STATEMENT OF ISSUE: Conduct a Public Hearing to accept testimony on two alternatives
for establishing a No Shooting Area in the vicinity of Tala Shore and Tala Point, near Port
Ludlow.
ANALYSIS: On December 14, 2012, the County Auditor certified as sufficient a petition to
establish a No Shooting Area in an area surrounding Tala Shore Drive. A No Shooting Area for
this original petition area would be created by Ordinance Alternative 1.
The County later received input from property owners outside the original petition area,
including a letter from the Tala Point Home Owners Association, asking that the No Shooting
Area be expanded. County staff also did outreach to Treaty Tribes soliciting their input.
Subsequently, at the request of the County Commissioners, a second No Shooting Area
alternative has been developed to reflect these and other comments the County received. The
second alternative enlarges the proposed No Shooting Area surrounding Tala Shore Drive by
extending it west to East Ludlow Ridge Road; and adds another, but separate, expansion area
comprised of the smaller lots located further north, at Tala Point. A No Shooting Area for both
expansion areas would be created by Ordinance Alternative 2.
Both ordinance alternatives have been approved as to form by the Prosecutor's Office.
Pursuant to state law (RCW 9.41.300) and county code (Chapter 8.50 JCC) the county can
restrict the discharge of firearms where there is a reasonable likelihood that humans, domestic
animals, or property may be jeopardized. The purpose of the public hearing is to take public
testimony from all interested persons for or against the two alternatives for establishing a No
Shooting Area. Written public comments will also be accepted any time up through the close of
the public hearing, addressed to the BoCC at P.O. Box 1220, Port Townsend, WA 98368, or by
e -mail at jeftboccLa)co jefferson.wa.us.
Public notice was published a month in advance in the Port Townsend Leader, on June 18 and
again on July 9, 2014, and posted on the County's web site. In addition, letters inviting written
or verbal testimony on the proposals were sent by US mail to 1) all registered property owners
and residents of all parcels within the entire area between the existing Paradise Bay No Shooting
Area and the Port Ludlow Master Planned Resort (also a No Shooting Area), 2) all registered
property owners and residents within 300 feet of the periphery of that area, and 3) a list of Treaty
Tribe representatives.
FISCAL IMPACT: None, other than the cost of publishing and mailing a hearing notice.
RECOMMENDATION: Hold the public hearing, consider all written and verbal testimony
and the record, deliberate, and adopt one of the two alternative ordinances, with or without
further amendments.

WHEREAS, the Jefferson County Board of County Commissioners makes the following
Findings of Fact with respect to this particular No Shooting Area petition and review process:
1. On April 16, 2007, Ordinance No. 02- 0416 -074as adopted by Jefferson County,
codified under the Health and Safety provisions of Jefferson County Code
Chapter 8.50, which specifies the process for the establishment of no shooting
areas in accordance with RCW 9AI.300(2)(a) "where there is a reasonable
likelihood that humans, domestic- anitiials, or property may be jeopardized;" and
2. Jefferson County Code Chapter 8.50 specifies procedures for establishing no
shooting areas in specifically described unincorporated areas of Jefferson County;
and
3. On November 6, 2012, a petition was received pursuant to JCC 8.50.050(a) from
residents of the Tala Shore area located in voting Precinct #504, which was found
to be sufficient upon review, by the County Auditor, for the purposes of

considerin the establishment of a Tala Shore no shooting area by this ordinance;
and
4. At a January 14, 2013, meeting of the Board of County Commissioners the Board
that review, requested the petitioners to
provide documentation regarding the potential interest of nearby landowners to
further expand the proposed no shooting area boundary; and
5. The County received a letter dated February 1, 2013 from the Tala Point Home
Owners Association supporting expanding the existing Port Ludlow and Paradise
No Shooting Areas to include the entire Tala Point area, with 13 property owners
in favor, 3 opposed, and 2 non- responding; and
6. Sufficient interest has been documented to warrant considering an expansion to
the boundaries of the proposed Tala Shore no shooting area to potentially include
the area of Tala Point containing smaller lots, many of which have homes; and
7. On February 18, 2014, the County sent letters to all Point No Point and Point
Elliott Treaty tribes pursuant to JCC 8.50.050, inviting the tribes to identify their
concerns and inviting their participation regarding the potential establishment of a
Tala Shore No Shooting Area; and
8. Properties surrounding the Tala Shore Drive area and the developed area of Tala
Point include a number of larger, undeveloped lots, including an 80 -acre parcel
managed by the Washington Department of Natural Resources, and
9. Pursuant to JCC 8.50.050(b), the County Commissioners may themselves propose
the boundaries of a no shooting area; and

10. The entire area lies north of the existing Paradise Bay No Shooting Area and east

11. On June 16, 2014, the Board approved a legal notice announcing a public hearing
to be conducted on July 21, 2014, at 10:00 a.m. in the Jefferson County
Commissioners' Chambers; and
12. On July 21, 2014, the Board held the public hearing on the proposed Tala Shore
No Shooting Area boundary. Oral and written testimony was received by the
Board; and
13. In accordance with RCW 9.41.300(2)(a), the Boa
Shore No Shooting Area is a region of unincorpor;
there is a reasonable likelihood that the health and

The residents of Tala Shore Drive, Port Ludlow, County of Jefferson, state of Washington wish to
Petition the board to extend or establish a new no shooting zone from existing Paradise Bay no
shooting zone to include the following area of Tala Shore Drive beginning with lots 9982DD354 (west
side of Tala Shore Drive and lot #998200301 on the east side of Tala Shore Drive Section 22 Township 28
north and continuing north beginning with lot 998200353 west side of Tala Shore Drive and lot
#998100302 on the East side of Tala Shore Drive Section 15 Township 28 north. This petition continues
from the above Listed lots and includes all lots on the west and east side of Tala Shore Drive to and
including lot 821151002 Section 15 Township 28 north.
(see attached map).
We are petitioning for the no shooting zone because of the close proximity of the lots. Also we have
several properties that are weekend or seasonal rentals and have heard gun shots during midday and
in the late hours of night, which has originated from rental properties. It is not a comfortable feeling to
know that a complete stranger can stay in our neighborhood for a night or two and be free to target
practice at will.

Hello Tala Point Neighbors.
I had a conversation with our County Commissioner, John Austin, a few days ago and learned
an interesting piece of information. Tala Point is not currently designated a "No Shooting
Zone ". 1 had alway assumed it was. The area south of Paradise Road is no shooting, but not the
area north of the road including our development.
My personal opinion is that being in a no shooting zone is a good thing and I would support
such a change. John Austin indicated that the County Commissioners might also be
interested in making this change, if there is general support from the residents within the
area. That's us, and also the folks along Tala Shores.
And, what brings this up at this time is that the Tala Shores neighbors have petitioned the
county to do this. My understanding, however, is that the requested zone would only
include the area east of E Ludlow Ridge Road, and not the entire point. The Commissioners
have the authority to expand this no shooting zone to include the entire point, but would
only do so with community support.
The following note from Homer Evans of Tala Shores provides more information as well as
an attached map. Please take a look. I hope you will agree with me and give this project
your support. As Homer suggests, a note to the County Administrator, Philip Morley, with a
copy to John Austin, is all that is required.

yellow areas are in a no shooting zone.
Residents of Tala Shore Drive have petitioned Jefferson County to establish
a no shooting zone for the northern part of Tala Shore Drive. There is an
established no shooting zone that covers the southern part of Tala Shore
Drive that includes portions of Paradise Bay Road south.
There was an informal meeting with the County Commissioners on Monday
January 14th at the Court House in Port Townsend to discuss our petition.
While discussing the different ways of pursuing the petition, they asked the
citizens in attendance if we would be willing to contact home owners and
residents on East Ludlow Ridge Road.
They are proposing to include a larger area than was proposed by Tala Shore
residents so that they wouldn t have to go through another hearing for
future no shooting areas to be added. One of their suggestions was to
include all the way out to Tala Point on East Ludlow Ridge Road and east to
the shoreline and south to Paradise Bay road.
If anyone is interested in pursuing this for the E. Ludlow Ridge Road they
need to send a letter or email at your earliest convenience to the

Hello -
My name is Gregory Baruso and my wife Shawn and I own property on Tala Shores Drive in Port
Ludlow.
Recently is has come to our attention that presently there is gun shooting allowed in and around
the wooded area surrounding our property. My wife and I purchased our property with the idea of one
day building a getaway home for ourselves and our family. We have been owners for approximately
15 years now and if and when we build would like to enjoy the peace and quiet that the area offers to
us when we first looked in that area.
Although we have not built anything on our property, we still engage in the neighborhood events
and even have a RV that we use to enjoy our property when we come over for a night or even days.
A lot of folks there have kids and even grand kids that visit so you can imagine how difficult it is for
all of us to understand why the County would allow such incidents like gun shooting around this type
of residential setting. We too have younger children and ask that the County reconsider
allowing these types of events in happening in and around such a peaceful and quiet family
neighborhood.
I understand that folks have rights to own guns but Tala Shores is not a shooting range. I too am
an owner of guns but also have respect the for property owners in and around my area and wouldn't
even think about practicing target shooting around residential neighborhoods.
Again, please reconsider this allowance and know that this is something that is just not conducive
to the Tala Shores area and its residents. A lot of retired folks did not buy and build their retirement
homes there, as we plan to do one day, to have the peace shattered by the sound of gun shooting.
Consider this; sitting in your backyard on a beautiful summer day and then have
that tranquility broken by gun fire. Would that be something that you would like to hear?

The Tala Point Owners Association (TPOA) is strongly in favor of expanding the Port
Ludlow and Paradise Bay NO SHOOTING ZONES to include the entire Tala Point area
east to the shoreline and south to Paradise Bay Road. In a polling of our 18 owners,
13 owners expressed support of this change, with 3 opposed and 2 non - responding.
While our homes are at the tip of Tala Point, our TPOA easement access along East
Ludlow Ridge Road covers the full length of the point to Paradise Bay Road. All of us
drive along this route, and many of us walk (often with dogs) the full length of this
road and along the many trails in the adjoining woods. As such, we believe we have
standing on this issue over the full Tala Point.
Along with our Tata Shores Neighbors, the TPOA urges you to declare the entire Tala
Point north of Paradise Bay Road a NO SHOOTING ZONE.

Tale Shore Drive Shooting free Zone request
Dear Mr Morley,
We are residents at 140 Tala Shore Drive, an area we understand that is a "shooting free
zone." As residents here for over 24 years and having enjoyed walking our street with our
dogs and neighbors, we give our full support to extending the shooting free zone to the end
of the road, and down to the termination point at the beach, where there are residents. We
have many neighbors who like to walk our road because it is quiet and a wonderful and,
hopefully, safe place to exercise and enjoy our outdoors. Extending the zone would add to
the relaxation and feeling of safety to our residents and their pets. Beyond walking the
street, there is the enjoyment we derive just being outdoors in our own
yards. The possibility of a stray bullet is intimidating! For these
same reasons it would make sense to make East Ludlow Ridge Road and the area in between a
shooting free zone.

Dear Sirs,
The Suquamish Tribe appreciates the opportunity to provide the Jefferson County
Commission, on a government -to- government basis, its position on the County's proposal to
create a No Shoot Area for Tala Shore, an area just east of Port Ludlow. The Suquamish Tribe
opposes a total ban on hunting in the Tala Shore area; however, it would support limiting
hunting in the area to bow hunting and certain firearms, specifically muzzleloaders and
shotguns.
Port Ludlow is the location of pre -treaty Suquamish winter villages and continues to be
an important place for Suquamish people to exercise their treaty hunting, fishing and gathering
rights to this day. It is difficult enough under current circumstances for Suquamish hunters and
gatherers to obtain traditional foods like elk, deer and bear to meet their basic food and
medicinal needs. The Tribe understands and agrees that Indians and non - Indians alike must
conduct their hunting activities safely. The Tribe also understands and agrees that as housing
developments increase in this area, conflicts between hunters and new residents will arise.
We believe that by limiting the type of weapons allowed in hunting in this area,
Suquamish hunters will be able to obtain animals while addressing the safety concerns of
Jefferson County citizens. The Suquamish Tribe and I personally would welcome closer co-
management efforts between the Tribe and Jefferson County to maintain healthy herds and
encourage good management practices that ensure animal resources for generations to come.

Dear Mr. Morley,
I am writing in response to the proposed creation of a No Shooting Area in eastern Jefferson
County, adjacent to Port Ludlow. The Port Gamble S'Klallam Tribe has hunting and
gathering rights on all Open and Unclaimed lands. These rights are reserved for the Tribe
through Article 4 of the Treaty of Point -No- Point.
The Port Gamble S'Klallam Tribe is sensitive to public safety concerns regarding the
discharge of firearms in areas of increasing population density and acknowledges the need
to protect humans, domestic animals and private property.
The map document with your attached letter shows previously designated and new
proposed no shooting zones. It is important to note that these had previously all been
important hunting areas for the Port Gamble S'Klallam Tribe prior to increased population
densities and the creation of No Shooting Zones. Of particular concern to the Tribe is the
designation of the 80- acre DNR Tract as a no shooting zone. The Port Gamble S'Klallam
Tribe has recently entered into an agreement with DNR regarding access to gated DNR
lands for hunting and gathering. Designating these lands as a no shooting zone is an
imposition on the Tribes hunting treaty rights.
The DNR lands that are proposed for inclusion in the no shooting zone could be designated
in manner that preserves Tribal Hunting rights. They could be designated for bow hunting
only and or for elderly or youth hunts. The Tribe supports developing a management
framework that preserves hunting rights and creates the public safety and property
protections sought through creation of no shooting zone.
The Tribe would like to discuss these options with you at your convince in order to see if we
can develop a cooperative management framework that addresses Jefferson County's public
safety concerns and protects Port Gamble S'Klallam Treaty Rights.
