This service does not include extensive field inspection or correspondence. Pre-application consultation does not limit subsequent administrative review. At the conference, Department of Community Development personnel shall provide the applicant with: (1) A list of the requirements for a completed application; (2) A general summary of the procedures to be used to process the application; (3) The references to relevant code provisions or development standards that may apply to the approval of the application;and (4) A list of any applicable hourly review fees that may be charged by one or more County agencies upon the filing of a project permit application with the County. FR: Thomas Aumock,Consulting Fire Code Inspector to Jefferson Co - DT: 18 May 2014 RE: PRE14-07,Powers Pre-Application: Cottage Industry,Marijuana Commercial Kitchen CC: None This plans examiner is in receipt of the pre-application for the above-referenced proposal from your office,and have reviewed the proposal with the International Fire Code [I.F.C.],2012 Edition,established law for marijuana production and processing, and relevant N.F.P.A. editions. The following constitutes this consulting Fire Code Inspector findings and recommendations for this pre-application. Findings&Determinations: 1. The proposal was reviewed as a cottage industry marijuana production and processing proposal that includes use of a 2,400 square foot 3-story "pole barn', with indoor grow and processing, at a rural location. 2. The pre-application does not indicate whether there is use of indoor high-intensity lamps, air conditioning, de-humidifiers, fans, etc, which are generally consistent with existing growing and processing operations of this type. The process does indicate use of a closed system carbon dioxide generation process. Issues Identification For Future Permit Application: 1. Industry issues about electrical overloads due to levels of lighting, and fans, will require formal electrical design and permits from the Washington State Dept. of Labor & Industries, including formal inspection[s]. 2. The applicant will be required to indicate all proposed or future air ducting, wiring, electrical chords, rope or twine use,which are contributors to entanglement for emergency responders. 3. The applicant shall indicate the amounts and methodology of the use of carbon dioxide generation [accelerant for plant growth]. This is due to equipment use and explosion hazards identification from International Fire Code [I.F.C.]jurisdiction. 4. Besides a normal Building Inspection prior to certificate of occupancy, a formal Fire Code inspection is required, including the commercial kitchen International Fire Code Applications: 1. Road access needs be reviewed for this proposal, and should be consistent with Jefferson County adopted private fire apparatus access road design recommendations, to insure efficient emergency services delivery to this remote site. 2. The proposal will be reviewed under basic fire flow requirements as established under the Jefferson County Water System Coordination Plan. Rural areas received liberal reduction thereof. 3. Any automatic fire sprinkler system proposal will require a deferred permit submittal to Jefferson County. 4. All electrical systems shall be designed and installed to N.F.P.A. 70, et al, and Washington State Dept.of Labor&Industries standards and permit requirements. 5. The use of compressed gase[s] is subject to I.F.C. Section 5301. Information can be obtained about these requirements from the Jefferson County D.G.D. 6. The proposal contains a "commercial kitchen". Commercial kitchens are subject to specific I.F.C., International Mechanical Code, and N.F.P.A. requirements based upon whether there is a "Type 1" [grease laden vapor production] or "Type 2" [water vapor production] kitchen system. Further, exhaust ducts, structural protection,and possible automatic fire sprinkler system installation,will apply. Any other applicable or relevant sections of said Code, and national standards, not covered herein shall apply to this proposal. This will be relevant when formal permit application is made, with disclosure of the physical elements of the proposal is made. It is my recommendation that the aforesaid be approved for submittal to the pre-application meeting. This plans examiner does not need to be present at this time. 1.0 hours time was logged in the review,documentation,and report for this proposal. Agricultural Buildings There has been confusion around what constitutes an exemption from the International Building Code for the construction of an agricultural building. An agricultural exemption is not authorized under the IBC nor the State Building Code Act, RCW 19.27 Structures.According to JCC 15.05.040(1),certain types of agricultural structures do not require a building permit from the Department of Community Development. (A) No county building permit is required for buildings or structures erected exclusively for the storage of livestock, feed,and/or farm implements, provided said structures are:freestanding, located at least 10 feet from the nearest structure and not attached to any structure, unless attached to another agricultural building;do not contain plumbing,except as necessary to maintain farm animals; do not contain a heat source,such as a wood stove or electric heat, unless specifically permitted. (B)Agricultural buildings that contain plumbing other than that as authorized above must obtain a plumbing installation permit and health department approval. (C)Agricultural buildings that contain a heat source for an agricultural purpose must obtain a wood stove permit or an electrical permit as appropriate. (D)Agricultural buildings used for the storage of private automobiles,trucks, etc.,which are not licensed as farm equipment,are considered garages or carports and must obtain a building permit. (E)Agricultural buildings used for the purpose of hosting members of the public for the purpose of retail sales of agricultural products or machinery constructed on-site shall require a building permit to ensure life safety and structural integrity. If an older agricultural building constructed under the building permit exemption for agricultural buildings is proposed for hosting members of the public,the building shall be brought into compliance with the building code,as determined by the building official. The change of use will also require planning review by the Development Review Division. (F)The building official shall judge whether a proposed structure,a structure under construction,or a completed structure violates this building permit exemption.A structure determined to be in violation will be considered a structure subject to the building code. (G)Temporary growing structures used solely for the commercial production of horticultural plants including ornamental plants,flowers,vegetables,and fruits are not considered structures subject to the State Building Code,Chapter 19.27 RCW, pursuant to RCW 19.27.065. I've also included an information sheet describing the exemption for Agricultural Buildings from building permits and the limits of the exemption. In response to your question whether a Cottage Industry/Conditional Use Permit would be required if only a growing operation was being considered—Agriculture, as an activity, is an allowed use in all zoning districts as a matter of right, but a structure that is developed to the level of heating/lighting/HVAC/plumbing may require a building permit if developed beyond the level described in the information sheet. This would be determined by the Building Official. Agriculture-only (no processing) would lower the building standards the structure would be required to meet from what is be required for the commercial kitchen. I have expended the paid time within the pre-application base rate. You can continue by paying the hourly rate of$76.00 for any additional work you require. The applicant shall indicate the amounts and methodology of the use of carbon dioxide generation [accelerant for plant growth]. Scope The scope of this policy is for emergency services access provision on private properties and privately constructed and maintained roadways in public rights of way to at least 150 feet of a significant structure as measured from the rear of that structure. Standards • A travel surface should be constructed and maintained according to these standards: • All materials should meet WSDOT standard specifications for road construction • Twenty[20] foot minimum unobstructed width[see finished surface standard below] • Minimum 6-inch ballast or gravel base, which may need to be increased depending upon the suitability of native material,with 2-inch minimum depth of compacted crushed surfacing top course, and; • 2 percent crown slope at the centerline,and; • Compaction of the material to a load capacity of 75,000 pounds • Minimum finished driving surface width of twelve[12] feet should be provided,and maintained. • Four [4] foot shoulder—each side—is recommended in sloped landscapes, as shoulders provide lateral support of elevated roadway surfaces and provide an "operations zone" around parked emergency services vehicles on the roadway. Hoods are required by Codes& Standards to be installed at or above all commercial-type deep fat fryers, broilers,fry grills,steam jacketed kettles,hot top ranges,ovens,barbecues,rotisseries,dishwashing machines and similar equipment which produce comparable amounts of steam,smoke,grease,or heat in a food-processing establishment.Non-commercial-type appliances require a ducted exhaust fan rated at 100 CFM or a continuously operating exhaust fan rated at 25 CFM. [Wa. St.Indoor Air Quality Code] Where should exhaust outlets go? The exhaust outlet for grease ducts must extend through the roof unless otherwise approved by the Building Official for any side wall termination,or when a special air-recovery system is used in conjunction with the hood system. Construction of these systems is strictly regulated by the Building Code and NFPA 96. Normally,exhaust outlet terminations must be ten-feet from wall or roof openings,and ten feet from adjacent buildings and property lines or other air intake openings,two feet higher than the roof surface, and ten feet above the adjoining grade level. When does one need Fire Sprinklers? The International Fire Code requires that an approved fire suppression system(i.e.sprinklers)be provided for the protection of commercial-type food heat-processing equipment that produce grease laden vapors, i.e. cooking surfaces,flyers,griddles,upright broilers,char-broilers,range tops and grills . Sauteed foods are considered by the City to be subject to the Type I hood fire protection requirements. What if there is an existing fire sprinkler system that is a dry-chemical type? Over the years,the use of animal fats for frying foods has given way to the use of vegetable oils. Vegetable oils burn at a higher temperature than animal fats and create fires that are more difficult to extinguish. Energy efficient cooking appliances are now used,which highly insulate appliances to reduce fuel consumption and improve cooking times. This keeps the cooking oils and appliances hotter longer which also makes fire extinguishments more difficult. Thus,the dry-chemical and water-spray fire extinguishing systems can only provide life-safety protection in the kitchen,and not guarantee extinguishments of a fire. Therefore,national Codes and Standards,and the City,requires the addition of a K-Class [wet chemical] fire extinguisher at a minimum,and requires a conversion of the fire extinguishing agent to one that meets the new UL 300 standard. A standard dry- chemical fire extinguisher is required as a standby for electrical based fires Does one need automatic power, fuel, and ventilation shutoffs? Yes, the code requires that automatic fire extinguishing systems shall be interconnected to the fuel(i.e., LPG)or power supply for the cooking equipment and arranged to automatically shut off all equipment under the hood when the system is actuated.The City of Port Townsend requires that the hood exhaust fan continue to exhaust air under these circumstances.Accessory exhaust fans will also be affected. How does one maintain Hood and Duct Fire Systems? The International Fire Code requires that all extinguishing systems serving commercial grease hoods and ducts shall be serviced at least every six(6)months,or after any activation of the sprinkler system. Inspection shall be by qualified individuals,and a"certificate of service"should be immediately forwarded to the fire code official for recordation.The fire sprinkler system has"fusible links"and "automatic sprinkler heads"that shall be replaced at least annually,and other protection devices shall be serviced or replaced in accordance with the manufacturer's instructions. All Type I hoods shall have a grease or baffle-type filter(s)that need to be cleaned when necessary. In Type II hoods, such filters are an optional accessory. The orientation of the filters is important,and must be done according to the manufacturer's specifications. Hoods,grease removal devices,fans,ducts and other appurtenances shall be cleaned at frequent intervals and as necessary and must meet stringent Health Department standards of cleanliness. What do employees need to know? Instructions for manually engaging the fire extinguishing system should be posted at a conspicuous location within the kitchen. Codes require that all employees be trained as to the purpose,function,and manual operation of said system,and what to do in an emergency. An auxiliary 40-B:C rated fire extinguisher,with a maximum distance between each extinguisher of thirty(30)feet is required for electrical based fires. Extinguishers must be serviced annually,and after each use. OTHER AGENCIES The Washington State Surveying&Rating Bureau You have a choice when installing a Type I kitchen,to comply with either the Washington State Mechanical Code,or the National Fire Code standards administered by the Washington State Survey& Rating Bureau. The Washington State Survey&Rating Bureau reviews commercial kitchen projects for the insurance industry(when you apply for business insurance)to establish the insurance rates for your business. They use the National Fire Protection Association and Underwriter's Lab standards for installation to review your plans. The exception to this requirement is steam kettles, steamers,pasta cookers,and dishwashing machines which require a"Type Il"hood alone. • In the I.M.C.Application and Interpretation Manual,the code does not require Type I hoods over domestic cooking equipment or above commercial food heat-processing equipment which produce only steam,heat,vapors,or odors. The latter category of equipment requires a Type II hood. [I.M.C. Application and Interpretation Manual,p. 60]. Churches are allowed an exception to the type I hood requirements as they are not"commercial"and are intermittent in use. [Provided such facilities are not leased out] • I.C.B.O.has noted that commercial food heat-processing equipment,with certain exceptions such as coffee urns,pizza ovens and dishwashers,require installation of a Type I hood;the excepted items require a Type II hood. • Convection ovens are not a device that is directly noted in the Codes. Procedure • Review the"sample menu"of any proposed commercial kitchen and the occupancy classification to which the operation relates. • Inspection of the subject site and appliances,vent connection,termination,etc. Findings • "Sauté":The definition of"sauté"is to"fry something lightly",consequently,menu items including meats,bacon-drippings,and onions,and the like as determined by the Code Official to produce grease-laden vapors and or smoke,thus,a Type I hood protection is required for sauté. • "Re-heating":A proposed menu with range or oven use to re-heat pre-cooked soups and sauces,or fillings,baking,and the like as determined by the Code Official,is subject to the Code requirements of a Type II exhaust hood,duct,and termination. • Convection ovens are found not to require a Type II exhaust hood,primarily since such devices are required by the manufacturer to have,at least,a ducted exhaust to outside air. Determinations&Recommendations • When it is the administrative determination by the Code Official that the proposed menu constitutes the production of grease-laden vapors,it thus requires a Type I hood with an automatic fire extinguishing system. • Any proposed new Type II hood shall meet the requirements of the International Mechanical Code. • When the subject facility is proposed for Type II hood use,and has an existing type II exhaust hood assembly,the proponent is required to provide the authority with jurisdiction with the following information from a reputable metal fabricator prior to approval : I. Assurance that the existing exhaust duct is constructed of rigid metallic materials as set forth in Section 507 of the International Mechanical Code, and, braced and supported as required therein, and; 2. Assurance that the joints and seams of the duct shall be made substantially airtight by using approved tapes,gasket material, or other means consistent with Sections 504 and 601.5,and; 3. Assurance that the hood is constructed of material consistent with Section 508.2,which requires that Type II hoods be constructed o not less than 0.024-inch[No 24 gage]steel,and, 4. Assurance that the capacity of the exhaust fan meets the requirements of code using the low- temperature formula shown in Section 507 for hood capacity • It is the administrative determination that convection ovens are not subject to the Type I and II hood requirements provided that equipment exhaust method[s]meet manufacturer's listing. May 2014 I x. 18.20.170 Cottage industry. (1)Purpose.To provide for small-scale economic development activities on residential parcels, subordinate to the primary residential use, if the administrator finds that such activities can be conducted without substantial adverse impact on the residential environment and rural character in the vicinity.The scale and intensity of cottage industries are typically greater than could be accommodated as a home business, but less than would require a land use district designation of commercial or industrial. (2)The following list of uses allowable as cottage industries include, but are not necessarily limited to: (a)Sales of antiques and collectibles; (b)Art or photography studios; (c)Computer software development; (d)Handicrafts; (e) Ironworking or blacksmith shop; (f)Construction office; (g) Furniture repair or refinishing; (h)Pottery shop; (i)Real estate sales office; (j)Small equipment repair; (k)Woodworking shop; (I) Excavating contractors; (m)Small engine and boat repair; and (n)Auto and truck repair and service(excludes auto and truck sales,fuel stations and heavy equipment repair). (3)The following occupations are prohibited as cottage industries, except in the West End Planning Area —Remote Rural(WEPA RR)overlay district(Article VI-L of Chapter 18.15 JCC)and when located on parcels with direct access to a principal arterial (i.e., Highway 101)in the Brinnon Planning Area— Remote Rural(BRPA RR)overlay district: (a)Heavy equipment repair shop; , (b)Autobody work or paint shop;and (c)Large-scale furniture stripping. (4)All cottage industries shall be subject to the following standards, except as provided for in the West End Planning Area and Brinnon Planning Area—Remote Rural overlay districts as specified in Article VI- L of Chapter 18.15 JCC, Remote Rural Overlay Districts for the West End Planning Area and the Brinnon Planning Area. (a)The cottage industry shall be operated by at least one full-time, bona fide resident in a single- family residence of the parcel on which the proposed use is being requested. (b)The cottage industry may not employ more than four employees on the site who reside off the subject property.Auto and truck repair shall only employ two persons on the site who reside off the subject property. (c)Only those buildings or areas as specifically approved by the county may be utilized in the conduct of business. (d)Any business requiring customers to visit the site shall provide adequate on-site parking spaces, in addition to one for each full-time equivalent employee who resides off the subject property, and two for the owners of the property.All parking spaces shall meet the standards of JCC 18.30.100. (e)All structures and outside activities shall be so located or screened from adjacent properties to avoid disturbances through glare, noise,dirt or other nuisances or hazards. (f)All activity related to the conduct of the business or industry, except for activities related to the growing and storing of plants, shall be conducted within an enclosed structure or be sufficiently screened from view of adjacent residences. . (g)All cottage industry activities shall be sufficiently screened from view of adjacent residences, using site location,topography, landscaping,fencing, the retention of native vegetation, or a combination thereof necessary to meet the Type A screening requirements of JCC 18.30.130. (h)Traffic generated by the cottage industry shall not exceed the level of service adopted for the public roadway which accesses the use, nor generate significant traffic in excess of that normally generated by typical uses found within the particular district. (i)No business may provide drive-through service. (j)Cottage industries shall be limited in their hours of operation. No business on-site customer service shall be conducted before 8:00 a.m. or after 8:00 p.m., Monday through Friday, and before 9:00 a.m. or after 6:00 p.m., Saturday and Sunday. 4 (k)The administrator may attach additional conditions or requirements, or may make modifications to the site plan where necessary to protect the health, safety and welfare of the public. (I)The granting of the proposed cottage industry use shall not constitute a rezone. No expansions of approved cottage industries are permitted,except as specified in Article VI-L of Chapter 18.15 JCC, Remote Rural Overlay Districts for the West End Planning Area and the Brinnon Planning Area, concerning the rural remote overlay districts. (m)No exterior display of goods for sale shall be allowed. (n)The cottage enterprise is an accessory use to the residential use of a dwelling unit, and the residential function of the buildings and property shall be maintained. (o)Any new structure constructed to accommodate the cottage industry shall be limited in scale so that it is in character with neighboring properties. In no case shall more than 5,000 square feet of total building area on the property be devoted to the cottage industry. (p)No more than one sign is allowed, consistent with the sign standards in JCC 18.30.150. (q)No on-site direct retail sales of products not produced on-site are allowed, except for items collected, traded and occasionally sold by hobbyists, such as coins, stamps and antiques, and their accessories. (r)Minimum parcel size shall be one acre gross site area. (s) No use shall be made of equipment or material which produces unreasonable vibration, noise, dust, smoke, odor, or electrical interference to the detriment of the quiet use and enjoyment of adjoining and surrounding property.Any after-hours business activities shall not have noise impacts discernible beyond the property boundaries. (t)Not more than one cottage industry shall be allowed in or on the same premises. (u)The proposed cottage industry shall comply with the standards and requirements of the Jefferson County environmental health department. (5)Auto repair and service proposals are subject to the following additional requirements: (a)The proposal shall submit a detailed operating plan in compliance with the latest addition of the Washington State Department of Ecology's Guide for Automotive Repair Shops identified as Publication No.92-BR-16. (b)The proposal shall include an operating plan which complies with the Department of Ecology's SMM. The submittal shall include a stormwater management plan in compliance with Chapter 18.30 JCC and include supplemental information which addresses and complies with Volume IV-2.1 and 2.2 of the SMM. (c)The operation shall be limited to two stalls or bays for repair and servicing. (d)The cottage industry shall not store more than three vehicles at any one time awaiting or departing for or from servicing or repair.This excludes the vehicles being actively serviced in the facility. (e)A 50-foot buffer shall be maintained from the structure housing the auto repair and service to all adjacent property lines. [Ord.8-06§ 1] • 18.30.130 Landscaping/screening. (1)Application. Landscaping or screening shall be provided for all multifamily residential, commercial and industrial land uses, small-scale recreational and tourist uses, and as required in other sections of this code, except that landscaping will not be required of industrial uses within the resource-based industrial district when the development is sufficiently screened from public view. (2)General Provisions. (a)Existing trees,vegetative plantings, undisturbed open space,and/or topographic or natural features which meet or exceed these standards shall be considered to fulfill the landscaping or screening requirements of this section and any other applicable reference to these screening requirements in other sections of this code. (b)The administrator may authorize variations to the landscaping/screening requirements of this section to: (i)Provide consideration of topography, natural features, existing native vegetation and soils on the site and site location in relation to adjacent and surrounding uses; (ii)Allow alternative plant mixes or berming that accomplish the purposes of the type of landscape screening required; (iii)Conserve water through the concept of xeriscaping; (iv)Provide flexibility in the size of initial plantings;and (v) Ensure that any nonresidential use, structure or activity when proposed in a rural residential(RR)district shall be compatible with that of existing and anticipated future uses in the district. (3)Landscape Screening.The three types of landscaping screens are described and applied as follows. (a)"Screen-A" landscaping: (i) Is a"full screen"that functions as a visual barrier.This landscaping is typically found between residential and nonresidential areas; (ii)Shall at a minimum consist of: (A)A mix of primarily evergreen trees and shrubs generally interspersed to form a continuous year-round screen that grows to at least eight feet in height within two growing seasons. (b)"Screen-B" landscaping: • , r (i) Is a"filtered screen"that functions as a visual separator.This landscaping is typically found between commercial and industrial uses; between differing types of residential development; and to screen industrial uses from the road; (ii)Shall at a minimum consist of: (A)A mix of evergreen and deciduous trees and shrubs generally interspersed to create a filtered screen that grows to at least eight feet in height within two growing seasons. (c)"Screen-C"landscaping: (i) Is a"see-through screen"that functions as a partial visual separator to soften the appearance of parking areas and building elevations.This landscaping is typically found along road frontage or between multiple-family developments; (ii)Shall at a minimum consist of: (A)A mix of evergreen and deciduous trees or shrubs generally interspersed to create a continuous canopy. (4) Landscaping Road Frontages.The average width or depth of perimeter landscaping along road frontages and required locations on private property shall be provided as follows: (a)Ten feet of Screen-B landscaping shall be provided for an industrial development. (b)Ten feet of Screen-B landscaping shall be provided for all above-ground utility facilities or development, excluding distribution and transmission corridors, located outside a public right-of way. (c)Ten feet of Screen-C landscaping shall be provided for all commercial or multiple-family residential development. (5)Landscaping of Interior Lot Lines.The average width or depth of perimeter landscaping along interior lot lines shall be provided as follows: (a) Fifteen feet of Screen-A landscaping shall be included in all commercial, industrial, or small- scale recreational and tourist development along any portion adjacent to a residential use or district, except as may be varied by the administrator under subsection (2)(b)of this section. (b)Ten feet of Screen-B landscaping shall be included in all multiple-family development along any portion adjacent to a single-family residential use and in an industrial development along any portion adjacent to a nonindustrial development, except as provided in subsection(5)(a)of this section. (6)Landscaping for Parking Lots. Landscaping shall be provided for commercial, industrial,small-scale recreational and tourist uses, and multifamily residential use surface parking lots,with five or more parking stalls, as follows: (a)Screening shall be provided on each side,front, and/or rear of a parking lot where such side, front, and/or rear abuts any residential use or district, except that no screening is required where the elevation of the parking area lot line is four feet higher than the finished elevation of the parking area surface. (b)Parking lot screening and landscaping shall be kept in good condition and shall meet the following conditions: (i)It shall be continuous where required along a side,front or rear of a parking area and shall not be less than four feet in height above the grade of the parking lot surface, broken only for accessways and aisles; provided,that the screening shall not be permitted for a distance of 20 feet on each side of a parking area accessway to ensure proper sight distance.Where screening is prohibited by the above provisions, low lying shrubs or other similar plantings shall be placed; such plantings shall not be allowed to exceed three feet in height. (ii)Screening shall not be installed in such a manner as to obstruct the free use of any fire hydrant. (iii)The space between the landscaping screen and the right-of-way, except for any pedestrian access improvements, shall be landscaped with grass, shrubs,trees, or evergreen groundcover. On the sides and rear of parking areas not facing a street, such landscaping shall be required between screening and the lot line. -4 (7) Landscape Plan.When screening is required, a landscaping plan shall be submitted with the project application to indicate how the minimum screening requirements are met.The plan must meet the following requirements: (a)The landscape plan shall be drawn on the same base map as the development plans or on a separate sheet properly labeled and shall identify the following: (i)Total landscape area; (ii)Landscape materials, plant names,and applicable size; (iii)Property lines; (iv) Impervious surfaces; (v)Existing or proposed structures,fences, and retaining walls; and (vi)Natural features or vegetation left in natural state. (b)The required landscaping shall be installed prior to project occupancy. However, a certificate of occupancy may be issued prior to installation of the required landscaping if a bond or other form of appropriate surety is posted in a manner acceptable to the administrator.The time limit for compliance may be extended to allow installation of such required landscaping during the next planting season. (8)Maintenance. (a)All landscaping and necessary support systems shall be maintained for the life of the project. (b)All landscape materials shall be pruned and trimmed as necessary to maintain a healthy growing condition. (c) Landscape areas shall be kept free of trash. [Ord. 8-06§ 1] Article VIII. Conditional Uses 18.40.490 Purpose. The purpose of the conditional use permit process is to provide flexibility in the application of the use regulations contained in this code in order to accommodate uses that may be appropriate in an established district under certain circumstances, but inappropriate in the same district under others.At the time of application, a review of the location, design,configuration, and potential impact of the proposed use shall be conducted by comparing the use to the goals and policies established in the Jefferson County Comprehensive Plan and to adopted development standards.This review shall determine whether the proposed use should be permitted by weighing the public need or the benefit to be derived from the use against the impact that it may cause. [Ord. 8-06§ 1] 18.40.500 Scope. This article shall apply to each application for a conditional use permit. Only those uses indicated by a "C(a),""C(d)"or"C"opposite the use in Table 3-1 in JCC 18.15.040 will be considered for a conditional use permit. [Ord.8-06§ 1] 18.40.510 Application submittal and contents. (1)The application for a conditional use permit shall be submitted to DCD on forms provided by the department, along with the appropriate fees established under the Jefferson County fee ordinance.The application shall include all materials required pursuant to JCC 18.40.100. (2)The administrator may waive specific submittal requirements determined to be unnecessary for review of an application. [Ord. 8-06§ 1] 18.40.520 Conditional use permit types—Review processes. (1)Applications for uses listed as an administrative conditional use permit(i.e., "C(a)")in Table 3-1 in JCC 18.15.040 shall be processed according to the procedures for Type II land use decisions established in Article IV of this chapter. (2)Applications for uses listed as discretionary conditional use permits(i.e., "C(d)")in Table 3-1 in JCC 18.15.040 shall, at a minimum, be processed according to the procedures for Type II land use decisions established in Article IV of this chapter. However, in accordance with this subsection, the administrator may on a case-by-case basis refer a discretionary conditional use permit application to the hearing examiner to be processed according to the procedures for Type III land use decisions established in Article IV of this chapter. (a) Required Findings. Prior to referring an application for a use listed as"C(d)" in Table 3-1 in JCC 18.15.040 to the hearing examiner,the administrator shall make one or both of the following findings: (i)In the exclusive,discretionary judgment of the administrator, the application involves potentially significant issues relating to location, design, configuration, and potential 4 impacts to surrounding properties and the community that can be more appropriately considered and addressed through an open public record pre-decision hearing before the Jefferson County hearing examiner; or (ii) In the exclusive, discretionary judgment of the administrator,the application seeks approval of a use involving complex legal issues necessitating special expertise in the decision-maker. (b)Timing.The administrator shall determine whether or not to refer an application to the hearing examiner,for a public hearing, concurrent with the determination of completeness required under JCC 18.40.110(1). (c) Discretion of the Administrator.The administrator's decision to refer an application to the hearing examiner under this subsection to be processed as a Type III application shall be for the purpose of affording maximum fairness in decision-making and procedural due process protection, and shall not affect the substantive applicability of local, state or federal policies or law applicable to any permit application.The decision to refer any application to the hearing examiner to be processed as a Type III application rests exclusively within the discretion of the administrator. (d)No Notice or Hearing Required. Because the administrator's decision to refer(or not to refer) an application for a use listed as"C(d)" in Table 3-1 in JCC 18.15.040 to the hearing examiner for a public hearing rests solely in the administrator's discretion,the county is not required to provide prior notice of the administrator's decision.The administrator shall not be required to hold a public hearing on such a decision.The decision of the administrator made pursuant to this subsection (2)shall not constitute an appealable administrative decision. (3)Applications for uses listed as a"C"in Table 3-1 in JCC 18.15.040 shall be processed according to the procedures for Type III land use decision established in Article IV of this chapter. [Ord.8-06§ 1] 18.40.530 Approval criteria for all conditional uses. (1)The county may approve or approve with modifications an application for a conditional use permit(i.e., uses listed in Table 3-1 in JCC 18.15.040 as"C(a),""C(d)"or"C") if all of the following criteria are satisfied: (a)The conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity of the subject property and with the physical characteristics of the subject property; (b)The conditional use will be served by adequate infrastructure including roads,fire protection, water,wastewater disposal, and stormwater control; (c)The conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel; (d)The conditional use will not introduce noise, smoke,dust,fumes,vibrations, odors, or other conditions or which unreasonably impact existing uses in the vicinity of the subject parcel; (e)The location, size, and height of buildings, structures,walls and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties; (f)The pedestrian and vehicular traffic associated with the conditional use will not be hazardous to existing and anticipated traffic in the vicinity of the subject parcel; (g)The conditional use complies with all other applicable criteria and standards of this code and any other applicable local, state or federal law; and more specifically, conforms to the standards contained in Chapters 18.20 and 18.30 JCC; (h)The proposed conditional use will not result in the siting of an incompatible use adjacent to an airport or airfield; (i)The conditional use will not cause significant adverse impacts on the human or natural environments that cannot be mitigated through conditions of approval; (j)The conditional use has merit and value for the community as a whole; (k)The conditional use is consistent with all relevant goals and policies of the Jefferson County Comprehensive Plan;and (I)The public interest suffers no substantial detrimental effect. Consideration shall be given to the cumulative effect of similar actions in the area. (2) In instances where all of the above findings cannot be made,the application shall be denied. (3)The administrator may consider applications for modifications of lawfully established conditional uses and developments approved under this code and conditional uses in existence on December 18, 2000, when the application proposes to bring the existing use substantially closer to compliance with the standards of this code.The administrator may approve, conditionally approve, or deny the modification application.A site plan conforming to the provisions of this chapter and Article II, Project Permit Applications(Type I—IV), of this chapter shall accompany the application showing the location, size and type of modification proposed by the applicant. (4) Modifications may be approved by the administrator under Type I review procedures; provided, that the cumulative modifications of the approved use will not exceed the following limitations: (a)The modification will not increase residential use by more than one unit, if allowed by the land use district; (b)The modification will not increase the required amount of parking by more than 20 percent or 20 spaces(whichever is less); (c)The proposed modification will not expand the total square footage of all structures and/or outdoor use areas, excluding parking, by more than 20 percent. In addition,the proposed expansion of the structure shall not result in total size of the structure exceeding the maximum building size limits in Chapter 18.30 JCC; (d)The modification will not change or modify any special condition imposed under any previous official review; (e)The modification will not significantly reduce the amount or location of required site screening; (f)The modification will not expand an existing nonconforming use or structure,or render a conforming use or structure nonconforming; (g)The modification will not establish a new use; (h)The modification will not expand a mining/site operation, mineral processing or mineral batching activity; (i) In the determination of the administrator, the modification will not create or materially increase any adverse impacts or undesirable effects of the project, or cause the use or structure to become inconsistent with the Comprehensive Plan or the purpose of the land use class and district. (5)All proposed uses, structures and site improvements(and modifications thereof)shall comply with the development standards of this code. (6)Any proposed modification that does not meet all the requirements of this subsection shall not be approved through this process, but shall be reviewed through the current review procedures as outlined by this chapter. (7)Decisions to administratively approve modifications shall be administered through a consistency review of development permits in accordance with this code and any previous conditions of approval. [Ord. 8-06§ 1] A 18.40.540 Additional conditions. The county may impose additional conditions on a particular use if it is deemed necessary for the protection of the surrounding properties, the neighborhood, or the general welfare of the public.The conditions may: (1) Increase requirements in the standards, criteria or policies established by this code; (2)Stipulate an exact location for the conditional use on the subject property as a means of minimizing hazards to life, limb, property damage, erosion, landslides or traffic; (3)Require structural features or equipment as a means of minimizing hazards to life, limb, property damage, erosion, landslides or traffic;or (4)Contain restrictions or provisions deemed necessary to establish parity with uses permitted in the same zone with respect to avoiding nuisance generating features in matters of noise, odors, air pollution, wastes,vibration,traffic and physical hazards. [Ord. 8-06§ 1] 18.40.550 Use of property before final decision. No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. [Ord. 8-06§1] 18.40.560 Effective period—Expiration. (1)A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three years of the effective date(the date of the decision granting the permit)of the permit unless the permit approval provides for a greater period of time. (2) Extensions to the duration of the original permit approval are prohibited. (3)The department of community development shall not be responsible for notifying the applicant of an impending expiration. [Ord. 8-06§ 1] 18.40.570 Modification of a conditional use permit. The county may modify an approved conditional use permit as follows:the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s)who control the property without approval so as to significantly impact surrounding land uses.A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270. [Ord. 8-06§ 1] w • , • r 18.40.580 Conditional use permit to run with the land. A conditional use permit granted under this article shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. [Ord.8-06§ 1] 18.40.590 Permit suspension or revocation. The county may suspend or revoke an approved conditional use permit pursuant to Chapter 18.50 JCC upon finding that: (1)The use for which the approval was granted has been abandoned for a period of at least one year; (2)Approval of the permit was obtained by misrepresentation of material fact; or (3)The permit is being exercised contrary to the terms of approval. Attachment 0 , Flinn L:4i 5� 1::t� '.•o DENVER THE MILE HIGH CITY Best Management Practices: Commercial Medical Marijuana Cultivation The emerging medical marijuana cultivation industry has many opportunities to enhance their public image and protect the environment by incorporating best management practices to reduce or eliminate odors and other adverse environmental impacts from their operations. 1. Ventilation and Odor Control The pungent odor from marijuana cultivation operations is objectionable to many people. Offensive odors can easily migrate in and around the marijuana cultivation site and some strains produce odors that are detectable in the surrounding neighborhood as well as adjacent tenants. All medical marijuana cultivation operations should employ ventilation and odor control that is adequate for the size of the operation. • It is imperative to properly design the ventilation system, taking into consideration the square footage and number of plants. A properly sized, installed and maintained ventilation system can help resolve two issues. Firstly, having the grow rooms properly balanced will inhibit odors from escaping. Secondly, the addition of a dehumidifying system to control mold and pathogen growth should be considered. ideally, humidity to control molds should be set under 50%. Contact a reputable HVAC contractor for assistance with these design elements. • Three (3) odor control technologies have shown promise with controlling odors from grow operations. o Activated Carbon Filtration —This technique involves forcing the air circulating within the HVAC system through an activated carbon filter in order to filter out odors and pathogens that may pose a public health risk. This method is highly effective and can be used in combination with other technologies such as an electrostatic precipitator. The size and layout of the cultivation operation will determine the requirements for the carbon filtration system. Larger scale operations will require the use of larger fans and more carbon and will typically increase the requirements of existing HVAC systems. In addition, as filters age and the activated carbon becomes clogged with impurities, it will be necessary to replace the carbon; filters should typically be replaced per the manufacturers recommendation. In addition, the dust April 2011 Version 1.0 collector"sock" associated with the carbon filter should be changed out every 6-8 months for proper air flow. Carbon filtration is the least energy intensive of the three technologies. In most cases, the energy required to run the filtration system is already accounted for in the air handling and exchange system. The excess energy necessary to force air through the filter is negligible and, depending on the size of the discharge and intake, often only slightly alters the speed of the exchange. The use and disposal of the filters creates the most physical waste; however, the carbon can typically be regenerated for reuse. o Negative Ion Generation —These machines, sometimes called electrostatic precipitators, will use a negative charge to attract positively charged particles in the air. The charged particles are attracted to the metal filters, which over time, will become concentrated with particles and require cleaning with water on a regular basis. In some cases this technology has been shown to work The negative ion generators can improve indoor air quality to a greater degree than some of the other technologies. The environmental impact of this technology is also dependent upon size and use. They are typically powered by a single wall outlet and can run 24 hours a day, 7 days a week. They will also need to be cleaned which usually requires removing the metal panel and washing it to remove the particles. Otherwise, they require very little maintenance and their energy consumption is typically negligible and lower than many fans. o Ozone Generators - Ozone can be extremely effective at breaking down odors and other contaminants. Potential problems with ozone originate with the molecule's destructive tendencies. Ozone is an effective sterilizer; however, excessive and/or unmonitored use has been shown to damage or even destroy crops and can cause lung irritation. Although ozone degrades quickly, the output of the gas can be an indoor environmental hazard to both the people and the plants. Release of the gas outside can also have varying local effects depending on the time of day, concentration, and disbursement factors associated with the location and weather. The major impact will come from energy consumption. o Masking Agents —There are also odor masking equipment that can be used for temporary localized odor control. This method is not recommended to control odors alone. April 2011 Version 1.0 A preventative maintenance and replacement plan should be established for any of theses systems to ensure optimum operation and continuous odor control. 2. Energy Consumption Energy efficient lighting such as compact fluorescent lights (CFLs), may be a great alternative to incandescent bulbs in many applications; however, they may not provide the proper growing spectrum for your plants. High efficiency CFLs or LEDs should be used whenever possible in non-grow spaces, such as offices and restrooms. In addition, when installing new electrical equipment, use products with the Energy Star seal whenever feasible. Always have a licensed electrical contractor install electrical equipment and lighting to ensure safe wiring and adherence to local building code requirements. Another option to off-set your energy usage is to purchase Windsource from Xcel Energy or carbon off-sets through Climate Trust or The Carbon Fund. 3. Water Quality and Conservation Although water covers nearly three quarters of the earth, less than one percent is clean fresh water. Therefore, it is critical that we conserve and protect this valuable resource. Never dispose of anything in the outside storm drains. Keep areas surrounding dumpsters free of debris and wastes. Remember, "nothing in the storm drain but stormwater". To help with water conservation, educate staff on turning off the water while washing hands and equipment, installing low-flow aerators on faucets, and retrofitting toilets to low flow models. 4. Other Standard Practices • Ensure safe disposal of fertilizers, insecticides, plant growth regulators, and other chemicals. Buy only what you need and store in a safe place and clean- up spills immediately. Refer to the Material Safety Data Sheet for disposal requirements. • Currently there are no pesticide products that are registered or labeled for use on medical marijuana. The application of a pesticide to a plant that is not on the pesticide label is a violation of federal and state pesticide laws. • Effective July 1, 2011, section 12-43.3-12.200 of the of the Colorado Revised Statute in part requires that medical marijuana waste must be rendered unusable prior to leaving the facility by grinding and incorporating the material with non-consumable solid wastes such as food waste, soil or other compostable materials. Composting unusable plant material and soils provides a valuable opportunity to create nutrient rich soil to stimulate healthy plant growth. The findings and conclusions below support Jefferson County's comment that we do not object to the location for the producer Tier 2 license. Findings: 1. License 413086-513 requests approval for designation as Marijuana Producer Tier 2. 2. Per the WSLCB website,a Marijuana Producer Tier 2 license allows the applicant at a specific location, "To produce marijuana for sale at wholesale to marijuana processor licensees and to other marijuana producer licensees. Tier 2 allows for between two thousand square feet and ten thousand square feet of dedicated plant canopy. Any entity and/or principals within an entity are limited to no more than three marijuana producer licenses." 3. The parcel located at 195 Glacier Ridge Rd, Quilcene, WA 98376-9639 is zoned Rural Residential 1:5 acres,(RR 1:5). 4. Agriculture activities including growing marijuana is an allowed use under any of the Comprehensive Plan land use designations, subject to the provisions of this JCC 18.20.030, except that "processing," "packing,"and"sales"are regulated under JCC 18.20.030(3)Accessory Uses. 5. Per JCC 18.20.030(3)(c) Proposals that would be classified accessory uses in agricultural lands, such as processing,packing,and sales of agricultural products,may be considered and approved in other land use districts under different and appropriate land use classifications, such as commercial use, light industrial use, home business, cottage industry, or small-scale recreation and tourist use, subject to allowed and prohibited uses per land use district and the associated permit processes and approval criteria. 6. Accessory agricultural activities including marijuana processing, packaging and labeling in the Rural Residential 1:5 zoning district may be allowed subject to a cottage industry permit and compliance with the Jefferson County Code. 7. Any structures proposed for growing, processing, packaging or labeling of marijuana shall comply with Jefferson County Code including but not limited to critical area buffer and setback requirements per Chapter JCC 18.22 and building code standards per Chapter JCC 15.05. 8. Jefferson County has no record of application or issuance of a permit for construction or use of a structure for growing,processing,packaging or labeling of marijuana. 9. The location for the proposed license(s)is not within a known exclusion zone based on the criteria of "The distance shall be measured as the shortest straight line distance from the property line of the licensed premises to the property line of an elementary or secondary school,playground,recreation center or facility,child care center,public park,public transit center, library or arcade where admission is not restricted to those age 21 and older." 1 Conclusions: 1. Jefferson County has no objection to issuance of the Marijuana Producer Tier 2 license at 195 Glacier Ridge Rd,Quilcene,WA 98376-9639. Jefferson County's comments are based upon information on record with Jefferson County Department of Community Development and provided by the Washington State Liquor Control Board to date. The County continues to be interested in the outcome of this project and requests the WSLCB continue to include Jefferson County as an interested party. State Environmental Policy Act(SEPA)—SEPA is not a permit; it is an environmental review process which helps governments make decisions about permits and other actions. The WSLCB completed a SEPA review for the rules governing marijuana licensing. Individual producer operations may also have to undertake SEPA reviews. Local permitting agencies will determine if it is necessary. If SEPA is required, project applicants must complete a checklist describing the possible environmental impacts of their project. Processes such as wastewater and solid waste disposal, CO2 use in the growing cycle, odors, etc. may be included.Additional guidance about SEPA can be found at: • www.ecy.wa.gov/programs/sea/sepa/aaenciesApplicantsGuidance.html State and Regional Environmental Permits and Regulations There are a number of environmental permits and regulations that may apply to indoor growing operations.These permits are generally administered by state or regional agencies unless a local jurisdiction has been delegated by the state to issue the permit. Water Quality Permits—water quality permits address wastewater or stormwater discharged from a facility or leaving facility grounds. Indoor marijuana producers may need water quality permits if they discharge wastewater from their growing operations, such as water containing excess fertilizers or if they construct a new facility. Wastewater discharge permits can be issued by either the state Department of Ecology(Ecology) or a local jurisdiction, such as King County, if it has delegated authority. Construction stormwater permits are issued by Ecology and might be needed for construction of a new facility.They are required for land-disturbing activities that disturb one or more acres of land and that discharge stormwater into surface waters of the state. Smaller sites may also need a permit if they are part of a larger development that will disturb one acre or more. (The definition of fertilizers includes water reclaimed from food processing or wastewater treatment facilities.) Chemigation and fertigation systems must be installed according to state regulations,WAC 16-202-1001 and WAC 16-202-2002.The Department of Agriculture has a technical assistance program to assist individuals who chemigate and fertigate in protecting human health and the environment from the potential hazard of improper fertilizer and pesticide use. If a facility uses a boiler in its operations, such as for heating or CO2 generation, that boiler could need a permit. See: http://apps.oria.wa.qov/permithandbook/permitdetail.asp?id=108 In addition, clean air agencies have the authority to regulate odors that"may unreasonably interfere with another property owner's use or enjoyment of his property", (WAC 173-400-040(5)). Facilities that receive odor complaints can be subject to fines or be required to add air filtration equipment. Before odor complaints occur, consider adding odor control technology to your building's heating, ventilation and air conditioning system. Solid Waste Handling—The marijuana licensing rules require that marijuana wastes from indoor growing operations be rendered unusable by mixing with 50% other materials and ground before disposal or composting. These ground and mixed materials are considered"solid waste" by the state regulations and must be handled according to the state Solid Waste Handling Standards(WAC 173-350)and the requirements of the marijuana licensing rules. Solid waste regulatory oversight is the responsibility of county health districts (sometimes called "environmental health"). Producers should work with their health district to determine proper disposal of solid wastes. Tip:Determine how you want to handle your solid waste before beginning operations. Be prepared to discuss the following with your local health district(be as specific as possible): • How much waste will you have? • What you will be mixing the marijuana waste with to render it unusable? • How, where and for how long will marijuana waste be stored? • Where will the unusable marijuana waste be sent and who will be transporting it? • Are you planning to compost marijuana waste on-site?
