A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top or toe of the Landslide Hazard Area. 2.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 3.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 4.) All construction activities shall not encroach upon the landslide hazard area buffer. This includes the storage or preparation of materials. 5.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 6.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 7.) A stormwater management plan shall be prepared and submitted at time of building permit application and shall comply with the Washington State Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of a stormwater and drainage control system. 8.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 9.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk(or salvage)yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 10.) Proponent shall submit an original written confirmation letter from DOT stating that the approach has been installed based on the conditions of the permit Number 47480. 11.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5) year period, the Site Plan Approval Advance Determination (SPAAD)cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval-Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.)and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD)and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Section 8.7 shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Section 8.7 of the UDC for criteria pertaining to modifications). 12.) A minimum of two (2)on-site parking spaces shall be provided for the single family residence. 13.) Minimum setback from SR 19 right-of-way shall be 35 feet. Minimum side yard setbacks shall be 5 feet. Minimum rear setback (adjacent to commercial forest lands) shall be 120 feet. 14.) The building height is not to exceed 35 feet. 15.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. Pre-existing legal lots of record less than one acre in size in rural residential districts are subject to the stormwater requirements in Chapter 18.30 JCC and must meet the"Area of Impervious Surface Coverage"to the maximum extent practicable as determined by the administrator. Lot coverage is defined as amount of impervious surface, which includes rooftops, driveways, concrete, etc. 16.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 17.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 18.) The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 19.) Applicant is requesting a reduction to the commercial forest lands setback from 250 feet to 120 feet at the eastern boundary. Based on the requested reduction, at time of building permit application, applicant shall also submit a letter to the Administrator acknowledging that the County considers forestry operations a high priority and a favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations. Such forestry activities may include but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of forestry machinery during any 24-hour period, and the application of permitted fertilizers and permitted pesticides. A reduced buffer may cause those activities to be intensified on the subject parcel and the county will not be liable. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Septic Permit approved under SEP95-145, approved 7/5/1995, finaled 7/26/1995. The SPAAD approval does not extend approval to development other than that stated on the finaled onsite sewage permit. Any changes, alterations or modification of the site in the vicinity of the approved system, drilling of wells or observation of critical areas may invalidate this permit. 3.) The application was reviewed by the Jefferson County Department of Community Development staff on July 28, 2009 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: type N stream; seismic; low landslide hazard area; SUSC aquifer recharge area. 4.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 6.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 7.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500)feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 8.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 9.) The site plan as submitted with the SPAAD application on May 11, 2009 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 28, 2009 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) This approval is for a SPAAD only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 11.) The parcel has been designated as RR 1:10 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 12.) The proposal was reviewed against the site plan determination criteria of the Unified Development Code (Section 8.7). The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan and the provisions of the Unified Development Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The site plan identifies that water will be provided through an on-site private well located in the mid-eastern portion of the parcel. Potable water shall be provided at time of building permit application. An address of 2982 Beaver Valley Road (SR 19), Port Ludlow has been assigned to the parcel. A state access connection permit(#47480)was approved on April 2, 2009. A septic permit(SEP95-0145)was approved on July 5, 1995 and finaled on July 26, 1995. The SPAAD approval does not extend approval to development other than that stated on the finaled onsite sewage permit. Any changes, alterations or modification of the site in the vicinity of the approved system, drilling of wells or observation of critical areas may invalidate this permit. The approved site plan has not been reviewed for stormwater requirements. Sections JCC 18.30.060 and JCC 18.30.070 of the Jefferson County Code requires the project applicant prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. The parcel is approximately 11.23 acres in size and impervious surface coverage should not exceed 25 percent and complies with JCC 18.30.050, Table 6-1: Density, Dimension and Open Space Standards. The SPAAD was not reviewed for fire flow. However, the parcel is located within a state approved water system. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP)fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source, and storage. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing the provisions contained within Section 8 of this Code and Chapter 43.21C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 13.) The proposed ADU for this SPAAD application is greater than 400 feet to the north of the Type N stream. Therefore, no stream conditions were placed on this application. 14.) 7/28/09 county staff telephoned the applicant to inform him of the adjacent commercial forest lands and the county required 250 foot buffer to commercial forest lands. Site plan shows 120 feet to the commercial forest lands on the eastern boundary. Applicant acknowledged forestry activities and accepts responsibility for a reduced setback of the potential intensified increase in inconveniences forest activities may create. A letter of acknowledgement will be submitted with a building permit. 15.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final deasion to Jefferson County Superior Court within twenty-one (21 lendar days of the date of issuance of this land use decision. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 19.) Applicant is requesting a reduction to the commercial forest lands setback from 250 feet to 120 feet at the eastern boundary. Based on the requested reduction, at time of building permit application, applicant shall also submit a letter to the Administrator acknowledging that the County considers forestry operations a high priority and a favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations. Such forestry activities may include but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of forestry machinery during any 24-hour period, and the application of permitted fertilizers and permitted pesticides. A reduced buffer may cause those activities to be intensified on the subject parcel and the county will not be liable. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Septic Permit approved under SEP95-145, approved 7/5/1995, finaled 7/26/1995. The SPAAD approval does not extend approval to development other than that stated on the finaled onsite sewage permit. Any changes, alterations or modification of the site in the vicinity of the approved system, drilling of wells or observation of critical areas may invalidate this permit. 3.) The application was reviewed by the Jefferson County Department of Community Development staff on July 28, 2009 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: type N stream; seismic; low landslide hazard area; SUSC aquifer recharge area. 4.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 6.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 7.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500) feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 8.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 9.) The site plan as submitted with the SPAAD application on May 11, 2009 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 28, 2009 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) This approval is for a SPAAD only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 11.) The parcel has been designated as RR 1:10 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 12.) The proposal was reviewed against the site plan determination criteria of the Unified Development Code (Section 8.7). The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan and the provisions of the Unified Development Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The site plan identifies that water will be provided through an on-site private well located in the mid-eastern portion of the parcel. Potable water shall be provided at time of building permit application. An address of 2982 Beaver Valley Road (SR 19), Port Ludlow has been assigned to the parcel. A state access connection permit(#47480)was approved on April 2, 2009. A septic permit(SEP95-0145)was approved on July 5, 1995 and finaled on July 26, 1995. The SPAAD approval does not extend approval to development other than that stated on the finaled onsite sewage permit. Any changes, alterations or modification of the site in the vicinity of the approved system, drilling of wells or observation of critical areas may invalidate this permit. The approved site plan has not been reviewed for stormwater requirements. Sections JCC 18.30.060 and JCC 18.30.070 of the Jefferson County Code requires the project applicant prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. The parcel is approximately 11.23 acres in size and impervious surface coverage should not exceed 25 percent and complies with JCC 18.30.050, Table 6-1: Density, Dimension and Open Space Standards. The SPAAD was not reviewed for fire flow. However, the parcel is located within a state approved water system. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP) fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source, and storage. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act (SEPA) implementing the provisions contained within Section 8 of this Code and Chapter 43.21 C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act (SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 13.) The proposed ADU for this SPAAD application is greater than 400 feet to the north of the Type N stream. Therefore, no stream conditions were placed on this application. 14.) 7/28/09 county staff telephoned the applicant to inform him of the adjacent commercial forest lands and the county required 250 foot buffer to commercial forest lands. Site plan shows 120 feet to the commercial forest lands on the eastern boundary. Applicant acknowledged forestry activities and accepts responsibility for a reduced setback of the potential intensified increase in inconveniences forest activities may create. A letter of acknowledgement will be submitted with a building permit. 15.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. Directing of surface water from private property onto Department right of way will not be permitted,unless otherwise approved by the Department. Q 9. All buildings and appurtenances shall be so located at a distance from the right of way line of any State Highway that none of the right of way therefore is required for use of the patrons or customers of any such establishment. Permit Holder shall comply with local building codes. Set-back requirements for the location of buildingts in relation to the right of way line are a function of local authorities,and they should be consulted regarding requirements that must be adhered to. The Permit Holder agrees to schedule the work herein referred to and perform said work in such a manner as not to delay the Department's contractor in the performance of his contract. O 11. Work within the right of way shall be restricted to between the hours of 7:00 AM and 5:00 PM and/or ,and no work shall be allowed on the right of way Saturday,Sunday,or holidays,unless authorized by the Department. Any lane closures must be submitted for approval in advance of use. The hours of permitted closure may differ from the above noted hours. Q 12. The shoulders,where disturbed,shall be surfaced with crushed surfacing top course 4-6 inches minimum compacted depth,or as directed by the Department. The surface of the finished shoulder shall slope down from the edge of pavement at the rate of 5%unless otherwise directed. The restored shoulder must not have any strips or sections less than 0.6 meters(2 feet)wide. The restored shoulder shall be surfaced with Crushed Rock Q 13. The Permit Holder shall be responsible for constructing and maintaining the access connection(s)and appurtenances between the shoulder line of the highway and the right of way line inclusive of surfacing and drainage. The Department has the right to inspect all installations at the time of construction and at any time afterward and to require that necessary changes and repairs be made. Unsatisfactory work will be corrected by the Department,at the Permit Holder's expense,or access may be removed at the Permit Holder's expense. The access aconnection shall be sufficiently surfaced back an adequate distance from the edge of the pavement to prevent any tracking of material onto the highway. Any tracking of material onto the highway shall be subject to enforcement of Chapter 46.61.655 RCW and shall be immediately cleaned up by the Permit Holder or the Permit Holder's agent. 0 15. Standard highway warning signs designated as"Truck Crossing"sign,plate W8-6,shall be placed and maintained at Permit Holder's expense on each side of the access connection. Signs shall be in evidence only when access is actually being used. If necessary,flagmen shall be provided. Sufficient parking space shall be provided by the Permit Holder outside Department right of way so no vehicles will be parked on said right of way. Q 16. All manholes,valve covers,and like appurtenances shall be constructed at such an elevation to conform to the shoulder slope from the edge of pavement or as directed by the Department. Q 17. All slopes,slope treatment,top soil,ditches,pipes,etc.,disturbed by this operation shall be restored to their original cross section and condition. All hazards shall be marked by warning signs,barricades,and lights. If necessary,flagmenshall be employed for the purpose of protecting the traveling public. Roadside operations shall be specified by the Department's representative. Q 18. During the construction and/or maintenance of this facility,the Permit Holder shall comply with the Manual on Uniform Traffic Control Devices for Streets and Highways,(Federal Highway Administration)and Washington modifications thereto. If determined necessary by the Department, the Permit Holder shall submit a signing and traffic control plan to the Department's representative for approval prior to construction or maintenance operations. No lane closures shall be allowed except as approved by the Department representative. Approvals may cause revision of special provisions,including hours of operation. 0 19. Bond coverage required to ensure proper compliance with all terms and conditions of said permit will be furnished by a Blanket Surety Bond held by the Department at the Olympia Service Center. j]✓ 20. A surety bond in the amount of $2,000.00 written by a surety company authorized to do business in the State of Washington shall be furnished to ensure compliance with any and all of the terms and conditions of this permit and shall remain in force until all work under this permit has been completed and approved by the Department. Q 21. Relative to advertising adjacent to all State highways,we wish to call your attention to the Sceni Vistas Act of 1971,Chapter 47.42 RCW and State Transportation Commission ruling Chapter 468-66 WAC. Violation of this section of the statutes will be sufficient cause for cancellation of this permit. On-premise signs are allowed. O 22. The Permit Holder shall notify the Department's representative upon completion of the work under this permit so that a final inspection can be made. Q 23. The responsibility of the Permit Holder for proper performance,safe conduct,and adequate policing and supervision of the project shall not be lessened or otherwise affected by Department approval of plans,specifications,or work,or by the presence at the work site of Department representatives,or by compliance by the Grantee with any requests or recommendations made by such representatives.
