Regular Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners Philip Morley, County Administrator FROM: Carl Smith, Director, Department of Community Development Stacie Hoskins, Planning Manager, DCD ~' DATE: June 3, 2013 SUBJECT: Deliberation and Decision regarding Establishment of the Final docket for the 2013 Comprehensive Amendment Cycle STATEMENT OF ISSUE: Pursuant to Chapter 18.45.060(4)(b) of the Unified Development Code (UDC), Title 18 of the Jefferson County Code (JCC), a preliminary docket was not required this year as Jefferson County received only two site-specific Comprehensive Plan Amendments. A suggested amendment for increasing density allowances in Jefferson County's West End was initiated by the Planning Commission and subsequently unanimously decided to be put on hold to allow for an action plan in advance of consideration in 2014. The Planning Commission further approved a motion with a vote of 4-2-0 to, "Collect information from the residents of the West End sufficient for us to develop MLA13-00042, collected by the end of 2013 and discussed by the Planning Commission." No other suggested amendments were submitted to the Department of Community Development by the Mazch 1, 2013 deadline. Attachments: Administrator's Report Preliminary Docket with Full Applications ANALYSIS/STRATEGIC GOALS/PROS and CONS: Per JCC18.45.050 Formal site-specific applications for amendments that are properly and timely filed under JCC 18.45.040(2)(a) shall be placed on the final docket for consideration during the current annual amendment process. Per JCC 18.45.060(4)(c) The decision of the board of county commissioners to adopt the final docket does not constitute a decision or recommendation that the substance of any formal site-specific, suggested, or planning commission recommended amendment should be adopted. Fr: Stacie Hoskins, Planning Manager ~{;{~ Date: March 12, 20I3 (,} Re: DCD review nf'Preliminary Docket for 2013 Comprehensive Plan Amendment Cycle and Administrator's Report for the 2013 Final Docket BackerouQd Pursuant to Chapter I8.45 of the Jefferson County :code, DCD is charged with the task of reviewing suggested amendments on the Preliminary Docket for'the Annual Comprehensive Plan Amendment Cycle and preparing a report connerning which suggested amendments strould be placed on the Final Docket. In so doing, staff is required to address the need, urgency, and appropriateness of each suggested amendment and to include the following considerations in their recommendation: a) The availability of suffecient DCD staffto substantively review the suggested amendments and:manage the public-review process. b) Anticipated DCD cost and budget for processing the suggested amendments. 'these recommendations consider the proposed amendments in the context of need, urgency, and appropriateness, and also based upon available resources. Sui?eested Amendments There is one {1) suggested omprehensivePlan amendment on the Preliminary Docket (see attached).. The suggested amendment. is proposed by the Jefferson County Planning Commission. Complete copies of each application have been provided to the Planning: Commission and the BoCC. There<is a webpage dedicated to the 2013 Cycle that can be accessed' from the County homepage: http://www.co.jefferson.wa.us/commdeve]opmentlCP I7DCamendments.htm Formal Site•Specific Amendments In addition to the suggested amendment,leffeeson County has receued twn (2) formal site-spee~c amendment applications for a total three (3) proposed amendments. Pursuant to JCC 1$.45.050(3), site-specific applications are automatically included onthe Final Docket. Discussion of DCD Staff Snfficieacy DCD's staff resources: have been significantly reduced, and he 2013 work plan reflects this reduction in force. Urgency of some projects and state requirements often direct the focus of the Long Range Planning (J ItP}work plan. Inclusion of suggested amendments nn the Final Docket shall consider LRP resources and. workload. Suggested amendments are financed b}'the gexieral fund and are not fee-supporked. Anticipated DCD Cost and Budget. Application fees have been collected for the two site-specific amendments. Some applications have the potential to require much more personnel time and expense due t4 the level of potential environmental impacts and the public interest in these applications. The scale, complexity, and potential contrgversy of the rezoning thousands of acres on the West End are a challenge to DCD staffing. Specifically, the cost of staffing to process this amendment, proposal exceeds the standard cost per applieatiatt of $3,4D8. Current DCD staff resources are insufficient to complete review of this proposal without additional resources. Plannin>= Commission Work Plan in addition to staff time, it should be noted that all Comprehensive Plan amendments require review by the. Planning Commission. The Planning Commission will need to consider other issues during this year, including, but not limited to; substantive review and public process related to: • 2013 Comprehensive Pfan Amendment Cycle: two site-specific rezone requests Pleasant Harbor Master Planned Resort development agreement, zoning code, zoning map with associated supplemental EIS; • UDC text amendment to update the Sign Gode; • UDC textamendment to address permitadministratfon issues; The Planning Commission regular meeting schedule includes one meeting per month.. A review of the 2013 Planning Commission schedule of tasks argues for a reduced work plan, as the number of suggested amendments included on the Final Docket ditectly affects the Planning Commission's ability to provide thorough and thoughtful amendment review. Following is a summary description of the suggested amendmentorr the Preliminary Docket and staff comments in relation to project demand with respect to need, urgency, and appropriateness, and in the context of available resources: I, MLA13-42 proposed by Jefferson County Planning Commission, requesting the Following: Rezone lands designated Rural Residential in Jefferson County's West, End (RR 1:10 and RR 1:20) to RR I:S. Approximately 1,907 acres of land are zoned ItR 1:10 and 23, 983 acres aze zoned ItR 1:20. Starecagnizes that this proposed amendment will command a substantial degree of County resources to implement. Conclusion Based on an assessment of need, urgency, and appropriateness, as well as considerations of DCD staffing levels;. anticipated cost and budget, and current countywide budget conditions, staff recommends that the suggested amendment; MLA13-42, nor be included as the suggested amendment an the 2013 Comprehensive Plan Final Docket. If the suggested amendment is not docketed by the BoCC, the Final Docket. will be composed ofa total of the two (2)site-specific applications that are automatically included. For the aforementioned reasons, DCD recommends that the Final Docket be limited to a sum total of two (2) amendment proposals. Should the Board decide to include the suggested amendment or the Planning Commission deems additional committeesnecessary, we recommend tihe Board grant DCD the authority and funding to obtain additional staffing. This 207-acre farm, which is boated on the west side of U.S. Highway 101 approximately 4.5 miles south of Discovery Bay and 7 miles north of Quilcene, is zoned entirely for resourced based uses - both agricutural (AP-20) and forestry (RF-40). The proposa! seeks merely to expand the area designated and zoned as Prime Agricultural lands {AP-20) by approximately 12.80 acres, and reduce the area presently designated as Rural Forest land (RF-40) by a corresponding amount. If approved, the total amount of designated resource land within Jefferson County would remain unchanged. The proposed change would require an amendment to the Land Use/Zoning Map of the Jefferson County Comprehensive Ptan to expand the AP-20 designation and zone to encompass approximately 11.80 acres of currently RF-40 land on APN 862141005. Fuel prices have risen, the economy fell into a deep recession, jobs and businesses have disappeared, and unemployment has risen drastically. As a result ofi these geological processes, the County has steep marine bluffs composed of glacially-deposited sediments and with varying levels of stability. Some of these bluffs are developed. with individual residences, although the bluffs remain largely intact.
