Regular Agenda Commissioners Office JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners Philip Morley, County Administrator FROM: Julie Shannon, Executive Secretary I DATE: August 5, 2013 SUBJECT: POSSIBLE APPROVAL: RESOLUTION re: Calling for a Special Election on Whether to Choose a Board of Freeholders to Frame a County Charter; and to Choose Freeholders to Draft a Home Rule Charter for Jefferson County and Prescribing the Procedure for the Election of such Freeholders STATEMENT OF ISSUE: A petition proposing that a board of fifteen (15) freeholders be elected for the purpose of framing a Home Rule Charter for Jefferson County pursuant to Article XI, Section 4, of the Washington State Constitution. The County Auditor has certified that the petition was signed by a number of registered voters exceeding 10% of the voters in the last general election. Under State law and the Constitution, the Board of County Commissioners (BoCC) is responsible for passing a Resolution placing the issue on the ballot, and for establishing the procedure for the nomination of qualified electors as candidates for the board of freeholders. A Resolution for this purpose has been proposed for adoption by the BoCC. It sets the election for November 5, 2013, provides guidelines on how the ballot shall appear, including a ballot proposition on whether a board of freeholders be elected, and the form for the election of the candidates for freeholder. Freeholder candidates elected would only serve if the ballot question on electing the board of freeholders passes by a simple majority. The board of 15 freeholders, if the ballot proposition passes, would be comprised of five freeholders from each of the three County Commissioner districts. Candidates for Freeholder must be qualified electors, be a resident of the Commissioner district from which they are seeking election, and shall have resided within Jefferson County for a continuous period of not less than five years prior to election. All Freeholder candidates must be registered voters of Jefferson County. All fifteen Freeholder positions shall be non - partisan elected positions and are not paid. The term of office would begin the day after certification of the general election, and would end June 30, 2015 or upon submission of a charter to be placed for public vote, whichever comes first. Regular Agenda Commissioners Office Based upon consultation with the County Auditor, the candidate filing period for those interested in running for the board of freeholders will be between 8:30 a.m. and 4:30 p.m. August 14, 15 and 16, 2013. The filing fee would be $25. Election on Whether to Choose a Board of } Freeholders to Frame a County Charter; } and to Choose Freeholders to Draft a } Home Rule Charter for Jefferson County } and Prescribing the Procedure for the } Election of such Freeholders } WHEREAS, Article XI, Section 4, of the Washington State Constitution provides that any County may frame a "Home Rule" Charter and may call for an election of freeholders for the purpose of framing a county charter for its own government, subject to the constitution and laws of the state; and WHEREAS, a petition proposing that a board of fifteen (15) freeholders be elected for the purpose of framing a county charter was filed with the County Auditor at least three (3) months before the general election, and the County Auditor has certified that the petition was signed by registered voters equal in number to at least 10% of the voters at the last preceding general election; and WHEREAS, pursuant to Article XI, the County is required to call an election on whether a board of freeholders shall be created for the purpose of framing a county charter, and simultaneously provide an election of said freeholders; and WHEREAS, those citizens elected to serve on the board of freeholders would only serve in that capacity if a majority of the citizens approve the creation of said board of freeholders in a vote to be held simultaneously on November 5, 2013; and WHEREAS, freeholder candidates shall be residents of Jefferson County for a period of at least five (5) years preceding their election and who are themselves qualified electors, whose duty is shall be to convene within thirty (30) days after their election and prepare and propose a charter for Jefferson County; and WHEREAS, Article XI, Section 4, of the Washington State Constitution further provides the Legislative Authority of the county shall prescribe the procedure for the nomination of qualified electors as candidates for such a board of freeholders; and WHEREAS, the County Commissioners have determined that it is in the best interest of the citizens to apportion the election of freeholders by County Commissioner District, electing five (5) freeholders from Commissioner District No. 1, electing five (5) freeholders from Commissioner District No. 2, and electing five (5) freeholders from Commissioner District No. 3; and 1of5 WHEREAS, the position of freeholder will be a nonpartisan position elected by Commissioner District, and a candidate filing fee for each freeholder position is set at $25.00; and WHEREAS, the County Auditor has the authority to set the date for a- special three (3) day filing period for candidate filing; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Pursuant to Article XI, Section 4 of the State Constitution, and upon certification by the Jefferson County Auditor that the number of valid signatures of qualified voters on the petition was at least ten percent (10 %) of the voters in the last preceding general election, a Special Election is called for November 5, 2013, to be held in conjunction with the General Election on such date, to place on the ballot the question of whether a board of freeholders should be elected to prepare a Home Rule Charter, and the election of fifteen (15) freeholders whose duty shall be to frame a Home Rule Charter. Such freeholders will serve only if the first question is approved by a majority of those voting. For the purpose of such election, the following procedures shall apply: 1. The ballot shall list the ballot proposition, and then the freeholder candidates within each respective commissioner district with the instruction to "Vote for Five" below the heading for the Freeholder Commissioner District. The ballot shall appear in, substantially, the following form, with the names of the candidates for freeholder in each commissioner district appearing only on the ballots in that district. A petition to elect freeholders to prepare a Home Rule Charter was submitted to the Jefferson County Auditor pursuant to the State Constitution, and the Auditor has certified that the number of valid signatures on the petition was sufficient to place the proposition on the ballot. The ballot proposition and list of freeholder candidates shall appear on the ballot after the State Measures and before local candidates normally elected in an odd year election. 3. Except only as they may be modified by specific provisions here, the procedures and laws governing the conduct of election to nonpartisan office in Title 29A RC W shall apply to the election of freeholders. 4. Candidates for election as a Freeholder may file with the Jefferson County Auditor between 8:30 a.m. and 4:30 p.m. on August 14, 15 and 16, 2013, and shall declare the district in which they are filing. No candidate may file for more than one position. 5. There shall be a $25.00 filing fee for Freeholder candidates. 6. Candidates for Freeholder shall be qualified electors, be a resident of the Commissioner district from which they are seeking election, and shall have resided within Jefferson County for a continuous period of not less than five years prior to election. All Freeholder candidates must be registered voters of Jefferson County. 7. All fifteen Freeholder positions shall be non - partisan elected positions. 3of5 Freeholder candidate names will appear on the ballot in the order determined by lot, drawing to be held at the close of filing at 4:30 p.m., Friday, August 16, 2013. Candidate filing will be entered in the Washington State Office of the Secretary of State's WEI system, so the candidate guide features shall be available for candidate photos and statements for the general election using the same method prescribed for candidates to other offices in that election. 9. Electors will only be allowed to vote for the Freeholder positions representing the commissioner district within which they reside. 10. Freeholders shall be elected to a term of office commencing the day following the certification of the general election and ending June 30, 2015, or upon submission of a charter to be placed for a public vote, whichever comes first. 11. The candidate receiving the highest number of votes in the election shall serve as interim chair of the Board of Freeholders until such time as the Board of Freeholders shall determine the procedures under which it shall operate. 12. No member of the Board of Freeholders shall receive any compensation for their service as a Freeholder. 13. Within thirty days following the certification of election the Board of Freeholders will schedule and hold a public meeting that has proper public notice. At its initial meeting, the Board of Freeholders shall receive a briefing on their authority, rights, and responsibilities as public officials by the Jefferson County Prosecuting Attorney's Office. This briefing shall include requirements of open meetings laws, the public records act, conflict of interest, and other such matters as the Prosecuting Attorney's Office deems relevant and necessary for the legal performance of their office. 14. At the first meeting, the Board of Freeholders are encouraged to make provisions to accomplish the following things: a. Establish dates, times, and places for regularly scheduled meetings; b. Establish the procedures under which it shall operate; and c. Encourage and allow for public testimony and public inclusion in the Freeholder process. 15. Thenceforth, and for so long as the Board of Freeholders shall meet, it shall ensure that all Board of Freeholder meetings are open to the public and are noticed in accordance with RCW 42.30. 4of5 16. No county employee shall engage in any activity while on public time or at public expense to promote or oppose the adoption of any Home Rule Charter proposal. The Board of Freeholders shall not use any public employees, resources, or facilities to promote the adoption of a Home Rule Charter. However, the County may utilize its resources to provide factual information about the existing or proposed organization of county government, and the Charter procedure.
