The proposal site is located on State Route 116, Flagler Road, Nordland, WA 98358, between West Nolton Road on the south and Madrona Road to the north, and along the eastern shoreline of Kilisut Harbor, Marrowstone Island. Requesting final approval and signing by the BoCC per Chapter 18.35 JCC and RCW 58.17.170. The Applicants and Property Owners are Marc Mauney and Lynn Rogerson. ATTACHMENTS: • Written Findings and Conclusions • Type 11 Land Use Approval — MLA 12- 00265. • Final Plat Review Copy • Mylar ready for BoCC signing ANALYSIS: Staff has determined that the application as submitted on December 10, 2012 meets the required criteria of Chapter 18.35.130 as addressed in written Findings and Conclusions and Preliminary Plat Approval MLA12- 00265. Written Findings and Conclusions are required per RCW 58.17.195 which state in part that a county makes a formal written finding of fact that the proposed subdivision or proposed short subdivision is in conformity with applicable zoning ordinance or other land use controls which may exist. ALTERNATIVES: The requested action is mandatory per RCW 58.17.170 and Chapter 18.35 JCC. FISCAL IMPACT /COST BENEFIT ANALYSIS: There is no identifiable fiscal impact related to this request for final plat approval. RECOMMENDATION: Per Jefferson County Ordinance and State Law, DCD requests that the BoCC grant final short plat approval by adopting the written findings and conclusions and sign the final Mylar. The proposal requires a Type 11 Short Plat subdivision pen-nit and is exempt from SEPA under WAC 197-11-800(6)(a), Property Location: The proposal site is located on State Route 116, Flagler Road, Nordland, WA 98358, between West Nolton Road on the south and Madrona Road to the north, and along the eastern shoreline of Kilisut Harbor, Marrowstone Island. Legal Description: Parcel number 953 700 320, Glerman Suburban Acre, Blk 3, Lot 2, Section 20, Township 3011, Range I E, WM, located off Flagler Road, Nordland Property Description: The parcel 953 700 320 is rectangular in shape and 10.04 acres in size and oriented to the west along the shoreline of Kilisut Flarbor. The site is relatively flat with a gentle slope from east to west. The site is completely forested except for a dirt driveway.. The shoreline bluff is between 90 feet in height on the south side of the property, to 65 feet on the north. community Plan: The Jefferson County Comprehensive Plan Land Use Map designates the site as Rural Residential 1:5. Surrounding Area: The surrounding parcels range in size from approximately 0.5 to 23 acres in size. Average parcel size is approximately 5 acres. Parcels to the east of the subject parcels are zoned Rural Residential 1:10, to the north and south are Rural Residential 1:5. Access to surrounding parcels is via State Route 116, Flagler Road, Parcels to the east and south have existing houses while parcels to the north remain undeveloped. (WAC 197 - 11- 800(6)(a). Notice Information: Notice of Application was mailed to agencies and adjacent property owners January 9, 2013, Notice was published in the January 16, 2013 edition of the Port Townsend and Jefferson County Leader, Applicant posted the notice on-site on January 16, 2013 per the Affidavit of Posting Notice. Testimony: No written testimony were received from the adjacent properties and/or interested parties. Staff Findings and Conclusions: I The proposal is to subdivide one (1) parcel of 10.04 acres into two (2) 5.02 acre parcels for residential use. 2. I'he proposed short subdivision is subject to the policies of the Jefferson County Comprehensive Plan. The applicable policies are discussed below. 3. The proposed short subdivision is subject to the requirements of Sections 18,30 & 1835 of the Jefferson County Code (JCC). There are several ordinance requirements that apply to the proposed subdivision: JCC 18.30,030, Water Supplies; JCC 18.30.040, Sewage Disposal; JCC 18,30,080, Mauney Short Plat SUB 12- 0002,3 121412013 - 2 - Roads; JCC 18.35.090 Article 111, Short Subdivisions. The applicable criteria and requirements are discussed below. The Jefferson County Comprehensive Plan Rural Residential Land Use Policy LNP 3.3 states: "Rural residential densities shown on the Land Use Map shall be designated by three (3) residential land use densities: one dwelling unit per five (5) acres, one dwelling unit permit ten (10) acres, and one dwelling unit per twenty (20) acres in size and subject to the following criteria: LNP 3.3,1 A residential land use designation of one dwelling unit per 5 acres (RR 1:5) shall be assigned to those areas throughout the County with: a. an established pattern of the same or similar sized parcels (i.e., 5 acres) or smaller size exiting lots of record; b. parcels of similar size (i.e., 5 acres) or pre-existing smaller parcels along the coastal areas; C. parcels immediately adjacent to the boundaries of Rural Village Centers; and d. as an overlay to pre-existing developed "suburban" platted subdivisions. e. Parcels designated as Forest Transition Overlay. The parcel is a legal conforming lot consisting of at least 10.04 acres. The average size of the surrounding parcels is approximately 5 acres. These parcels have been designated as Rural Residential 1:5 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. The site is currently undeveloped with the exception of a dirt driveway. This is a legal use of the property. This subdivision shall not serve as rationale for a future re-zone application. The Jefferson County Comprehensive Plan Rural Residential Land Use Policy LNP 14.1 states: "Ensure that land use decisions are based on land use ordinances which are in compliance with the Critical Areas Ordinance and all applicable state and federal environmental laws." The proposal was subject to an environmentally sensitive area (ESA) review and found that the parcel has the following ESA's identified on it: Susceptible Aquifer Recharge & Special Aquifer Recharge Protection Areas; High Landslide Hazard Area (Shoreline Bluff); Conservancy Shoreline Designation; Fish & Wildlife Habitat Conservation Area, A Geotechnical Report was prepared by Stratum Group dated September 13, 2012 and submitted with the application. The report concludes that residential structures may be located on site such that erosion or land-sliding would not threaten the structures with the lifetime of those structures (100 years) as long as the recommendations of the report are followed (80 foot building setback from top of bluff). The Jefferson County Comprehensive Plan Transportation Policy LNP 173 states: "Encourage development and land use proposals that utilize existing transportation systems and provide non-motorized transportation opportunities." Mauney Short Plat SUB 12- 0002.3 1214/2013 - 3 - JCC _.18.30.Q80 Roads: The access from State Route: (SR) 1] 6, Flagler Road is under the jurisdiction of the State Department of Transportation (WSDO'T), A right-of-way encompassing that portion of the property that is within 30 feet of the centerline of SR 116 shall be conveyed to the public for roadway purposes by a dedication on the final plat, 'The proposal is for two separate access points, one for each lot with the required 20 foot wide road approach. The Jefferson County Public Works Department will defer to WSDOT on approval of two separate access points with proof prior to final of WSDOT access permits, A road maintenance agreement shall also be required prior to final plat. 'The Department of Public Works has reviewed the proposal and made recommendations, As conditioned, the proposal meets the development standards under JCC 18.30MO. &c 8.30,Q30 Water Supplies: "When the development or redevelopment of land requires the availability of a supply of potable water as determined by the Administrator, potable water shall be delivered by a means approved by the Washington Department of Flealth and/or Jefferson County Health and Human Services." 'The parcel is within the current water system service area of the Quimper Water System. A certificate of water supply utility service review has been completed and approved by the Jefferson County PUD fl. As conditioned, the proposal meets the development standards under JCC I8.31 O30, jCC 18 .040.5SKa ge "All development shall be provided with an individual, on-site septic system and drainfield approved by the Jefferson County Health Department in compliance with Chapter 8.15 JCC, unless the Jefferson County Health Department determines that public sewer is available which would then require connection to the approved public sewer." Jefferson County Environmental Health Department has stated that lot sizes meet minimum land area requirements per WAC 246-272A-0320 for use of onsite sewage system. Review of the soils report and site inspection by Environmental Health Department indicates that there is sufficient area within each lot with soil suitable for the use of onsite sewage systems. LQC Iwa35.13�QUI : "Short subdivisions shall be given preliminary approval, including preliminary approval subject to conditions, upon finding by the administrator that all of the following have been satisfied., a) The proposed subdivision conforms to all applicable county, state and federal zoning, land use, environmental and health regulations and plans, including, but not limited to the following: i. The Jefferson County Comprehensive Plan: and ii, 'The provisions of this Code, including any incorporated standards; b) Utilities and other public services necessary to serve the needs of the proposed subdivision shall be made available, including open spaces, drainage ways, roads, streets and other public ways, potable water, transit facilities, sewage disposal, parks, playgrounds, schools, sidewalks, and other improvements to assure safe walking conditions for students who walk to and from school. Mauney Short Plat StJB]2-00023 1214/2013 - 4 - c) Approving the proposed short subdivision will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Based on the previous findings, the proposal is found to be consistent with the Comprehensive Plan and JCC Title 18. Water is provided through an approved water system. Proposed lots have verified soils on site for sewage disposal systems and designated reserve drainfield areas identified. The proposal does not require sidewalks to be installed. The proposed lots consist of 5,02 (Lot 1) and 5,02 (Lot 2) acres. Provisions for open spaces, drainage ways, streets/roads, alleys/other public ways, potable water supplies, sanitary wastes, and parks and recreation have been addressed. The site is outside of the service area of the local transit provider and consequently unavailable at this time. The site is within the Chimacum School District, Based on current policy of the school district, students living within the site boundaries would not be required to walk to school. Bus service would be provided under the current policy of the district. There is no probable significant adverse environmental impact as the existing residence, utilities, and septics all exist. The public interest would be served by the division of parcel 953 700 320 into two (2) lots intended for residential use. STAFF RECOMMENDATION: Based on the preceding findings and conclusions, staff recommends finding that the proposal is consistent with the applicable plans and ordinances and that it meets the Short Subdivision review criteria. Approval of the Preliminary Short Plat should be granted subject to the following conditions. C.ONDITIONS: 1, Prior to final plat approval, water meters and water lines to serve each parcel must be installed to meet requirements pre JCC 18,35,130(1)(b). Show meter and/or water line location as installed on the face of the plat. 2. Prior to final plat approval, the applicant shall provide Washington State Department of Transportation Access Permit to each lot, whether a single shared access or two separate access points and as depicted on the face of the plat. If a shared access is being utilized, then a Road Maintenance Agreement shall be submitted and approved by the Public Works Department. 3, Prior to final plat approval, the plat shall dedicate a 30 foot in width casement from the existing center line for SR 116, Flagler Road. 4, All easements of record shall be shown on the final plat with the Auditor's File Number (AFN) of the easement(s) also referenced on the final plat. 5. Correct the distances along the north property line from 1253.50 feet to 1252.91 feet. Depict and label the required 80 foot building setback line per the Geotechnical Report on the face of the plat. 8. Delete the Owner Names from the adjacent parcels. 9. Depict and label the 150 foot Fish & Wildlife Habitat Conservation Area buffer from the OH►M on the face of the plat. 10, Label the shoreline bank height per the Geotechnical Report (90 feet on south bank to 65 feet on north bank). 11, Re-label Lot A to Lot I and Lot B to Lot 2. 12. In accordance with Chapter 486, Washington Laws of 1993 [amending RCW 58.17.280], addresses shall be assigned to all lots. Addresses may be shown on the final plat or may be applied for at the time of building permit application. 13. Address plates for the lots shall be located in accordance with the provisions of the Jefferson County 911 Locator System Ordinance. 14. In accordance with the Jefferson County Fee Schedule Ordinance, the Public Works Department charges an hourly fee for subdivision application and plan reviews, project inspections, meetings, hearings, and final review. The applicant shall pay all fees incidental to the subdivision prior to final plat approval. In the event that approval is denied Jefferson County or the applicant does not complete the proposal, the applicant shall still be responsible for paying the Department's fees. The Department's fee is currently $81 per hour. 15. The applicant shall submit a blue line copy of the site plan and lot closure information prepared by a licensed surveyor to DCD for review. The applicant shall make any corrections or additions prior to final approval, 16. After all preliminary plat conditions are met, the applicant shall submit a final mylar of the plat to Department of Community Development for approval by the Public Works Director, Assessor, Treasurer, and Director of Community Development. 17, 'The following notice shall be placed on the final plat under N " otice to Potential Purchasers: "The lots, parcels or tracts contained within this subdivision were approved based on design standards and regulatory requirements in effect at the time of final approval. Sewage disposal systems have not been approved for lots I & 2, within the subdivision. Onsite sewage disposal systerns shall meet design standards and regulatory requirements in effect at the time of application for a sewage disposal permit. Purchaser should contact the Jefferson County Environmental Health Department for procedures concerning permit applications. Any removal of or major disturbances of soil within the proposed drainfield areas may create site conditions that are unacceptable for the installation of sewage disposal systems." The final plat shall be prepared in accordance with the final short plat checklist. A copy is attached. 20, An accurate vicinity map shall be graphically portrayed on the face of the plat, 21. All existing structures (residences, garages, driveways, septic and components, etc) shall be accurately and graphically portrayed on the face of the final Mylar. No proposed structures shall be portrayed on the face of the final Mylar. 22. The final blue line shall be accompanied by a current (within 30 days) title report and/or supplemental sheet. 23. The following notice shall be placed on the final short plat under Notice to Potential Purchasers: "Any further subdivision of the lots within this plat will be subject to the densities permitted in the Jefferson County Ordinances and Codes in effect at time of such application. These lots may or may not be further subdivided in the future," 24, The following notice shall be placed on the final short plat under Notice to Potential RtrrgjhAsM: "Any future development will require review and compliance with Jefferson County Code." 25, The following notice shall be placed on the final plat under No - tice to Potential Purchasers: "Lots created herein shall not be further divided in any manner within a period of five (5) years without filing of a final long plat." 26. The following notice shall be placed on the final plat tinder Notice to Potential Purchasers: "Approval of this subdivision does not constitute approval of building permits on each lot. Permit approvals will be subject to building lots, plans, type of use, contours, and soils on individual lots. Permits will be reviewed in accordance with the conditions and regulations existing on the date the permit is applied for." 27. Consistent with JCC 18.40.360(2)(b), any appeal of this decision must be in writing within fourteen days of said decision. 28. Consistent with JCC 18,40.360(5) the appeal must comply with the following procedures: a) A notice of appeal shall be delivered to the Administrator by mail or personal delivery, and must be received by 4:00 p.m. on the last business day of the appeal period, with the required appeal fee pursuant to the Jefferson County Fee Ordinance; b) The decision being appealed and the identification of the application which is the subject of the appeal. 0 The name, address, and phone number of the appellant and his/her interest in the matter; d) Appellant's statement describing standing to appeal i.e., how he or she is affected by or interested in the decision); Mauney Short Plat SUB 12-00023 1214/2013 -7- e) The specific reason why the appellant believes the decision to be wrong. "File appellant shall bear the burden of proving the decision was wrong; f) The desired outcome or changes to the decision; and g) A statement that the appellant has read the appeal and believes the contents to be true, signed by the appellant. 29. Any notice of appeal not in full compliance with the above procedures shall not be considered. 30, The current year and all delinquent taxes must be paid prior to the recording of the final Mylar. The applicant must submit a reproducible copy, plus five paper copies of the proposed final short plat to the administrator. The reproducible copy of the approved final short plat will contain the elements as described in JCC L&a5.12Q and shall include certifications and other requirements as provided in JCC 18,35.370 for long plats, [Ord. 8-06 § 11 18.35.190 Accompanying documents — Final short plat. (1) In cases where any restrictive deed covenants or CC&Rs will apply to lots or parcels within a subdivision, a type written copy of such covenants, bearing all necessary signatures, shall be submitted along with the final plat. Where the recordation of specific deed restrictions or CC&R provisions have been required as a condition of preliminary plat approval, the administrator shall approve and sign the deed restriction or CC&Rs prior to final plat approval. (2) The final plat shall be accompanied by a current (i.e., within 30 days) title company certification of the following: (a) The legal description of the total parcel sought to be subdivided; (b) Those individuals or corporations holding an ownership interest and any security interest (such as deeds or trust or mortgages) or any other encumbrances affecting the title of said parcel. Such individuals or corporations shall sign and approve the final plat prior to final approval; (c) Any lands to be dedicated shall be confirmed as being owned in fee title by the owner(s) signing the dedication certificate; (d) Any easements or restrictions affecting, the property to be subdivided with a description of purpose and referenced by the auditor's file number and/or recording number; and (e) If lands are to be dedicated or conveyed to the county as part of the subdivision, an American Land Title Association (A.L.T.A.) policy may be required by the director of the department of public works. (3) All maintenance, performance and guarantee bonds or other guarantees as may be required by the director of the department of public works and the approved improvement method report to guarantee the acceptability and/or performance of all required improvements. The final short plat shall be approved by the administrator upon satisfaction of all conditions of approval and all requirements as provided in this article and Article VI of this chapter. Final approval of short plats by the Jefferson County board of county commissioners shall be required. All final short plats shall be approved, disapproved or returned to the applicant within 30 days of their filing, unless the applicant consents to an extension of time in writing. [Ord, 8-06 § 1] 18.35.210 Time limitation on final short plat submittal. Approval of a preliminary short plat shall expire unless the applicant submits a proposed final plat in proper form for final approval within three years after preliminary approval. The department of community development shall not be responsible for notifying the applicant of an impending expiration. [Ord. 8-06 § 1] 18.35.220 Effect of an approved final short plat — Valid land use. Any lots, tracts or parcels in a final short plat filed for record shall be a valid land use notwithstanding any change in zoning for a period of five years from the date of filing. A short subdivision shall be governed by the terms of approval of the final short plat, and the statutes, ordinances and regulations in effect on the date of preliminary plat approval for a period of five years after final short plat approval unless the Jefferson County board of commissioners finds that a change in conditions creates a serious threat to the public health or safety of residents within or outside the short subdivision. The administrator shall distribute the original and copies of the approved final short plat as follows: (1) The original shall be returned to the applicant after it has been forwarded to the county auditor for recording; and (2) One recorded paper copy shall be retained in the files of the department of community development.
