SUBJECT: Consultant Contract with Shockey Planning Group to assist with clarification of Iron Mountain
Quarry permit conditions
STATEMENT OF ISSUE:
Shockey Planning Group, Inc was retained by Jefferson County and the Washington Risk Pool to assist with
SEPA and permitting reviews for applicant Iron Mountain Quany. The applicant requested a stormwater permit
allowing development of the New Shine Quarry adjacent to the existing Shine Quarry near Port Ludlow. A
SEPA MDNS and Stormwater Management permit were issued on Apri120, 2012 and September 28, 2012,
respectively. The Applicant has requested clarification of certain permit conditions and/or compliance
requirements. Jefferson County requests assistance from the Consultant in reviewing these requests and
responding to the Applicant.

ANALYSIS/STRATEGIC GOALS/PROS and CONS:
Given Shockey Planning Group, Ines previous work on the issued stormwater permit and SEPA analysis, their
expertise is imperative to the County's response to the Applicant's inquiry.
FISCAL IMPACT/COST-BENEFIT ANALYSIS:
DCD Staff time and Consultant services not to exceed $6,500.00 will be paid from the General Fund Non-

DCD recommends the Board of County Commissioners approve the Consultant Agreement for Professional
Services for Jefferson County Permit Review between Jefferson County and Shockey Planning Inc.

The Consultant was retained b}F Jefferson County and the `G~''ashington Risk fool to assist

requested a stormwater permit allowing develc~prrtent of tl~e '!'~e~v Shine Quarry- adjacent to
the existing, Shine Quarry` near Part Llrrdlo~v. A SEPA MDNS and Stormr~~,ater lvlanagement
Permit were issued on April Z(1, 2t) l2 and Septen~her 28, 2~ 12, respectively, "I'he Applicant
has requested. clarification of certain permit conditions andlor compliance requirements.
Jefferson County requests assistance front tyre Cons~rltant in reviewing these requests and
responding to the ~-lppliarrt.
~'he Consultant agrees to perlorm certain advisory services for the Client:
l . ReviewF of tyre Applicant's requests.
2. Consultation. with the [Arent and County's legal counsel in formir-rg responses to the
requests,
3. Coordination of transportation subconsultants o3z items related to truce. traffic, traftac
monitorinf; or other transportation issues. The Consultant will review ~4~ith the Client the
specific requests >7y the ~ipplicant to determine the level of sukrconsrrltant assistance
needed.
~i-. Review of information propsided ~y the Applicant related to compliance w°ith tlxe critical
area mitigation and conditions contained in the September 28 permit.
5. Confirmration with Perfect Inc. of their review and agreement with the .applicant's
storrnwater plan.
6. attendance at meetings writh County Staff, applicant, legal counsel, etc, as directed. by the
Client.
7, C)ther services as requested related to the storm~vater permit.
This Scope of ~~w'orlc does nc~t include the following:
• Assistance with I~tJl7A andlor SEPA appeals.
• 1lssstance as~~itlr legal proceedings involving any damage claims asserted by tl~e
applicant.
II. ~'E~YVIE1~iT
Client agrees to pay Consultant as compensation for these services liour•ly rates iri
accordance with the attached 1`ee Schedule (plus direct expenses in accordance with the
schedule). 'fhe estimat~.d labor ar3d cost distribution is $6,500 based on the follo~~,~ing
estirnatcs:
Principal 10 hours
Senior Associate 10 hours
'G~'etland Scientist 113 hours
Clerical 3 hours
Ciibsora .frafiic Consultants 10 hours
Actual fees. could exceed this estimate depending on the mature and complexity of issues that
z~;ray arise during the analysis. It is agreed by the Client and Consultant that due diliger~ree
and practical approaches to achiev°ing the desired outcome will be the foremost
consideration. Consultant shall keep Client advised of needed work elements that exceed
the scope of servicc;s previously described.

Detainer is waived for Client.

The attached Standard Provisions are incorporated into and made a part of this Agreerx~ent.
Client and Consultant also agree to the following additional prcovisions:
Payment tc~ Consultant shall not exceed $6,500,[lU without prior written agreement executed
by bath patties; said w-ritten agreement to include both an estimate cif ad~litaonal prc~fessona]
hours needed to complete the objectives arad scope of work laid out in Section 1 above and a
new° maximum payment arnoarnt.

Subconsulta9rt, technical or prafessianal services shall be billed on the basis o#~ actual charges plus

balaraee after deducting payments and credits for the current mnartla} will be charged on all past-due

referred far crallection. In such an went, Client understand., that reasonable. attorney fees will be
added to the amount sought.
