Through this Amendment, the PUD #1 will continue to provide the matching contribution for watershed planning and implementation in the Quilcene-Snow watershed in the form payments for Peterson Lake, a critical aquifer recharge area in the Chimacum Creek sub-basin. FISCAL IMPACT/COST BENEFIT ANALYSIS: This agreement provides the requisite match for the WRIA 17 Watershed Grant #G0700097 from the Department of Ecology. Match funds will continue to be provided by documenting PUD payments toward the purchase of Peterson Lake, a critical aquifer recharge area. WHEREAS, the parties desire to amend the terms of that agreement. IT IS AGREED BETWEEN BOTH PARTIES AS NAMED HEREIN AS FOLLOWS: I. The term of the above referenced agreement ends on June 30, 2012. 2. The PUD will provide additional match funding needed to support activities in the amount of $14,328.50. 3. All other terms and conditions of the agreement will remain the same. BETWEEN JEFFERSON COUNTY PUBLIC UTILITY DISTRICT NUMBER 1 AND JEFFERSON COUNTY THIS AGREEMENT is made and entered into by and between the JEFFERSON COUNTY PUBLIC UTILITY DISTRICT NUMBER 1, hereinafter referred to as the "PUD", and JEFFERSON COUNTY, hereinafter referred to as the "COUNTY." IT IS THE PURPOSE OF THIS AGREEMENT is to provide the WRIA 17 Planning Unit $11,111 to satisfy the Department of Ecology's match requirements for the first year of a Watershed Planning "Phase Four Implementation" grant. The PUD is an "Initiating Government" in the comprehensive watershed planning process in Water Resource Inventory Area (WRIA) 17, also known as the Quilcene - Snow watershed. The County is the "Lead Agency" for the WRIA 17 watershed planning process, governed by RCW 90.82. The statute states that with respect to Phase Four Implementation Grants: "A match of ten percent is required and may include financial contributions or in-kind goods and services directly related to coordination and oversight functions. The match can be provided by the planning unit or by the combined commitments from federal agencies, tribal governments, local governments, special districts, or other local organizations. The phase four grant may be up to one hundred thousand dollars for each planning unit for each of the first three years of implementation." The PUD is in the process purchasing Peterson Lake to protect a critical aquifer recharge area in the Chimacum Creek sub-basin. This effort is implementing a key recommendation in the Watershed Management Plan developed under RCW 90.82 - specifically Recommendation Number 5 that asks water purveyors to protect critical aquifer recharge areas and wellhead protection zones. As we know, the Chimacum Creek Sub-basin presents the greatest challenge to resource planners in our WRIA given its critically low summer flows and high demands for water. Our understanding is that an $11,111 match is required for a one year Phase 4 grant, with a total project cost of $111,111. We also understand that this match must be provided within the one year grant period. The PUD is hereby offering to allow the WRIA 17 Planning Unit to use up to $11,111 of our payments for the purchase of Peterson Lake to satisfy the grant match requirements. The amount of these payments will be at least sufficient to equal the $11,111 match requirement for the first year Phase 4 Implementation grant. The County will use this documentation to support the match requirement in its capacity as Lead Agency for the WRIA 17 watershed planning effort. The County will apply for the Phase 4 Implementation grant on behalf of the WRIA 17 Planning Unit during calendar year 2006. IN WITNESS WHEREOF, the parties have executed this Agreement.
