There are many misunderstandings about a firefighter’s right to remain silent. Which of the following are true or false? (answers at the bottom of the email)
1. An accused firefighter can decide whether to invoke Garrity or not.
2. A fire department can compel a firefighter to answer any questions the investigator thinks are important to a disciplinary investigation.
3. A firefighter who discloses his/her involvement in a criminal offense during a compelled interview can never be charged with the offenses.
4. Refusing to answer questions during a disciplinary interview is generally not a terminable offense, and even then is subject to progressive disciplinary principles.
5. Answers given during a Garrity-compelled interview cannot be used in a disciplinary proceeding against the firefighter.
BONUS: If a union rep or lawyer gives a firefighter bad advice to remain silent, the firefighter cannot be terminated.
