Memo to Old Hadlock Road(CR#527109)file regarding research of 1992 Road Vacation
Petition for portion of Old Hadlock Road lying between Lopeman Road and Promwell Road.
The following items were noted:•
• Resolution#94-92 dated 10/12/1992 declared the County's intent to vacate a portion of
the Old Hadlock Road right of way at its intersection with Chimacum Road.
• Engineer's Report dated 12/7/1992 recommended approval of the Vacation provided a .
"Statutory Warranty Deed"granting the rights of way for construction of a new
intersection to Jefferson County be fully executed and filed with the Jefferson County
Auditor prior to finalizing this vacation."
• Hearing held 01/05/1993—several people testified in opposition stating that they use the
road not only for vehicular traffic,but for walking&riding horses as well.
• Hearing Examiner's Report and Recommendation dated 01/28/1993 recommends
approval of the vacation subject to 1)the petitioner(County)reserving an easement
within the right of way being vacated and construct a trail suitable for walking,bicycling
and horse use. The trail would need to be separate from Chimacum Road and connect
with the trail to the north(if and when constructed—subject to approval of a separate
vacation petition);and Hayden Development.Co.dedicating,by statutory warranty deed,
the land needed for construction of a new intersection connecting Chimacum Rd to Old
Hadlock Rd. The area to be vacated was determined to have a value of$3,000. Either
Hayden Dev Co or PW were to obtain an assessment from the Assessor's Office or value
from a private appraiser for the area being deeded by Hayden Developement. If the
• estimated value of the right of way being deeded to the County does not satisfy the
compensation requirement,Hayden Dev Co was to pay the difference(by cash or some
other method acceptable to the CO).
• On February 16, 1993,the BOCC approved the vacation petition as recommended by the
Hearing Examiner.
• Hayden Development Co.deeded right of way to County for new intersection. Statutory
Warranty deed recorded 9/16/1993 at AFN 364148(V430/P50)for portion shown in
green on attached survey. This right of way is shown on the Assessor's map(NE 11-29-
1 W).
• No indication was found that the value of the Hayden Development property deeded to
the County was ever obtained.
' • . The Vacation Ordinance in effect in 1993 (06-0615-92) stipulates that conditions must be
met and fees paid within one year of approval or approval may be rescinded upon notice
by mail to the petitioners.
• Did not find a Vacation Resolution signed by the BOCC nor does the vacation appear in
the"Vacations"Database.
