Subject: Reject Bids /Re -Bid in lieu of Contract Award
Center Road Overlay Phase 6: MP 4.39 to 6.86

Statement of Issue: Sealed bids were received and opened for the Center Rd.
Overlay Phase 6, at the Jefferson County Board of Commissioners regular meeting on
January 6, 2014 at 10:00 a.m. Two bids were received. It was subsequently
discovered that Public Works had not included the required federal Non - Collusion
Declaration form in all of the bid proposal packets provided to the bidders. As a
result, Public Works has been advised by the funding agency that bids cannot be
awarded to any bidder and the project must be rebid to provide an opportunity to all
potential bidders to provide the required forms.
Analysis /Strategic Goals /Pro's ft Con's: Inclusion of the subject bid certificates is a
federal contracting requirement. Without the bid certificates, the County risks losing
FHWA reimbursement.
Fiscal Impact /Cost Benefit Analysis: The Engineer's Estimate is $752,269.00. This will
be funded at 86.5% by the FHWA. The remaining 13.5% will be funded by the Public
Infrastructure Fund.
Recommendation: Public Works recommends the Board sign the No Contract Award
letter and return to Public Works.

• The Call for Bids was issued by the Board of County Commissioners on December 9, 2013.
• Due notice of the Call for Bids was given as required by law.
• Two sealed bids were received and opened for the Center Road Overlay Phase 6 project, County
Project No. CR1929, Federal Aid Project No. STPR- Q161(009), at the Jefferson County Board of
Commissioners regular meeting on January 6, 2014 at 10:00 a.m.
• It was subsequently discovered that Public Works had not included the required federal Non -
Collusion Declaration form in all of the bid proposal packets provided to the bidders. As a result,
Public Works has been advised by the funding agency that bids cannot be awarded to any bidder and

Public Works recommends that all bids received be rejected and that the project be rebid.
