STATEMENT OF ISSUE: After years of effort by citizens, stakeholders, consultants, County and State staff, and the Board, the updated Shoreline Master Program (SMP) is ready for final adoption. Staff seeks Board approval of the attached Ordinance to adopt the new SMP and the attached Resolution to adopt the technical supplements to the SMP. Upon the Board's direction, staff will submit the new SMP to Ecology for final approval, thereby making the new set of goals, policies, shoreline designations, and regulations effective upon notification from the State. Additional attachments include A draft letter to the Director of Washington Department of Ecology indicating the County's acceptance of changes to the December 2009 Locally Approved SMP, represented in the November 2013 Final Response matrix. This formal submittal to the Director is the final step after receiving informal support & guidance from Ecology staff; As staff prepared the final SMP (including maps and the CAO) additional, non - substantive edits were made Regular Agenda to refine the document, as indicated in a summary document; • The bibliography of scientific and technical information considered during the SMP Update has been updated and now includes nearly 800 citations; • In 1999, the County had begun an SMP update effort with a citizen advisory committee before the State revised the requirements. At the start of this current update process, the consultants evaluated a July 2000 Draft SMP for consistency with the newer 2003 State SMP Guidelines, resulting in a Consistency Report intended to help guide additional update efforts. • The consultants also evaluated other major County plans, programs and regulations to identify how the updated SMP will complement them and avoid overlaps and conflicts. This analysis resulted in the Integration Strategy to help guide the update process. • The State SMP Guidelines (WAC 173 -26) administer the Shoreline Management Act (RCW 90.58) and reference the State's Growth Management Act (GMA; RCW 36.70A) that requires local shoreline goals and policies to be included in the County's Comprehensive Plan. The Comprehensive Plan Addendum reflects the updated goals & policies contained in the final SMP document. • As a complementary action to the adopting ordinance, a resolution is also ready for approval to adopt three technical supporting documents, key to the past preparation and pending implementation of the updated SMP, including an inventory & characterization of shoreline conditions, restoration plan to improve degraded shorelines, and a cumulative impacts analysis of the proposed SMP provisions. ANALYSIS /STRATEGIC GOALS /PROS and CONS: State standards and requirements for local Shoreline Master Programs were updated in 2003 and all jurisdictions in the State were mandated to update their SMPs. Jefferson County began this current update process in 2005 with the receipt of State Department of Ecology grant funds. Department of Community Development (DCD) contracted well - qualified consultants to assist the technical and policy portions of the SMP Update and formed two citizen /stakeholder advisory committees to assist the team of staff and consultants. Public involvement opportunities were provided throughout the SMP Update process, including at the committee, Planning Commission, Board, and State review phases from 2006 - 2013. Final adoption of the updated SMP will put Jefferson County in compliance with the mandates of the Shoreline Management Act (RCW 90.58) and the State's SMP Guidelines (WAC 173 -26) and will provide new, science -based tools to allow appropriate use and development along our local lake, stream, and marine shorelines while protecting and restoring the natural functions and processes that support our rural economy and way of life. FISCAL IMPACT /COST - BENEFIT ANALYSIS: Grant funding for the SMP Update ended in June 2009. Final adoption of the SMP will help alleviate DCD staff work load in the short term (pending any legal appeals) and shift expenditures of the limited General Fund portion of the Department's annual budget to focus on other Long Range Planning tasks. Final adoption will also benefit DCD revenue, including permit fees for review of projects awaiting the new code, and the Enhancing Shoreline Protection — Measuring & Achieving No Net Loss agreement with Clallam County, approximately $270,000 during 2014 that hinges on evaluation of projects permitted under the new SMP. Staff recommends the Board: 1. Approve the Ordinance for final adoption of the updated SMP; 2. Approve the Resolution for adoption of the technical supplements to the SMP; 3.
