summarized in the 2012 Amended Permanent Injunction Granting
Continuing Jurisdiction at 2-8. After considering evidence of non -conforming use presented by Mr.
Anderson at that time, the Court held:
J. Defendant Michael Anderson had been operating an illegal and unlawful
scrap processing facility at the SP1 until such time as the permanent injunctive relieve
was obtained by the Plaintiff.
K. Defendant Michael Anderson has been operating an illegal and unlawful
wrecking yard at the SP until such time as the order granting permanent Injunctive (sic)
relief was entered.
L. Defendant Michael Anderson cannot be and is not "grandfathered" as a
legal non -conforming use for scrap processing or as a wrecking yard at the SP because
those uses occurring at or upon the SP have never been legal, lawful or licensed by the
State of WA.
Id. at 9. Based on these conclusions of law, the Court permanently enjoined Mr. Anderson from:
• "Parting (disassembling or cannibalizing) Motor Vehicles at, upon or within the
boundaries of a certain parcel of real property that he owns within unincorporated
Jefferson County, specifically the parcel known as the SP, also known as APN 901-112-
013;"
• "Processing scrap metal at, upon or with, in the boundaries of a certain parcel of real
property that he owns within unincorporated Jefferson County, specifically the parcel
known as the SP, also known as APN 901-112-013;"
• "Depositing or leaving at or bringing or hauling to the parcel known as APN 901-112-
013 any solid waste, including but not limited to junk vehicles, vehicle hulks, vehicle
"SP" refers to the Property. Id. at 2.

parts, tires and/or any other personal property which fits within the statutory definition
of solid waste.
Id. at 11.
FINDINGS OF FACT
1. After the 2012 Amended Permanent Injunction was issued, the Jefferson County
Department of Public Health received complaints that Mr. Anderson was again brining solid waste and
junk vehicles on to the Subject Property in violation of the 2012 Amended Permanent Injunction.
2. On May 3, 2017, May 23, 2017 and September 13, 2017, representatives of the
Jefferson County Public Health Department inspected the Subject Property.
3. The Subject Property is near Chimacum Creek.
4. Chimacum Creek is a salmon -bearing stream.
5. In accordance with Chapter 18.22 JCC, there should be no man-made development, use
or structures within 150 feet of the edge of the stream. This distance is known as the "stream buffer."
J Man-made development on Mr. Anderson's parcel should only occur beyond the stream buffer, i.e.,
I not less than 150 feet from the edge of the stream.
6. Based on the May 3, 2017, May 23, 2017 and September 13, 2017 inspections of the
I Subject Property the solid waste is within the stream buffer for Chimacum Creek.
7. Solid waste on the Subject Property has been brought onto the Subject Property after
March 27, 2012 in an apparent violation of the prohibition in the 2012 Amended Permanent Injunction
of. "Depositing or leaving at or bringing or hauling to the parcel known as APN 901-112-013 any
solid waste, including but not limited to junk vehicles, vehicle hulks, vehicle parts, tires and/or any
other personal property which fits within the statutory definition of solid waste." The solid waste
brought on to the Subject Property since March 27, 2012 includes but is not limited to construction or
demolition waste, propane tanks, riding mowers, tanks of unknown use and junk vehicles (including
boats).
8. The Subject Property is the site of and is burdened by solid waste deposited on, left on,
brought to or hauled to the Subject Property in violation of the 2012 Amended Permanent Injunction.

9. The Defendant, Michael Anderson, has created, condoned and worsened the nuisance
I by violating the terms of 2012 Amended Permanent Injunction.
10. Mr. Anderson took advantage of the procedure in the Court's May 26, 2017 Order
G I Postponing Hearing on Nuisance Warrant ("May 2017 Order") that allowed for videotaping of up to 5
minutes of any vehicle he thought could operate ("run and drive"). Declaration of Roger J. Parker,
I dated November 14, 2017 ("Parker Declaration"), ¶ 40. Some vehicles operated and some did not.
Parker Declaration, ¶ 40 and Exhibit 7. The ones that passed the "run and drive" test are not junk
vehicles and the ones that failed are junk vehicles, per the May 2017 Order. May 2017 Order, ¶3 at 1.
11. In Exhibits 4, 5, 6 and 7 of the Parker Decl., after the "run and drive" tests, Mr. Parker
compared the vehicles on the SP to the 9 junk vehicle factors in the JCC and the 4 junk vehicle factors
under RCW 46.44.230 and concludes that 90 junk vehicles (including 13 boats) have been brought on
to the SP since March 27, 2012 in apparent violation of the permanent injunction. Parker Declaration,
¶41. This is in addition to the 24 junk vehicles (including 6 boats) that have been on the SP since
March 19, 2012. Id. Over 100 vehicles currently on the SP qualify as junk vehicles. Id. Vehicles Mr.
Anderson was able to operate on September 13, 2017 are not solid waste and the warrant of abatement
does not apply to those items. Mr. Anderson was able to operate certain vehicles on September 13,
2017 that are listed in Exhibit 7 to the Parker Declaration.
12. Except for items listed in Exhibit 7 to the Parker Declaration, items previously approved
by the Jefferson County Public Health Department in 2012, which were not required to be removed by
the Amended Permanent Injunction, are solid waste that are subject to removal from the Subject
Property as part of the public nuisance worsened by the Defendant.
13. The details of Mr. Parker's comparison are in Paragraphs 42 to 51 of the Parker
Declaration and are summarized in Exhibits 10, 11, and 12 of the Supplemental Declaration of Roger
J. Parker signed January 22, 2018 ("Parker Supp. Declaration."). Exhibit 11 to the Parker Supp.
Declaration lists all the vehicles that are junk vehicles, considering the over 100 declarations filed in
support of Mr. Anderson's Response. The green rows in Exhibit 11 identify the vehicles that are not
junk vehicles —the rest meet the requirements for a junk vehicle under the RCWs and the JCC.

unauthorized deposition of solid waste into a container that is owned or leased by another person."
10. Chimacum Creek is considered to be a critical area and subject to the rules laid out in

11. Chimacum Creek also is an Environmentally Sensitive Area under JCC 8.10.100.
12. The public nuisance at the Subject Property is a detriment to the general health, safety
and welfare of the populace of Jefferson County, causing actual and immediate harm, including

transporter to demonstrate compliance with the notice and order to correct violation issued by Jefferson
County Public Health." The reason for this requirement in the JCC is to prevent a person from
transferring a solid waste problem from one location in Jefferson County to another location.
15. Mr. Anderson must immediately: (a) Remove from the Subject Property all the solid
waste in violation of this order; and, (b) Consistent with JCC 8.10.025(3)(h), provide the Jefferson
