PRELIMINARY SHORT PLAT
APPLICATION No. SUB2023-00001
Pleasant View Short Plat
Date: May 7, 2024
Expiration: May 7, 2027
Applicant: American Timber Resource LLC
Attn: Sam Boling
P.O. Box 810
Brinnon, WA 98320
Summary of Proposal:
The application requests preliminary short plat approval to divide approximately 18.94 acres of
Rural Residential 1:5 zoned property into three (3) parcels for residential use. Potable water is
proposed by a Group B water system. Sewage disposal would be provided by individual on-site
septic system. Access to Lots 1, 2, and 3 will be provided off of Mt. Jupiter Road at the
Southeastern corner of the property where it comes off of Highway 101.
Property Location: Parcel Number 502152019, in Section 15, Township 25N, Range 2W, WM,
having a site address of 309332 Highway 101, Brinnon, WA 98320.
Site Description: The parcel is mostly undeveloped and forested, with the exception of an
existing septic system in the central portion of the property and a gravel
driveway on the southern portion of the property. It is located on the
uphill (western)side of Highway 101. Mount Jupiter Road touches the
Western boundary of the parcel and loops around to connect at the
southeastern corner of the parcel right at the corner to Highway 101. The
site slopes up from Highway 101, with a ridge of more compressed
intermediate slope around the middle of the parcel. There is a Type Ns
(non-fish seasonal stream to the North meandering through the proposed
two (2) 5-acre parcels. The surrounding parcels to the North and South are
zoned Rural Residential 1:5. The eastern boundary of the parcel is Highway
101 but on the opposite side of the road is the proposed Pleasant Harbor
Master Plan. The western boundary abuts to a parcel zoned Commercial
Forest CF-80.
Findings of Fact:
Based on the information on file, available mapped information, applicable local and state
policies and regulations, and available records maintained by Jefferson County, the
Administrator finds as follows:
1. A short plat application (SUB2023-00001) was deemed substantially complete on
December 8, 2023. The purpose of this short plat is to create three (3) single-family
residential lots.
2. The short plat is subject to review under the State Environmental Policy. The optional
DNS process of WAC 197-11-355 is being used. The SEPA Responsible Official issued a
Final Determination of Non-Significance (DNS) on May 7 2024.
3. A Notice of Type II Application and SEPA Optional DNS was published in the Port
Townsend Jefferson County Leader newspaper on January 24, 2024. The Notice was
posted on the property on January 24, 2024. The applicant, agencies, and all property
owners within 300 feet were notified by mail on January 24, 2024.
4. Testimony: No verbal or written testimony was received from the adjacent properties or
interested parties.
5. Agency Responses:
a. County Public Works Department: Written comments dated December 26, 2023,
January 25, 2024 and May 2, 2024 are hereby incorporated by reference.
b. Environmental Public Health Department: Written comments dated March, 1,

are hereby incorporated by reference.
e. One response dated February 6, 2024 was received from the Department of Fish
and Wildlife (WDFW) with potential concerns regarding the Parcel being a critical
winter range habitat for Roosevelt Elk. The staff also recommended field review
of the watercourses and potential fish habitat.
f. Department of Natural Resources: Levi Puksta confirmed via an email on
February 12, 2024 that the stream as shown on the Forest Practice Map was a
non-fish seasonal Type Ns water.
g. WSDOT: Written comments dated April 23, 2024 are hereby incorporated by
reference.
6. Pursuant to JCC 18.35.140, an application for preliminary short plat approval must
demonstrate consistency with all the provisions of JCC 18.35.130.
h. The proposed subdivision conforms to all applicable county, state and federal
zoning, land use, environmental and health regulations and plans, including but
not limited to the Jefferson County Comprehensive Plan and the provisions of
this code, including any incorporated standards;
Staff Comment: The Comprehensive P/an designation for this property is Rural Residential.
The zoning designation for this property is Rural Residential 1:5, requiring a minimum density of
5 acre per lot. The proposed short subdivision is subject to the policies of the Jefferson County
Comprehensive Plan. The applicable policies are discussed below. The following goals and
'1,Asant View Short Plat SUC2023-0000,
policies of the Comprehensive Plan apply to the project, which relate to land use compatibility,
transportation, and environmental quality:
• Land use: The parcel is 18.94-acres and zoned Rural Residential one dwelling per
five acres (Rural Residential 1:5). The lots will be served by individual on-site septic
systems and a Group B well. The proposal is consistent with the Comprehensive
Plan Policies LU P-1.9, LU P-6.1, LU P-10.1, and LU P-15.1.
• Transportation: Jefferson Transit currently does not have a transit stop near the
subject parcel. Children housed within the Brinnon School District will be bussed to
the school campus. The proposal is consistent with the Comprehensive Plan Policies
TR-P-1.5, TR-P-2.5, TR-P-4.2 and TR-P-4.9.
• Environmental Quality: The proposed short plat has identified a couple of critical
areas, geohazard and Fish and Wildlife Habitat Conservation Areas (FWHCAs) and
their respective buffers/setbacks. Slight/moderate landslide hazard area identified
on the property. A"Ns"— Non-fish bearing Stream is present on the northern
portion of the parcel, included in proposed Lot 1 and 2, current and future property
owners of this short plat shall maintain applicable buffers from the ordinary high
watermarks (OHWM) on each side of the stream in accordance with the Jefferson
County Critical Areas Ordinance. An approved Group B water system and an
individual on-site septic system would serve each lot. Stormwater will be reviewed
with any road work and at the time of development for each individual parcel. The
proposal is consistent with the Comprehensive Plan Policies EN-P-1.1 and EN-P-2.2
• Utilities and other public services necessary to serve the needs of the proposed
subdivision shall be made available, including open spaces, drainage ways, roads,
streets and other public ways, potable water, transit facilities, sewage disposal,
parks, playgrounds, schools, sidewalks and other improvements to assure safe
walking conditions for students who walk to and from school;
Staff Comment: The lots will be served by a Group B water system. Water quality and quantity
information on the potable water must be submitted, reviewed, and approved by Environmental
Health prior to final approval. An On-site Sewage Disposal Permit was issued on December 7,
2006 for the central lot 2 on the parcel. The Environmental Health sanitarian had no additional
comment on the proposal. Jefferson Transit currently does not have a transit stop at this
location. The proposal would require children to be bussed to and from school due to the
distance to the nearest school, therefore sidewalks are not required. The parcel is located on
the uphill(western)side of Highway 101. Access to Lots 1, 2, and 3 will be provided off of Mt.
Jupiter Road at the Southeastern corner of the property where it comes off of Highway 101.
i. Approving the proposed short subdivision will serve the public use and interest
and adequate provision has been made for the public health, safety and general
welfare.
Staff Comment: Approving this short p/at will serve the public use and interest as each lot is
now going to be developed providing one additional housing unit in Jefferson County and meets
Pleasant View Short Plat SUC2023 0000'.
the Comprehensive Plan Density of Rural Residential 1:S. Public health, safety and general
welfare will not be compromised as a result of this short p/at. Each lot will be fully developed
with the construction of a single-family residences, using a group B water system, and installed,
approved, and finaled septic systems. Hwy 101 provides main route to the private road, Mt
_Jupiter Rd. Jefferson Transit currently does not serve the site and children attending the
nearest school will be bused to and from school. The proposal meets this criterion.
j. Notwithstanding the approval criteria set forth in this section, in accordance with
RCW 58.17.120, as now adopted and hereafter amended, a proposed subdivision
may be denied because of flood, inundation or swamp conditions. Where any
portion of the proposed short subdivision lies within both a flood control zone, as
specified by Chapter 86.16 RCW, and either the 100-year floodplain or the
regulatory floodway, the county shall not approve the preliminary short plat.
Staff Comment: The proposed short plat is not located within a flood plain, flood way, wetland
or any associated buffers. The proposal meets this criterion.
Action Taken:
Based on the preceding findings, the application as proposed has satisfied the above criteria.
Staff recommends Approval with Conditions of the Type II Short Plat application. SUB2023-
00001 is hereby preliminarily approved with the following conditions to be addressed prior to
final approval.
Conditions of Approval:
Main Condition: This preliminary approval is for a Three Lot Short Plat only. Final approval is
subject to all conditions and review by County Commissioners. Any future permits on this site
are subject to review for consistency with applicable codes and ordinances and does not
preclude review and conditions which may be placed on future permits.
