The following issues noted below require correction: 1) Based on the high levels observed in the septic tank an access riser shall be placed over the distribution box to allow regular observation and assessment of the drainfield. Please contact a certified installer or O&M Specialist to complete the work. 2) The documentation of current uses describes use of 2 of the spaces, G and L, as apartments. A review of the building permits approved for the property indicates that none of the buildings was approved for residential use. Application must be made for this change of use or the facilities must be converted to their approved use as storage. 3) Provide a site plan to scale with the buildings labeled. Items identified above may cause damage to, or premature failure of the onsite sewage system and/or constitute a violation of the following section of Jefferson County Code 8.15: > JCC 8.15.080(1)On-Site Sewage System Permit Required > JCC 8.15.150(1)Operations, Maintenance and Monitoring Jefferson County Public Health hereby gives you notice to correct the violations identified above within thirty days of the date of this notice by doing the following: > Hire a licensed professional as noted above to complete the required corrections; > Submit the inspection report to Jefferson County Public Health, Environmental Health Division for review to determine if additional actions are required OR submit a design for corrective actions that complies with state and local code to Jefferson County Public Health, Environmental Health Division for review, and, > If required by code, obtain a Sewage Disposal Permit from Jefferson County Public Health prepared by a licensed designer pursuant to JCC 8.15.080. > Contact this office at 360-385-9444 to inform me of the actions you are taking. This letter is intended to serve as formal notice that no further approvals shall be granted until corrections are made and approved by Health Department staff. Failure to comply with this notice and order to correct may result in the issuance of a civil infraction notice to you pursuant to section 180 of said regulations. The civil infraction notice may result in a fine of up to$513.00 per violation per day to be assessed to you. A permit is required for any repair or modification of an onsite sewage system, per Washington Administrative Code 246-272A and Jefferson County Code 8.15. A list of designers that have submitted work here is enclosed.The code sections referenced are attached for your information. • • The purpose of proper maintenance is so the County,for the benefit and protection of the public's health, is assured by this department that these systems are designed, installed and maintained in a proper manner. Please note that pursuant to JC Code 8.15.170 of the above regulations that any person aggrieved by the contents of a Notice and Order to Correct Violation issued under this regulation,or by any inspection or enforcement action conducted by Jefferson County Public Health under this regulation may request, in writing, a hearing before the Health Officer or his/her designee. Such request shall be presented to the Health Officer within 10 business days of the action appealed. Box 1400 Kingston, WA 98346-1400,herein called Lessee. Lessee hereby offers to lease from Lessor the premises situated in the City of PORT TOWNSEND, County of JEFFERSON, State of Washington, described as 234 R 3 OTTO STREET, PORT TOWNSEND, WA 98368 (and hereinafter referred to as the demised premises)upon the following TERMS and CONDITIONS: 1. Term and Rent. Lessor leases the demised premises to Lessee for a term of ONE year[s], commencing`MARCH 01, 2014, and terminating on FEBRUARY 28, 2015, or sooner as provided herein at the annual rental rate of ELEVEN THOUSAND EIGHT HUNDRED TWENTY Dollars ($11820.00) plus utilities. Payable in equal installments in advance on the first day of each month for that month's rental, during the term of this lease. All rental payments shall be made to Lessor at the address specified above. The rental amount each month will be $985.00 plus the utilities. ( see utilities below) 2. Use. Lessee shall use and occupy the demised premises for the purpose of PROCESSING LEGAL CANNABUS PRODUCTS. The demised premises shall be used for no other purpose, without the prior written consent of Lessor. Lessee shall not use the demised premises for storing, manufacturing or selling any explosives, flammables, or other inherently dangerous substances, chemicals, things, or devices. 3. Security Deposit. On execution of this lease, Lessee deposits with Lessor ONE THOUSAND Dollars ($1000.00), receipt of which is acknowledged by Lessor and deposited in escrow account in accordance with law, as security for the faithful performance by Lessee of the terms hereof, to be returned to Lessee, with NO interest on the full and faithful performance by Lessee of the provisions hereof. The deposited amount shall continue to be the property of Lessee and shall be held in trust by Lessor. 4. Care and Maintenance of Premises. Lessee acknowledges that the demised premises is in good order and repair, unless otherwise indicated herein. Lessee shall, at his own expense and at all times, maintain the demised premises in good and safe condition, including plate glass, electrical wiring, plumbing and heating installations and any other system or equipment upon the demised premises, and shall surrender the same, at termination hereof, in as good condition as received, normal wear and tear excepted. Lessee shall be responsible for all repairs required of the demised premises. Any waste or neglect of the demised premises by his/her employees or visitors which shall be the responsibility of Lessee. Lessor shall maintain in good condition such portions adjacent to the demised premises, such as sidewalks, driveways, lawns and shrubbery. Alterations. Lessee shall not, without first obtaining the written consent of Lessor, make any alterations, additions, or improvements in, to, or about the demised premises. 6. Ordinances and Statutes. Lessee shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, and which may hereafter be in force, pertaining to the demised premises, occasioned by or affecting the use thereof by Lessee. 7. Assignment and Subletting. Lessee shall not assign this lease or sublet any portion of the demised premises without prior written consent of Lessor, which shall not be unreasonably withheld. Any such assignment or subletting without the prior written consent shall be void and, at the option of Lessor, may terminate this lease. 8. Utilities. All applications and connections for necessary utility services on the demised premises shall be made in the name of Lessee only, and Lessee shall be solely liable for utility charges as they become due, including those for sewer, water, gas, electricity, and telephone services. In the event that any utility or service provided to the demised premises is not separately metered, Lessor shall pay the amount due and separately invoice Lessee for Lessee's pro rata share of the charges. Lessee shall pay such amounts within fifteen (15)days of invoice. Lessee acknowledges that the demised premises is designed to provide standard office use electrical facilities and standard office lighting. Lessee shall not use any equipment or devices that utilize excessive electrical energy, or that may, in Lessor's reasonable opinion, overload the wiring or interfere with electrical services to other tenants or lessees. 9. Entry and Inspection. Lessee shall permit Lessor or Lessor's agent(s)to enter upon the demised premises at reasonable times and upon reasonable notice, for the purpose of inspecting the same, and shall permit Lessor at any time within sixty (60) days prior to the expiration of this lease, to place upon the demised premises any usual "To Let", "For Lease" or"For Sale" signs, and permit prospective lessees or purchasers desiring to lease the same to inspect the demised premises thereafter. 10. Parking. During the term of this lease, Lessee shall have the nonexclusive use in common with Lessor, and other tenants or lessees of the building, their guests and invitees, of the non-reserved common automobile parking areas, driveways, and foot ways, subject to rules and regulations for the use thereof as prescribed from time to time by Lessor. Lessor reserves the right to designate parking areas within the building or in a reasonable proximity thereto, for Lessee and Lessee's agents and employees. Lessee shall provide Lessor with a list of all license numbers for the vehicles owned or used by Lessee, its agents and employees. Separated structured parking, if any, located about the building is reserved for Lessees of the building who rent such parking spaces. Lessee hereby leases from Lessor 0 spaces in such a structural parking area, such spaces to be on a first-come first-served basis. In consideration of the leasing to Lessee of such spaces, Lessee shall pay a monthly rental of 0 Dollars ($0.00) per space throughout the term of this lease. Possession. If Lessor is unable to deliver possession of the demised premises at the commencement hereof, Lessor shall not be liable for any damage caused thereby, nor shall this lease be void or voidable, but Lessee shall not be liable for any rent until possession is delivered. Lessee may terminate this lease if possession is not delivered within 30 days of the commencement of the term hereof. This right is only in addition to and shall not restrict any other remedy available to Lessee. 12. Indemnification of Lessor. To the extent permitted by law, Lessor shall not be liable for any damage or injury to Lessee, or any other person, or to any property, occurring on the demised premises or any part thereof. Lessee agrees to indemnify and hold Lessor harmless from any claims for damages which arise in connection with any such occurrence. Said indemnification shall include indemnity from any costs or fees which Lessor may incur in defending said claim. 13. Insurance. Lessee, at his/her expense, shall maintain plate glass and public liability insurance, including bodily injury and property damage, insuring Lessee and Lessor with minimum coverage as follows: Lessee shall provide Lessor with a Certificate of Insurance showing Lessor as additional insured. The Certificate shall provide for a ten-day written notice to Lessor in the event of cancellation or material change of coverage. To the maximum extent permitted by insurance policies which may be owned by Lessor or Lessee, Lessee and Lessor, for the benefit of each other, waive any and all rights of subrogation which might otherwise exist. If the demised premises or any other part of the building is damaged by fire or other casualty resulting from any act of negligence of Lessee or any of Lessee's agents, employees or invitees, rent shall not be diminished or abated while such damages are under repair, and Lessee shall be responsible for the costs of repair not covered by insurance. Lessor will not be required to cover any loss of Lessee's products in any and all cases and events. Lessee will provide their own "renters insurance" 14. Eminent Domain. If the demised premises, or any part thereof or any estate therein, or any other part of the building materially affecting Lessee's use of the demised premises, shall be taken by eminent domain, this lease shall terminate on the date when title vests pursuant to such taking. The rent, and any additional rent, shall be apportioned as of the termination date, and any rent paid for any period beyond that date shall be repaid to Lessee. Lessee shall not be entitled to any part of the award for such taking or any payment in lieu thereof, but Lessee may file a claim for any taking of fixtures and improvements owned by Lessee, and for moving expenses. 15. Destruction of Premises. Lessee shall give Lessor immediate notice in case of fire or other damage or casualty to the demised premises, or any part thereof. In the event of partial destruction of the demised premises during the term hereof, from any cause, Lessor shall forthwith repair the same, provided that such repairs can be made within sixty (60)days under existing governmental laws and regulations, but such partial destruction shall not terminate this lease, except that Lessee shall be entitled to a proportionate reduction of rent while such repairs are being made, based upon the extent to which the making of such repairs shall interfere with the business of Lessee on www.socrates.com Page 3 of 6 LF140-WA•Rev.03/05 • I 16. Lessor's Remedies on Default. If any default is made in the payment of rent, or any part thereof, at the times hereinbefore specified, or if any default is made in the performance of or compliance with any of the other covenants or conditions hereof, this lease, at the option of Lessor and to the extent permitted by law, shall terminate and be forfeited, and Lessor may re-enter the demised premises and remove all persons there from to the extent permitted by law. The full amount of this lease will be due and payable. 17. Tax Increase. In the event there is any increase during any year of the term of this lease in the City, County or State real estate taxes over and above the amount of such taxes assessed for the tax year during which the term of this lease commences, whether because of increased rate or valuation, Lessee shall pay to Lessor upon presentation of paid tax bills an amount equal to 50% of the increase in taxes upon the land and building in which the demised premises is situated. In the event that such taxes are assessed for a tax year extending beyond the term of the lease, the obligation of Lessee shall be proportionate to the portion of the lease term included in such year. 18. Common Area Expenses. In the event the demised premises is situated in a shopping center or in a commercial building in which there are common areas, Lessee agrees to pay his pro rata share of maintenance, taxes, and insurance for the common area. 19. Attorney's Fees. In case suit should be brought for recovery of the demised premises or for any sum due hereunder, or because of any act which may arise out of the possession of the demised premises, by either party, the prevailing party shall be entitled to all costs incurred in connection with such action, including a reasonable attorney's fee. 20. Waiver. No failure of Lessor to enforce any term hereof shall be deemed to be a waiver. 21. Notices. All notices pursuant to this agreement shall be in writing. 22. Heirs, Assigns, Successors. Provided that Lessee is not in default in the performance of this lease, Lessee shall have the option to renew the lease for an additional term of 36 months commencing at the expiration of the initial lease term. The option shall be exercised by written notice given to Lessor not less than 60 days prior to the expiration of the initial lease term. If notice is not given in the manner provided herein within the time specified, this option shall expire. All of the terms and conditions of the lease shall apply during the renewal term except that the rent may be adjusted at the option of the Lessor any time after the initial term. At no time will the annual rental amount be less than the then current rental amount. 24. Subordination. This lease is and shall be subordinated to all existing and future liens and encumbrances against the property. 25. Radon Gas Disclosure. As required by law, Lessor makes the following disclosure: "Radon Gas" is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon gas that exceed federal and state guidelines have been found in buildings in Washington. Additional information regarding radon gas and radon testing may be obtained from your county public health unit. 26. Other Disclosures (if any). Should any Public agency (County, State, Federal or any unknown or yet not created). impose a ruling upon this agreement, the Lessee and or the Lessor, that would in anyway injure the Lessor, the Lessee agrees to defend the Lessor in all capacities. 27. Entire Agreement. The foregoing and following constitutes the entire agreement between the parties and may be modified only by a writing signed by both parties. 28. Liability. Lessor shall not be liable for any loss, expense or damage to any person or property, unless it is due to Lessor's negligence. Lessee is responsible for all acts or negligence of Lessee's employees, visitors or invitees. 29. Paragraph Headings. The paragraph headings are for convenience only. 30. Choice of Law. This lease shall be governed by the laws of the State of Washington, and all disputes shall be subject to the jurisdiction of the Courts of the State of Washington. 31. Other Terms. Utilities maybe/will be paid to their provider IE: power to PUD, Cable to Wave, propane, water, sewer to Lessor as a prorated share of the building costs. Utilities vary in cost with the seasons and are not fixed. Their cost will be adjusted by the Lessor as needed, billing will follow their consumption. 32. Glen Cove Business Park is not on a Public Sewer System, the system is a private septic system, it can only handle personal waste from the human body, you may not put to that system anything that will foul or destroy the proper function of the system. Should it be determined that you, your employees, your customers or anyone else that may be associated with your business have fouled this system you will be required to fix, repair and or pay for the system. HOLD-An access riser is required over the distribution box. An inspection to verify is required prior to final approval of the building permit. 2.) The site plan as submitted with the Chage of Use/Tenant Improvement Building Permit application on March 13, 2014 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 8, 2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 3.) The intensity of sound emitted by any commercial or industrial activity shall not exceed levels estabished by the Washington State Department of Ecology under WAC 173-60, and by Jefferson County under Resolution No. 67-85, "Establishment of Environmental Designations for Noise Abatement Areas for Jefferson County." 4.) All noise emitting machinery that cannot in any other way operate below the maximum permitted noise level shall be housed in a sound-attenuating structure. 5.) All parking lots shall contain 4 parking spaces (one handicapped with signage) as designed and shown on the site plan. Parking spaces shall be constructed of all-weather materials and inspected prior to final building occupancy. 6.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 7.) Exterior lighting for commercial and industrial uses shall not exceed thirty feet(30') in height from the finished grade. Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 8.) The storage and handling of inflammable liquids, liquified petroleum, gases and explosives shall comply with rules and regulations falling under the jurisdiction of the fire marshal, the laws of the state and other local ordinances. Bulk storage of inflammable liquids below ground shall be located no closer to the property line than the greatest dimension (diameter, length, or height) of the tank. 9.)
