The area is unincorporated and surrounded by a mixture of predominantly residential use properties. To the west and north the property borders residential lots as large as 5 acres and as small as 1 acre. To the East and to the South the property borders residential lots as large 20 acres and as small as 5 acres, and directly to the South the property borders a 40 acre resource parcel. The total acreage of the project is approximately 200 acres, consisting of 9 legal parcels and 5 separate ownerships. The intent of the development is to eliminate high density zoning of seven existing rural lots, and to establish a low density development that is consistent with adjacent properties and the development patterns in the general area. The proposal includes rezoning Parcel No. 701123001 (160 acres) from commercial forestry 80 acres to rural residential 20 acres then boundary-line-adjust all parcels. The proposal includes adjusting four of the seven high density lots from their approximately 1.35 acre sizes to 5 acre parcels, and adjusting the remaining three high density lots to 20 acre parcels. The remaining acreage would consist of six additional 20 acre parcels. Currently,the high density lots are waterfront parcels on Rice Lake and include the only existing dock access to the water. A one to two acre community site around the dock access on the lake is proposed and all parcels within the development will be entitled to the dock and community site. The proposal will also include a forest management plan for the 20 acre individual parcels. Joel & Mo-chi The nine project parcels are north of Rice Lake in Quilcene. Zoning is RR1:5, 1:20, and a 160 acre Commercial Forest. The application request is to break up the 160 acres into 20 acre parcels and re-zone them to be residential; and to do boundary line adjustments with the seven lots in the RR1:5 zones to make them at least 5 acres. Stacie wants to start doing pre-apps for applications that involve rezones and eventually subdivisions. ITEM: FPA? SEPA? Cara This was a POD question. There is a slight landslide hazard on this parcel. The forester on behalf of the property owner wants to harvest 2+ acres on this parcel. Decision: He needs to talk to Ross Goodwin to determine if an FPA is required. Likely he does as this is over the two acre threshold. ITEM: Setback Reduction Request to Forest Land? Cara He is requesting that a 100' setback be reduced to 30'. Decision: Cara needs to include in her response letter that the parcel owner is going to experience inconveniences being so close to forest lands and their operations. The approval is under the existing code and is not vesting. If the code changes, the reduction may as well. If he wants a vested approval, he'll need to apply for a SPAAD. ITEM: Buoy? Cara Mobilisa has been contracted through the US Department of Defense to install a sensor buoy off the waters of Fort Flagler. Cara wants to clarify the permitting process necessary. Decision: This permit may be a shoreline exemption if it meets exemption 18.25.090 (10) or (15). The review would not the exemption under the Wireless Ordinance. ITEM: Separate Lots? Cara This parcel is on Thorndyke Road. The property owner is asking if this parcel can be considered as separate lots. The configuration used to be lots 101-107, in 1989, 104-107 were sold. Decision: Yes. The lots, although sold, are in their original configuration. ITEM: Sell Open Space? Cara There is a 15 acre common space that the property owners want to sell for future use as a subdivision. Decision: No, they will not be able to sell the parcel as it was part of the subdivision process that occurred years ago and the 15 acre piece was appears to have been created to meet density requirements of the interim large lot subdivision ordinance. Staff will tag the parcel. ITEM: Wibe Tree Removal? Cara This parcel is on Bee Mill Road. The parcel owner wrote a letter to Public Works, addressed to DCD, requesting to remove 2 trees in the county right of way and 3 trees from parcel. The tree removal is being proposed within an unstable slope stability area according to the Coastal Zone Atlas. Decision: Parcel owner needs to apply for a tree removal permit. The request and response will be forwarded to Public Works. ITEM: Alvord David Is another geotech required for this application? Decision: Stacie says that if the applicant stays within the developable area, then a geotech will not be needed as there have been 2 previous geotech reports for the plat. ITEM: Inner Harbor David This is a tree removal request that David processed. Apparently there is a wetland that is increasing in size. The increase seems to be because the culvert is plugged up. The neighbor who wants to remove the trees wants to know who is responsible for cleaning out the culvert. Decision: It is the property owner's responsibility to resolve this maintenance issue. ITEM: Becket Point Assessor's Plat Zoe An assessor's plat requires a resolution to go before the board. Should we prepare the document for this process? Decision: Per Stacie, we should go ahead and prepare this document. ADMIN 1. January 14, 2008 is the planned date for the BOCC final on the CAO. 2. AICP Exam Zoe Mo-chi, Zoe, & Stacie are trying to come up with a study group session. This will be on the second and fourth Tuesday from 2-4:00 pm starting in January. This will be open to LRP and the city planners. The first meeting will be January 8, 2008. 3. Anybody that has not taken this course should consider taking it. 4. As discussed our client is currently holding an option on several properties (7 nonconforming lots)on Rice Lake along with their ownership of 160 acres of Commercial Forest Land and 30 acres of RR 1/20. We have spent some time since the meeting contemplating the approach with the rezoning of the parcels to achieve their goal of developing the property. 1. Currently they have 160 acres in Commercial Forestry and 30 acres in RR 1/20. We would like to propose the idea of swapping the 30 acres of RR 1/20 with 30 acres of the 160 acres of commercial forestry 1/80. We would ask that the 30 acre swap be with the acreage at the north end of the 160 acre parcel as shown on the attached map. This would reconfigure the 30 acre RR 1/20 property so that it is adjacent to the small RR nonconforming parcels on Rice Lake while maintaining a reconfigured but contiguous 160 acre Commercial Forestry parcel. The question is; will an application for rezone be required to make this change or is it possible to do it administratively? (Exhibit Map 1) Vic'(Sep 2. Secondly, once the RR parcels are contiguous, is it possible to take the small non conforming lots and the 30 and do a boundary line adjustment to make a total of eight—five acre lots or does this require a rezone application? The net --' benefit in creating five acre parcels would be lower density around the lake and therefore less impact on the natural environment. We would not be increasing the total number of lots in the two zones just reallocating the number of acres per lot. As discussed our client is currently holding an option on several properties (7 nonconforming lots) on Rice Lake along with their ownership of 160 acres of Commercial Forest Land and 30 acres of RR 1/20. We have spent some time since the meeting contemplating the approach with the rezoning of the parcels to achieve their goal of developing the property. 1. Currently they have 160 acres in Commercial Forestry and 30 acres in RR 1/20. We would like to propose the idea of swapping the 30 acres of RR 1/20 with 30 acres of the 160 acres of commercial forestry 1/80. We would ask that the 30 acre swap be with the acreage at the north end of the 160 acre parcel as shown on the attached map. This would reconfigure the 30 acre RR 1/20 property so that it is adjacent to the small RR nonconforming parcels on Rice Lake while maintaining a reconfigured but contiguous 160 acre Commercial Forestry parcel. The question is; will an application for rezone be required to make this change or is it possible to do it administratively? (Exhibit Map 1) 2. Secondly, once the RR parcels are contiguous, is it possible to take the small non conforming lots and the 30 acres and do a boundary line adjustment to make a total of eight—five acre lots or does this require a rezone application? The net benefit in creating five acre parcels would be lower density around the lake and therefore less impact on the natural environment. We would not be increasing the total number of lots in the two zones just reallocating the number of acres per lot. Construction of the Sprint PCS telecommunication facilities is subject to the requirements of the County building code, Chapter 15.05 JCC, and all Building Code (UBC), the Electrical Code(NEC), the requirements of the National Electronics Industries Association/Telecommunications Industries Association (EIA/TIA) 222 Revision F Standard entitled "Structural Standards for Steel Antenna Towers and Antenna Supporting Structures"and any additional applicable standards published by the Electronics Industries Association, the Uniform Fire Code and the Jefferson County Critical Areas Ordinance. 2.) Prior to the operation of the telecommunication facilities the applicant shall document that the system has been integrated into the County's Emergency Response System as required by Section 18.42.050. 3.) Based on Section 18.42.090, Design Review Standard a-3, the applicant shall submit documentation from the FCC or FAA confirming that the tower is not required to be lit. The documentation shall be provided prior to issuance of a Certificate of Compliance. 4.) The Jefferson County Ordinance Administrator waives the required 585 feet setback from the south property line. Techniques such as additional screening, submittal and approval of the proposed color(s), reflective qualities of the paint and painting patterns are recommended for adequate mitigation, subject to Department approval. 5.) Security lighting for the equipment enclosure shall be minimized. Any newly installed security lighting shall be oriented downward and shielded so that light falls only within the boundaries of the property and shall be triggered only by a motion sensor. 6.) The applicant shall provide a security fence that is at least six feet in height surrounding the proposed tower and accessory equipment for public safety. The fence shall be installed prior to final Certificate of Occupancy from the Building Office. In lieu of installation of a security fence, the applicant shall apply for and obtain a variance from the Hearing Examiner. 7.) Existing plant materials located on and off the lease site shall be preserved to ensure that the tower and related equipment ara sufficiently concealed from ground level, adjacent properties and viewscapes. If it is not possible to achieve adequate screening by preserving existing vegetation on the site, the applicant shall lease or secure an easement for additional land to preserve existing significant vegetation or to allow the planting of additional vegetation. 8.) Noise generated by the wireless telecommunication facility shall not exceed the maximum levels estabished by the Washington State Department of Ecology under WAC 173-60, and by Jefferson County under Resolution No. 67-85, "Establishment of Environmental Designations for Noise Abatement Areas for Jefferson County"; as it is now in effect or hereafter amended. 9.) Signs, symbols, flags, banners or other devices shall not be attached to or painted or inscribed upon any tower or antenna. A telephone number and person to call for information or in the event of an emergency shall be posted at the site. 10.) The applicant shall protect the facility from unauthorized access consistent with the purpose of protecting the public health, safety and welfare. The applicant shall maintain the facility in a good and safe condition and preserve its original appearance and concealment or camouflage elements incorporated into the design at the time of approval. Maintenance shall include, but not be limited to, such items as painting, structural repair, repair of equipment and maintenance of landscaping. 11.) The type"A" land use permit for this facility shall automatically expire and become void if the applicant fails to obtain a building permit within one year of the effective date of the land use permit. The Director may extend the permit for a period of one year, provided that the applicant files a written request for extension not less than 60 days prior to the expiration that specifies good cause for the extension. If the applicant transfers, assigns, or subleases a wireless communication facility, a copy of the land use agreement and FCC license shall be submitted in writing to the Director, as well as the name and telephone number of a person responsible for the facility, who is capable of responding immediately. 13.) The applicant shall be responsible for all direct and indirect expenses incurred related to review and compliance with conditions of approval. All fees shall be as authorized by County Ordinance. 14.) In the event the wireless telecommunication facility is unused for a period of 180 consecutive days will be declared abandoned by the County. The property owner shall remove abandoned facilities within 180 days from the date of abandonment. Failure to remove an abandoned facility shall be considered a public nuisance subject to penalties. 15.) Upon written application, prior to the expiration of the 180-day period, the Director shall in writing grant a 180-day extension for reuse of the facility. Additional extensions beyond the first 180 day extension may be granted by the Director, subject to any conditions required to bring the project or facility into compliance with current law(s) and make it compatible with surrounding development. 16.) As discussed our client is currently holding an option on several properties (7 nonconforming lots) on Rice Lake along with their ownership of 160 acres of Commercial Forest Land and 30 acres of RR 1/20. We have spent some time since the meeting contemplating the approach with the rezoning of the parcels to achieve their goal of developing the property. 1. Currently they have 160 acres in Commercial Forestry and 30 acres in RR 1/20. We would like to propose the idea of swapping the 30 acres of RR 1/20 with 30 acres of the 160 acres of commercial forestry 1/80. We would ask that the 30 acre swap be with the acreage at the north end of the 160 acre parcel as shown on the attached map. This would reconfigure the 30 acre RR 1/20 property so that it is adjacent to the small RR nonconforming parcels on Rice Lake while maintaining a reconfigured but contiguous 160 acre Commercial Forestry parcel. The question is; will an application for rezone be required to make this change or is it possible to do it administratively? (Exhibit Map 1) Sous 2. Secondly, once the RR parcels are contiguous, is it possible to take the small non conforming lots and the 30 acres and do a boundary line adjustment to make a '.20 total of eight—five acre lots or does this require a rezone application? The net 4.0 benefit in creating five acre parcels would be lower density around the lake and vs-- therefore less impact on the natural environment. We would not be increasing the total number of lots in the two zones just reallocating the number of acres per lot.
