Jefferson County PUD #1 Broadband Telecommunications Franchise
Schedule Publlc Hearing
Statement of Issue:
Attached for the Board's revlew and consideration In a publlc hearing Is a Resolution
granting the Jefferson County PUD #1 a franchise to construct, maintain, and operate
broadband telecommunications facllltles In County rights-of-way In eastern Jefferson
County.
Also attached Is a publlc hearing notice for a Board of Commissioners hearing on May
7, 2012.
Analysis/Strategic Goals/Pro's & Con's:
The Northwest Open Access Network (NoaNet) Is a consortium of publlc utility
districts that Is constructing broadband telecommunications facilities In rural areas of
Washington, Including Jefferson County. Bringing broadband telecommunications to
Jefferson County Is an Important component of the County's economic development
strategy. A franchise from Jefferson County Is required In order to construct the
facllltles In County Road rights-of-way. NoaNet and the PUD have agreed that the PUD
will hold the Jefferson County franchise and own the system. The facilities In
unincorporated Jefferson County would be located on SR 19, SR 20, and SR 116 and on
the County Roads llsted In Attachment A - Franchise Area on Page 17 of the Franchise.
Significant franchise terms and conditions:
. Section 2 Franchise describes the terms and conditions of the franchise. The
express terms and conditions of the franchise constitute a binding contract
between Jefferson County and the PUD. The franchise would be for fifteen years.
· Section 3 Performance of Work establishes the requirements for the PUD to
Install, maintain, and operate facilities In County rights-of-way.

. Section 4 Relocation describes the process and requirements for the PUD to
relocate its facilities in County rights-of-way in order to accommodate County
projects.
. Section 6 Rights and Powers Reserved to the County requires the PUD to
reimburse the County for its expenses related to developing the franchise.
. Section 7 Indemnification indemnifies the County against third party claims
related to the PUD's negligence.
. Section 8 Insurance establishes the PUD's insurance requirements.
Fiscal Impact/Cost Benefit Analysis:
The franchise requires the PUD to reimburse Public Works for its staff time expense in
preparing the franchise and for the expense of publishing and posting the public
hearing notice and filing the franchise with the County Auditor.
Recommendation:
Public Works requests that the Board schedule a public hearing on the Franchise
Resolution at 10:00 AM on May 7, 2012 and that the Chair of the Board sign the
attached public hearing notice.
Public Works will conduct a workshop and answer questions on the Franchise
Resolution before the public hearing.
