Snllivan District No.3 Commissioner: John Anstin County Administrator: Philip Morley Clerk of the Board: Erin Lundgren MINUTES Week of May 7, 2012 Chairman John Austin called the meeting to order at the appointed time in the presence of Commissioner David Sullivan and Commissioner Phil Johnson. PUBLIC COMMENT PERIOD: The following are a summary of comments made by citizens in attendance at the meeting and reflect their personal opinions: . A citizen presented a map of potential trails for Quilcene and thanked the Public Works staff that traveled to Quilcene to speak to residents about the transportation plan; . A citizen urged the Board to respond to a proposed bill requiring permits for farmers to sell pies or Jams; . More and more regulations are being required for farmers for problems that do not exist; houses are declining in worth; . A Los Angeles news paper ran an article years ago that stated people should move to Port Townsend because it is easy to get on welfare; . Consent Agenda Item No.4 is a contract for facilitating meetings that already have a meeting coordinator employee assigned to it and if we must contract this work out, why is it not a local person? Even though it is being paid with grant funds, the money is still public funds; and . The consultant for Consent Agenda Item No.4 does a very impressive job and is very economical. APPROVAL AND ADOPTION OF CONSENT AGENDA: Commissioner Sullivan moved to approve all items on the Consent Agenda as presented. Commissioner Johnson seconded the motion which carried by a unanimous vote. 1. RESOLUTION NO. 26-12: Adopting a Salary Schedule for the FLSA and Union Exempt Management and Professional Employees for 2012 2. RESOLUTION NO. 27-12: Establishing New Salaries for the Elected Offices of Jefferson County 3. AGREEMENT, Amendment No.2: 2012-2014 Consolidated Contract; Additional Amount of $26,657 for a Total of $660,673; Jefferson County Public Health; Washington State Department of Health 4. AGREEMENT: Provide Support Services for Clean Water District Advisory Committee Meetings; In the Amount of $9,000; Jefferson County Public Health; Blackmore Consulting, LLC 5. AGREEMENT, Supplemental No.4: Spruce Creek Culvert Replacement, Upper Hoh Road Mile Post 9.70; Federal Aid No. ER-0701(051), County Project No. X01736, X01781 and X01821; In the Amount of$15,573; Jefferson County Public Works; Tetra Tech Inc. Payment of Jefferson County Payroll Warrants: Dated April 20, 2012 Totaling $87,728.68 and AlP Warrants Done by Payroll Dated April 20, 2012 Totaling $44,630.01 Proclaiming the Week of May 14-I8, 2012 as National Police Week and Observe May 15,2012 as Peace Officers' Memorial Day: Chairman Austin read the proclamation proclaiming the Week of May 14 - 18,2012 as National Police Week and Observe May 15,2012 as Peace Officers' Memorial Day. Commissioner Johnson moved to approve the proclamation. Commissioner Sullivan seconded the motion which carried by a unanimous vote. The Board presented the proclamation to Sheriff Civil Deputy Brian Tracer. Jefferson County Finances/Banking: As a follow up to the Occupy Movement requests, Treasurer Judi Morris stated Jefferson County banks with Bank of America through a contract which expires December 31,2013. She will be asking for Request for Proposals (RFP) in the Summer of2013. The contract will become effective in January 2014. The contract will be awarded based on services provided and the cost for those services. The needs of the County are complex. It has been suggested that the County use a Credit Union or a local bank, but many of the services required by the County are not offered by local banks. The State of Washington also banks with Bank of America. The County invests $62 million and none of that money is invested with Bank of America. It is invested in the Washington State Pool which is controlled by the Washington State Treasurer. The County also invests in treasuries and CD's. The primary CD's the County has are with Kitsap Bank. County Administrator Morley asked ifthe invested $62 million is entirely County funds? Treasurer Morris answered, no, it includes the hospital, school district and fire districts. Approval of Minutes: Commissioner Sullivan moved to approve the meeting minutes of January 23,2012 as presented. Commissioner Johnson seconded the motion which carried by a unanimous vote. Page 2 Commissioners Meeting Minutes: Week of May 7, 2012 (1~"" f"-t ~i.~,'~~~c'" COMMISSIONERS BRIEFING SESSION: The Commissioners each provided updates on the following items: Chairman Austin reminded everyone there is a special Board meeting tonight on Marrowstone Island and that next weeks regular Monday Board meeting is canceled. He will be attending a presentation on fish farms next week. Commissioner Sullivan will be meeting with Washington State Association of Counties (WSAC) this week. Commissioner Johnson went to a Legislative Steering Committee conference last week in Chelan. He will be going to a Olympic Regional Clean Air Committee meeting on Wednesday and following that meeting he will be out of town until next Tuesday. HEARING: Granting a Nonexclusive Franchise to Construct, Maintain and Operate Broadband Telecommunications Facilities in County Rights-of-Way in Eastern Jefferson County with Public Utility District No. I (Rescheduled to 5/29/12): County Administrator Morley stated NoaNet has requested some changes to the franchise agreement. Project Manager Jim Pearson stated the franchise agreement is for a broadband project which is sponsored by several local entities. There has been last minute requested changes from the Public Utility District No.1 to the franchise. Chairman Austin asked if the changes were of such a nature that the hearing should be rescheduled in order for the public to have time to review and comment on the requested changes? Mr. Pearson answered his preference would be for the changes to be stated, receive public testimony and discuss how the Board would like to proceed. Mr. Pearson reviewed the franchise and requested changes. County Administrator Morley stated that because of the requested language changes, public testimony may be received today, but another hearing needs to be scheduled. Chairman Austin opened the hearing for public testimony. Hearing none, he closed the hearing. Commissioner Johnson moved to approve a hearing notice regarding granting Jefferson County Public Utility District (PUD) No.1 a nonexclusive franchise to construct, maintain and operate broadband telecommunications facilities in County rights-of-way in Eastern Jefferson County scheduled for Tuesday, May 29, 2012 at 10:00 a.m. in the Commissioners Chambers. Commissioner Sullivan seconded the motion which carried by a unanimous vote. The meeting was recessed at 10:22 a.m. and reconvened at 10:31 a.m. with all three Commissioners present. Page 3 Commissioners Meeting Minutes: Week ofMav 7, 2012 HEARING: Moratorium on New Mooring Buoys in the Southern Portion of Port Townsend Bay: Planning Manager Stacie Hoskins presented an extension of a moratorium on new mooring buoys in the southern portion of Port Townsend Bay. Others present were Allen Bogner representing the Washington State Office of Regulatory Assistance, Brady Scott from the Washington State Department of Natural Resources (DNR) and Mark Toy representing the Washington State Department of Health (DOH). Mr. Scott stated in December an inventory was completed of mooring buoys in the southern portion of Port Townsend Bay. The inventory results showed 54 mooring buoys or vessels were counted in total and of those, 15 were authorized. In April inventory was counted again and the number had decreased to 42. There are three mooring buoys that are authorized by Jefferson County, but do not have authorization from DNR. Two of the three have a pending application with DNR. Mr. Toy stated a dozen buoys or vessels must be moved in order to protect a shellfish farm in the area. Chairman Austin opened the hearing for public testimony. Alden Johnson: As a former cruiser, he would not know that he was unauthorized to anchor in a particular area unless it stated so on a buoy. How would he know it's not authorized? Would it be on marine charts? Mr. Scott stated anchoring is allowed State owned aquatic land up to 30 days in a 90 day period of 365 days. If a vessel is anchored longer than that, it is not considered temporary. The vessel must move a minimum of five miles away from the previous anchored spot. Ms. Hoskins stated in the draft Shoreline Management plan there is a public education portion regarding voluntary no anchor zones, so education is made from the water and the land areas. Hearing no further comments, Chairman Austin closed the public hearing. Commissioner Sullivan moved to approve ORDINANCE NO. 05-0507-12 approving an extension of the moratorium on new mooring buoys in the southern portion of Port Townsend Bay. Commissioner Johnson seconded the motion which carried by a unanimous vote. Emergency management Services: Emergency Management Director Robert Hamlin gave the Board an update on current activities and projects occurring in the Jefferson County Department of Emergency Management. Letter of Support: Commissioner Sullivan moved to approve a letter to the Washington State Recreation and Conservation Office in support of the Washington Wildlife and Recreation Program Grant Application submitted by the Washington State Department of Natural Resources for Dabob Bay Natural Area. Commissioner Johnson seconded the motion which carried by a unanimous vote.
