OPENING BUSINESS The meeting was called to order at 7:35 p.m. by Vice Chairman,Burkhart. Members present were George Burkhart, Finis Stevens, Dorithe Harrington, Harry Pollard, D. Stewart Lennox, and Richard Kenyon. Eva Taylor arrived at 8:00 p.m., during the request for a road vacation by Fred Edwards. A quorum was declared by Vice Chairman Burkhart. Representing the Planning Department staff were Associate Planner Carol Saari and Secretary Laura Southmayd. Guests were Judith Edwards, Fred C. Edwards, Phil Boling, Carmen Boling, Jean Lennox, and Port Townsend Leader Reporter Denis Anstine. Minutes of April 4, 1979, were approved as written. II. PETITIONS FOR VACATION OF COUNTY ROADS A. Robert E. Bates: Carol Saari reviewed the request., The petitioner wishes to vacate a portion of a ten foot wide alley in Block 5 of Olsen's Addition to Irondale in order to create a larger usable area for construc- ting residential units. Findings made by applicable departments and agencies were reviewed (copy attached to official minutes). Richard Kenyon moved to recommend to the County Commissioners they approve the request for vacation as it meets all the criteria for approving road vacations. Dorithe Harrington seconded the motion and upon a vote it carried with unanimous approval. B. Fred C. Ewards: Carol Saari reviewed the request to vacate the Lone Star Road, 'located approximately three miles northeast of-Quilcene. The road is ten feet wide and one-half mile long. Findings of applicable agencies and departments were reviewed- Three conditions for vacation of approval were also reviewed. (Copy.attached to official minutes.) Fred Edwards, the petitioner, and his wife Judith, explained why they submitted the petition. The road was not recorded on their deed, or on other property owners deeds whose property fronts the road. But the court recently decided that the road is a County road. They said that the road is very hazardous; it is narrow, it has never been maintained, and the terrain is very poor. It is not used by any adjacent property owners except Bayview Industries, located at the end of the road. If the Road were vacated, Bayview Industries could construct a road onto the Dabob Bay Road. Phil Boling of Bayview Industries said a road to the Dabob Bay Road would -1- be impractical due to the terrain. Members discussed whether a road could be constructed from Mr. Boling's property to Dabob Road, as prescribed by the County Engineer. They also discussed the court case declaring the road a County road. Dorithe Harrington moved to withhold taking any action on the petition unttl the Commission could inspect the site. There being no second the motion was not voted on. Finis Stevens moved to table the peititon until more information could be presented, such as whether the County would improve the road. There being no second the motion was not acted upon. Eva Taylor moved to recommend to the County Commissioners they deny the request because on property owner adjacent to the road wishes to continue using the road. Finis Stevens seconded the motion. Upon a vote it carried with four in favor and two opposed, Rick Kenyon and Harry Pollard. Harry Pollard said he opposed the denial because he felt Bayview Industries was taking advantage of it's neighbors. He felt the Commission should take no action to the petition. III. PRELIMINARY LONG PLATS.. A. Chimcaum Creek Estates II, #C-78: Carol Saari read a letter from the developer's planner, Ken Sweeney of Clark and Associates, to the Planning Department dated April 17, 1979, asking that an extention be given for his preliminary plat for six months. Miss. Saari reviewed the preliminary plat that was approved by the County August 7, 1979. Approximately forty-three acres south of the Hadlock Road and east of Chimacum Creek will be divided into forty-nine residential homesites. The proposal will be an extention.of an existing subdivision of approximately thirteen acres into twenty-seven lots. Finis Stevens moved to recommend to the Board of County Commissioners that they approve the extention on the preliminary plat until August 7, 1980. Dorithe Harrington seconded the motion. Upon a vote the motion carried unanimously. B. Tamarack Village, #T-78: A letter from M.C. MacLearnsberry, Inc. to the Planning Department dated April 20, 1979, was read by Carol Saari. Mr. MacLearnsberry asked that a twelve month extention be given for his preliminary plat. Miss. Saari reviewed the proposed subdivision. Approximately twenty-two acres will be divided into forty-nine residential lots on property located in Irondale. The preliminary plat was approved by the County June 12, 1978. Finis Stevens moved to recommend to the County Commissioners that they grant the extension on the preliminary plat. Harry Pollard seconded the motion and upon a vote it carried with unanimous approval. -2- • be impractical due to the terrain. The developer; Richard Thornton, did not write a letter asking for an extention on his preliminary plat, even though it will expire May 9, 1979. He had verbally stated he was having some difficulties. --and would not be able to meet the expiration date for -sub- mittal of a final pl.4t. Miss. Saari reviewed the preliminary plat approved by the County May 9, 1977, and extended in 1978 for one year. Approximately ten acres will be divided into eighteen mobile home sites one-half mile north of Brinnon. Finis Stevens moved to recommend to the County Commissioners they approve an extention on the preliminary plat for one year. Eva Taylor seconded the motion. It carried with an unanimous vote for approval. D. Sunset Haven, #S-76: Carol Saari read a letter dated April 16, 1979, from Bud Rogers to the Planning Department asking for an extention of his preliminary plat. Miss. Saari explained that the proposed subdivision! would be located west of the .Hood Canal sunken bridge on approximately five acres. It would create five residential homesites. The preliminary plat was approved by the County June 6, 1977, and extended in 1978 for.e./ one year. Finis Stevens moved to recommend to the County Commissioners they give a years extention on the pr liminary plat. Dorithe Harrington seconded the motion. Upon a vote it carried with unanimous approval. IV. FINAL LONG PLATS A. Cotton Long Plat #C-79: Carol Saari reported on the proposed. development. The suLivi ion is a resubdivision of the Weidman Short 4 Plat f.1Tedwiththe County ecember 8, 1975. Then,: 1 pT was the division of approximately three acres into four commercial lots in Hadlock. The developer now proposes -to divide Lot 1-of that short ,plat into -two lots, which .requires filing of a long plat because the resubdivision ill occur within five years. Miss. Saari noted the preliminary plat was approved by the County April 9, 1979. All conditions of that,approval have_been.met. Finis Stevens moved to recommend to the County Commissioners they approve the final plat as submitted. Dorithe Harrington seconded the motion and it carried with an unanimous vote for approval. V. MISCELLANEOUS Members discussed the transportation situation in the TriA.rea, and the effects of road vacations on it. They decided to submit a request to the Board of Commissioners to have the County Engineer's develop a circualtion pattern for the area and to set a moritorium on any road vacations until such a pattern is developed. The Planning Department staff was instructed to write such a request on behalf of the Commission. Vice -Chairman Burkhart reported on "a.ppearance of fairness" and "donflict of interests", as discussed at the recent "Short Course fn Local Planning" -3- I workshop recently held by the Commission at Fort Worden. DEVELOPMENT: Resubdivision of Lot 1 of the Wiedman Short Plat into 2 commercial lots. According to the Jefferson County Subdivision Ordinance, Section 5.111, lots created through the.short subdivision process shall not be further divided in any manner -within a period of five (5) years without the filing of a long plat. On December 8, 1975, the Wiedman Short Plat, a plat consisting of four commercial lots, was approved and filed. Therefore, because the applicant is proposing. to resubdivide a short plat lot within the five (5) year period he is proceeding in full compliance with the Subdivision 0-1inance by the filing of a long plat for the resubdivision. As designated in the Jefferson County Park, Recreation, and Open Space -Plan, a County bike trail route runs along County Road No. 18 (Chimacum-Hadlock Road), abutting the east boundary line of the subject plat. 3. The ten percent open space requirement will be met by fees -in -lieu of, as prescri-bed in Section 6.204(1) of the Jefferson County Subdivision Ordinance. Public Works Department: 1. Constructed County roads abut the subject plat on three (3) sides, therefore,'access provision will not be a problem. DEPARTMENT AND/OR AGENCY RECOMMENDED CONDITIONS FOR FINAL PLAT APPROVAL: Jefferson County Planning Department: I. Stevens, Tax 9 REQUEST AND ROAD DESCRIPTION: To vacate the whole distance of County Road No. 18-3.50- -M4 (the Lone Star Road) beginning at the intersection of County Road No. 18-3.50 (Dabob Road) and said County road, running in a southwesterly direction to the terminis of said County road; the whole distance being about one-half mile in length and about ten feet in width; all located in Section 5, Township 27 North, Range 1 West, W.M. The petitioner is requesting to vacate the whole distance of the Lone Star Ranch Road because (a) the County has not maintained the road for the last twenty-five years and all maintenance has been privately financed, and (b) the Lone Star Road is only ten (10) feet wide. DEPARTMENT AND/OR AGENCY FINDINGS: County Public Works Department: 1. The proposed vacation will not conflict with the orderly expansion of the County road system. 2. On March 5, 1979, the petitioners went to Supreme Court.against Bay Industry (Phil Boling). The petitioners cl.a.imed that Say Industry was not entitled to use of the Lone Star Road for current logging activities.. The decision of the Court is that the Lone Star Road is assigned a County road number (18-3.50-0.34), is included on the County road- map, and is therefore a County road. S ES.TM.-CONDITIONS FOR APPROVAL: 1. .An easement for;'utility maintenance along said .road shall be secured by the applicant with the electric power and telephone companies. 2.
