HomeMy WebLinkAbout071513_ra04Regular Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of Commissioners FROM: Philip Morley, County Administrator DATE: July 15, 2013 RE: PUBLIC HEARING re: Proposed Formation of Park & Recreation District; Master Planned Resort of Port Ludlow STATEMENT OF ISSUE: A petition has been submitted to establish a Park and Recreation District within the area described as the Master Planned Resort of Port Ludlow. This petition was certified as sufficient by the Jefferson County Auditor's Office. Per RCW 36.69.040 the County Commissioners must hold a public hearing on the petition for the formation of a park and recreation District. ANALYSIS: A hearing notice was published in the Port Townsend & Jefferson County Leader on June 26, July 3, and July 10. Per RCW 36.69.050, after the public hearing, the Board of County Commissioners shall designate a name for the proposed Park and Recreation District, and fix the boundazies of the proposed district. In setting the boundaries, "The boazd of county commissioners shall eliminate from the boundaries of the proposed district land which they find will not be benefited by inclusion therein." The County Commissioners may also add additional land to the district boundaries if the owners of such land consent in writing. The park and recreation district boundary proposed by the petition is the same as the boundary of the Port Ludlow Master Planned Resort. Per RCW 36.69.070, a ballot proposition authorizing formation of the proposed park and. recreation district shall be submitted to the voters of the proposed district at the next general election that is at least 60 days after the county commissioners set the boundazy of the district proposal. RCW 29A.04.330(3) moves the deadline for a county commissioner resolution calling for the general election ballot proposition further forward, to the date of the primazy election, which in 2013 is August 6. A special filing period will be opened by the County Auditor for candidates wishing to be elected to the five-member board of park and recreation commissioners. Candidates must file for a specific seat. The election of the initial set of commissioners will take place at the same time as the ballot proposition to form the district. If the proposition should fail to pass, no commissioners would be seated. If it does pass, the three positions getting the highest votes Regulaz Agenda would serve longer terms, while the other two positions receiving fewer votes would serve short initial terms. This way, commissioners would run on staggered terms. 2 or 3 seats would be up for election every odd year. FISCAL IMPACT: The initial election costs for the ballot proposition and park commission would likely be borne by the County. If the ballot proposition does pass and the district is created, subsequent park commissioner election costs maybe billed to the park and recreation district. No funding source for the park and recreation district's election costs or its operating costs has been proposed for approval of the voters as yet. Hold the public heazing, take verbal and written testimony especially as relates to whether the lands within the boundary of the Port Ludlow Master Planned Resort will or will not be benefited by inclusion in the Park and Recreation District boundary, or whether properties outside the Master Planned Resort wish to be included in the Pazk and Recreation District. Following the hearing, deliberate on whether the Park and Recreation district boundary should be adjusted, and pass a resolution setting the boundaries and the name of the proposed Park and Recreation District, and placing a ballot proposition on the next available general election ballot. And Setting the Boundaries } WHEREAS, on the 6a' day of June, 2013, there was filed with the Auditor of Jefferson County, a petition for the purpose of forming a Park and Recreation District under the provisions of RC W 36.69.010 et seq., accompanied by an obligation signed by two of the petitioners agreeing to pay the cost of publication of the notice provided for in RCW 36.69.040, and said Auditor having found and determined that said petition contains a sufficient number of signatures of qualified persons, and having attached thereto the certificate of sufficiency, and on June 7, 2013, transmitted the same to the Board of County Commissioners, and said Board, by Resolution No. 23-13 entered upon their minutes, fixed Monday, July 15, 2013 at the hour of 11:00 a.m. of said day, at the Commissioners' Chambers, in the Jefferson County Courthouse, Port Townsend, Washington, as the time and place for the hearing of said petition; and, WHEREAS, at said time and place said petition came on for heazing, proof having been made to the satisfaction of this Board that Notice hereof had been given for the time and in the manner provided by law, and no objection having been made or filed, the Board proceeded to hear the petition and upon conclusion made the following findings: I. That the object of the district is to establish and maintain a Park and Recreations District that will be conducive to the public welfare and convenience, and that it will be a benefit to the area therein. IL The name and number of the district shall be Jefferson County Park and Recreation District No. 3, and the boundaries thereof shall be and are determined as the Port Ludlow Master Planned Resort, also described as all of Voter Precincts 500 and 501 and a portion of Voter Precinct 503, is hereby described in Exhibit A (legal description), and Exhibit B (map). III. The proposition for the formation of the proposed park and recreation district shall be submitted to the voters of the said Precinct Nos. 500, 501 and 503 for their approval or rejection at the next general election to be held on Tuesday, November 5, 2013. The election shall be conducted in accordance with the provisions of RCW 29A.04.321 for district elections. Notices of the election for the formation of the park and recreation district shall state generally and briefly the purpose thereof and shall give the boundaries of the proposed district and name the day of the election and the hours during which the polls will be open. IV. The ballot to be submitted to the voters upon which they may indicate yes or no upon the proposition of forming the proposed park and recreation district shall state, and be arranged as described in Exhibit C (ballot language). V. The initial park and recreation commissioners shall be elected at the same election, but this election shall be null and void if the district is not authorized to be formed. No primary shall be held to nominate candidates for the initial commissioner positions. Candidates shall run for specific commission positions. The person Resolution No. Page: 2 who receives the greatest number of votes for each commission position shall be elected to that position. The three persons who are elected receiving the greatest number of votes shall be elected to four-year terms of office if the election is held in anodd-numbered year or three-year terms of office if the election is held in an even-numbered year. The other two persons who are elected shall be elected to two-year terms of office if the election is held in anodd-numbered year or one- year terms of office if the election is held in aneven-numbered year. The inifial commissioners shall take office immediately upon being elected and qualified, but the length of such terms shall be computed from the first day of January in the yeaz following this election. NOW THEREFORE BE IT RESOLVED, that the Board of Jefferson County Commissioners hereby set the name and boundary of Pazk and Recreation District No. 3. Approved this day of July, 2013.
