Sullivan District No. 3 Commissioner: John Austin County Administrator: Philip Morley Clerk of the Board: Erin Lundgren MINUTES Week of May 13, 2013 Chairman John Austin called the meeting to order at the appointed time in the presence of Commissioner David Sullivan and Commissioner Phil Johnson. PUBLIC COMMENT PERIOD: The following is a summazy of comments made by citizens in attendance at the meeting and reflect their personal opinions: • A citizen commented that relocating animals to other areas is not beneficial to the animals; • A citizen stated that Jefferson County Department of Community Development staff did a well researched report; • A citizen voiced his concern about the Commissioners" use of personal cell phones for County Business. He previously stated that he submitted a public records request because he believed they are making decisions without going through the proper steps; and • A citizen commented on the previous public comment stating their allegations were based on speculation and they needed to review the records already provided to them. APPROVAL AND ADOPTION OF THE CONSENTAGENDA: Commissioner Johnson moved to approve all the items on the Consent Agenda as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. 1. AGREEMENT NO. G1400003 re: Jefferson County Toxic Cyanobactieria Project; In the Amount of $20,000; Jefferson County Public Health; Washington State Department of Ecology (DOE) 2. AGREEMENT NO. 1163-27310, Amendment No. 4 re: Substance Abuse Prevention; Amount Reduced by $625 for a total of $77,805; Jefferson County Public Health; Washington State Department of Social and Health Services (DSHS), Division of Behavioral Health and Recovery 3. AGREEMENT re: Memorial Field Drainage Improvements; In the Amount of $8,645; Jefferson County Public Works; Seton Constmction 4. AGREEMENT NO. G1200268 re: Coordinated Prevention Grant Program for Solid Waste Management Plans and Programs; In the Amount of $131,563 (State Share) and $43,853.33 (Local Match); Jefferson County Public Works; Washington State Department of Ecology (DOE) 5. Advisory Board Appointment: Climate Action Committee (CAC); Citizen at Large Representative; Cynthia Jayne 6. Payment of Jefferson County Payroll Warrants Dated May 3, 2013 Totaling $772,095.90 and A/P Warrants Done by Payroll Dated May 3, 2013 Totaling $674,041.42 COMMISSIONERS BRIEFING SESSION: The Commissioners each provided updates on the following items: Chairman Austin - Attended the Hargrove Committee Meeting and was impressed with the speakers - Attended a Community Input Meeting in Brinnon Commissioner Johnson - Attended an Olympic Regional Clean Air Agency (ORCAA) Committee meeting - Spoke with Senator Hargrove regarding the needs of Jefferson County - Will be attending a LEOFF 1 Board meeting this week - Will attend the Public Health Board meeting this week - Attended a Community Input Meeting in Brinnon Commissioner Sullivan - Attended a Community Input Meeting in Brinnon DISCUSSION re: Proposed Amendment fo the Port Ludlow DeveZopmentAgreement: The Commissioners listened to a presentation by the (DCD) staff regarding the proposed amendments to the Port Ludlow Development Agreement and Memorandum of Understanding. Associate Planner David Wayne Johnson recapped the progress of amending the Port Ludlow Development Agreement which resulted in the need for extending the plat approval. He stated that all of the public comments his office received, agreed with the extension, however, there were some that addressed concerns regarding contaminated soil at the Port Ludlow Golf Course, and a well at another location. He has been in touch with Chris Matthews of the Washington State Department of Ecology (DOE) regarding the two main sites of concern. The DOE ranked the Golf Course site a #3 and the well site a #2. According to their ranking system, ratings of 2 and 3 are to be handled by the site owner, but DOE can assist. The Port Ludlow Associates (PLA) and the Olympic Water and Sewer, Inc (OWSI) need to come to an agreement to get the site with the drinking water issues, cleaned up. Associate Planner Johnson also requested permission from the Commissioners to draft a letter to the DOE to seek cleanup assistance as well. As a result of speaking with Teresa Walker with the State Department of Health (DOH), Associate Planner Johnson confirmed that the number of connections approved are consistent with the MERU counts. He also spoke with Marie Peters with DOE and she confirmed that Port Ludlow's water rights are consistent with the Water Plan through 2025. There would be a need to apply for more water rights after that time, but actual use would need to be demonstrated to receive certificate. After in-depth research of the issues and confirming with both the DOE and DOH that there is adequate water and water rights for Port Ludlow, Associate Planner Johnson requested approval of the documents presented. Commissioner Sullivan moved to approve RESOLUTION NO. 2020=13 re: To amend a development agreement with land owned by Port Ludlow Associates per Section 4.6, Exhibit A of the Port Ludlow Development Agreement Resolution No. 42-00 and to approve the two Agreements amending the Port Ludlow Development Agreement. Commissioner Johnson seconded the motion which carried by unanimous vote. Commissioner Johnson moved to direct the DCD staff to draft a letter to the Washington State Department of Ecology requesting assistance in the cleanup of contaminated soil in Port Ludlow. Commissioner Sullivan seconded the motion which carried by unanimous vote. The meeting was recessed at 10:07 a.m. and reconvened at 1:31 p.m. with all three Commissioners present. COUNTYADMINISTRATOR BRIEFING SESSION.• Update re: Port Hadiock Wastewater Treatment System: Joel Peterson, Associate Planner and Frank Gifford, Public Works Director were present to discuss State and Federal grant/loan timing cycles along with a potential Local Improvement District (LID) organization in 2014. The amount the project is presently drawing on the Public Works Trust Fund Loan that will trigger annual repayment costs of around $70,000 a year starting in 2017. Additional draws from the loan would increase this amount. Presentation re: Organization of an Emergency Preparation Picnic: Judith Alexander. Loca120/20 stated an Emergency Preparation picnic will be held on July14, 2013 at HJ Carroll Park. She is seeking co-sponsorship of Department of Emergency Management (DEM) and potential contribution by the County for a newspaper advertisement. The organizing meeting will be held on May 30, 2013. County Administrator Morley will look into insurance requirements for the event and how County sponsorship may affect this. Ms. Alexander also noted a June 26, 2013 meeting of Citizens for Local Foods to discuss a potential Food Policy Council. County Administrator Philip Morley reviewed the following with the Board: Calendar Coordination • JeffCom's May meeting has been moved to May 31, 2013. Chairman Austin will be out of the office; County Administrator Morley will attend • Commissioner Sullivan will attend a Food Panel discussion on May 17, 2013 • Commissioner Johnson will be attending the Hood Canal Coordinating Committee (HCCC) on May 14, 2013 • Rhody Parade is on May 18, 2013 • SPECIAL MEETING: Community Input meeting at the Port Townsend Community Center on Page 3 Commissioners Meeting Minutes of May 13, 2013 May 21, 2013 • Commissioner Sullivan will be meeting with the Washington Transportation Commission (WTC) on May 21-22, 2013 • Chairman Austin will be attending a Washington State Association of Local Public Health Officials (WSALPHO) meeting on June 11, 2013 NOTICE OFADJOURNMENT: Commissioner Sullivan moved to adjourn the meeting at 2:46 p.m. until the next regular meeting or special meeting as properly noticed.
