Dear Mr. Gurnee:
This letter is being written to document the history of the septic case on the above referenced property.A review of our
files shows that a septic permit was approved on 6/29/1987. A partial inspection of the system,the drainfield only,was
completed 5/16/1988 by Steve Rice from Jefferson County Environmental Health. The inspection form indicates that the
septic tank and pump chamber were not installed at the time of inspection. On 7/5/2005 an evaluation of the existing
septic system was completed. The report indicates a well in the vicinity of the sewage effluent transport line. On
7/8/2005 Linda Atkins,Jefferson County Environmental Health, completed a site inspection with Mr.David Gurnee to
check the operation of the pump and observe the drainfield. At the time of the inspection a well was observed near the
transport line. Mr. Gurnee was notified that the effluent transport line must be 50' from a well. Further research indicates
that there are two wells on the site. One drilled in August of 1987 and one drilled in June of 1996.
The case cannot be completed/finaled until the transport line is moved to meet the required 50' setback to the well or other
corrective action is approved by Jefferson County Public Health. A permit is required for any repair or modification of an
onsite sewage system,per Washington Administrative Code 246-272A and Jefferson County Code 8.15. A list of
designers that have submitted work here is enclosed.The code sections referenced are attached for your information.
This letter is intended to serve as formal notice that no further approvals shall be granted until corrections are made and
approved by Jefferson County Public Health staff. Failure to comply may result in a Notice of Non-Compliance being
filed to the property title. Removal of the notice requires correction of the items identified and payment of the fee per the
adopted fee schedule,currently$525.
Please note that pursuant to JC Code 8.15.170 of the above regulations that any person aggrieved by the contents of a
Notice and Order to Correct Violation issued under this regulation,or by any inspection or enforcement action conducted
by Jefferson County Public Health under this regulation may request, in writing,a hearing with the Health Officer or
his/her designee. Such request shall be presented to the Health Officer within 10 business days of the action appealed.
Such a hearing, if requested by you,will be your sole opportunity to present live testimony and witnesses in support of
your position.

JCC 8.15.030 Adoption by Reference
Washington Administrative Code Chapter,246-272A On-site Sewage Systems Rules and Regulations of the State Board of Health,as
now or hereafter amended,is hereby adopted by reference as Rules and Regulations of the Jefferson County Board of Health.
JCC 8.15.080(1) On-site sewage system permit. No person shall install or cause to be installed a new on-site sewage
system nor perform any modification,extension,repair,relocation,or connection to an existing on-site sewage system without a valid
permit issued by the health officer.
JCC 8.15.170(1) Appeal—Hearing. Appeal of Public Health Action—Health Officer Administrative Hearing.Any
person aggrieved by the contents of a notice and order to correct violation issued under this regulation,or by any inspection,permit
issuance or enforcement action conducted by public health under this regulation,may request,in writing,a hearing before the health
officer or his or her designee. The appellant shall submit specific statements in writing of the reason why error is assigned to the
decision of public health. Such request shall be presented to the health officer within 10 business days of the action appealed;except
in the case of a suspension,the request for a hearing must be made within five business days.Upon receipt of such request together
with hearing fees,the health officer shall notify the person of the time,date,and place of such hearing,which shall be set at a mutually
convenient time not less than five business days nor more than 30 business days from the date the request was received.The health
officer will issue a decision upholding or reversing public health's action.The health officer may require additional actions as part of
the decision.
