Dear Bob: Thank you for the time you and Eileen Simon spent with Archie Charawell and me on Friday, September 25, 1992. In accordance with our discussion,we wish to confirm that Hayden Development is in opposition to, and will vigorously resist,the vacation of Old Chimacum Rd. as proposed by the county and Leon Lopeman unless the county agrees to vacate the portion of Old Chimacum Rd. which is adjacent to the Lopeman property. We feel that the county should be concerned with this unsafe intersection and the potential hazard that it presents and vacate this portion of Old Chimacum Rd. either simultaneous to or prior to any other vacation proceedings. It is our understanding that you agree that the county should vacate this mad as it crosses Hayden Development property(subject to certain agreements as to deeding property,rights of way,etc.). It is Mr. Charawell and my understanding that Eileen Simon will attempt to meet certain time constraints and get the Jefferson County Attorney to agree to some letter of intent that will commit Jefferson County to the vacation of the unsafe intersection. If and when this occurs,Hayden will withdraw its objection to the pending procedure. Due to serious illness of members of my family,I will not be available for the hearing on October 6, 1992, and ask that you make the hearing officer aware of Hayden's position should the county not have issued the above referenced letter of intent.
