This amendment is being proposed because the subject property is suitable and appropriate for higher density (1 :5) rural residential use because of the proximity of a public water system, power, telephone, roads, etc. The features of the ro are very perly ery usable for 1 :5 rural residential and approximately 80% are not affected by critical areas or buffers. (A National Wetlands Inventory map is attached as EXHIBIT C-3 and it should be noted that County maps are extremely inaccurate compared to this map in this area). The proposed change in designation would bring it into conformance with all surrounding property zoning. No other similarly situated parcel (i.e. a single parcel less than .40 acres 100% surrounded by small parcels) in the county was identified that did not receive 1 :5 zoning. It is believed that the 1 :20 designation was possibly a mapping error because the assessor's office had assigned the same parcel number to a much larger remote parcel which was not contiguous with this one nor had ever been attached or associated with it. This duplication of numbers was in effect at the time of the comp. plan adoption but has been changed since then. This parcel also could be subject to the so-called 50% criteria (i.e. at least 50% surrounded by small parcels), and in fact the subject parcel is 100% surrounded by small parcels of 5 acres or less. In the entire neighborhood (1/4 to 1/2 mile in all directions) there is only one similarly sized parcel (it does not border the subject) and it was zoned 1 :5. It is parcel #921072001 and it appears to be approximately at least 75% encumbered with wetlands. There are 42 individual lots of record (see assessors parcel maps attached) contiguous to the subject parcel. One is 5 acres. Two are between 2 and 4.75 acres. Three are between 2 and 3 acres. Assuming the Comp. plan reflects widely held values of the residents of Jefferson County (specifically, designation criteria for RR 1 :5 zoning, i.e. "Located in areas of similar development; areas with smaller existing lots of record") this amendment would conform. d. (i) Access: Cleveland Street, the logical access road for this parcel, is completely along one side of the property. The parcel also touches Oak Bay Road and Old Flagler Road.
