HomeMy WebLinkAbout080513_ca15Consent Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of Commissioners FROM: Philip Morley, County Administrator DATE: August 5, 2013 RE: Prosecuting Attorney 2013 Organizational Chart STATEMENT OF ISSUE: County Commissioner approval of a change to the 2013 Organizational Chart for the Prosecuting Attorney's office is requested. The change will designate a second Deputy Prosecuting Attorney III, through promotion of an existing Deputy Prosecuting Attorney II position. This change will enable to the position to be designated as the "Chief Criminal" Deputy Prosecuting Attorney, necessary for the effective function of the Criminal Division. ANALYSIS: As stated above, approval of the revised Prosecuting Attorney's office 2013 Organizational Chart will designate a second Deputy Prosecuting Attorney III, through promotion of an existing Deputy Prosecuting Attorney II position. Key differences in the essential functions of a Deputy Prosecuting Attorney II and a Deputy Prosecuting Attorney III include: providing leadership, legal advice, training and assistance to junior Deputy Prosecutors and support staff; directing work assignments; having complete discretion within the scope of policy and regulation in the performance of duties; and directing and assisting co- counsel or retained counsel and subordinate Deputy Prosecutors. The Prosecuting Attorney's office is structured with two divisions: Civil Division and Criminal Division. There currently exists a Deputy Prosecuting Attorney III position within the Civil Division which is designated within the Prosecuting Attorney's office as the "Chief Civil" Deputy Prosecuting Attorney. Promoting an existing Deputy Prosecuting Attorney II employee to a Deputy Prosecuting Attorney III position within the Criminal Division is needed to support the organizational structure of the Prosecuting Attorney's office and to allow for the successful performance of statutory requirements. The Prosecuting Attorney's office may designate the Deputy Prosecuting Attorney III position as the "Chief Criminal" Deputy Prosecuting Attorney for the Criminal Division. FISCAL IMPACT: The wage and benefit costs for the career advancement from a Deputy Prosecuting Attorney II to a Deputy Prosecuting Attorney III will be $2,338.94 in 2013 which will be covered by funding in the Prosecuting Attorney's existing budget. In 2014 and beyond, the Consent Agenda total increase to the base budget each year is approximately $5,291.31 which will be funded from the Prosecutor's discretionary portion of the Jefferson County Drug Fund. RECOMMENDATION: Approve the attached Prosecuting Attorney's office 2013 Organization Chart allowing for promotion of an existing Deputy Prosecuting Attorney II to a Deputy Prosecuting Attorney III position.
