The site plan as submitted with the Zoning Conditional Use Permit application on June 12, 2014 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated August 26, 2014, or to activities or uses on-site shall be resubmitted for review and approval by Jefferson County Department of Community Development. 2. This approval is for a one acre area to be used as Public Works Maintenance and Equipment Storage Area as depicted on the approved site plan date August 26, 2014. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 3. The use of chemicals, industrial solvents, or other noxious or hazardous substances shall comply with all federal, state, and county safety, fire, structural, storage, and disposal standards. 4. On-site noise shall not exceed levels established by the Washington State Department of Ecology under Chapter 173-60 WAG. 5. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three(3)years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. 6. Extensions to the duration of the original permit approval are prohibited. 7. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. 8. The county may modify an approved conditional use permit as follows: the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s)who control the property without approval so as to significantly impact surrounding land uses. A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270, or may be process as a Type I permit approval under JCC 18.40.530(4) of this Code. 9. A conditional use permit granted under this JCC 18.40 shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. 10. The county may suspend or revoke an approved conditional use permit pursuant to JCC 18.50 of this Code only upon finding that: a. The use for which the approval was granted has been abandoned for a period of at least one(1) year; b. Approval of the permit was obtained by misrepresentation of material fact; or c. The permit is being exercised contrary to the terms of approval. 11. In appropriate circum-stances, the Administrator may require a reasonable performance or maintenance assurance device, in a form acceptable to the county prosecutor, to assure compliance with the provisions of this Code and the conditional use permit as approved. The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) This proposal requires a Type II Conditional Discretionary "C(d)"Use permit with public notice, but no public hearing, except at the discretion of the Administrator under JCC 18.15.040 Table 3-1. On August 7, 2013, the UDC Administrator determined the application would be processed as a Administrative Conditional "C(a)"Use permit under JCC 18.40.520. Recommendation: Approval with Conditions Project Planner: David Wayne Johnson,Associate Planner BACKGROUND INFORMATION: Property Owners/Applicant: Jefferson County Public Works Department,Gordon Ramstrom 623 Sheridan Street Port Townsend, WA 98368 Location: The property is located via Discovery Road or Hastings Ave West, on the east side of Cape George Road south of the intersection of Hastings Ave West and Cape George Road, East Jefferson County, Washington State. There is currently no address assigned to the property. Legal Description: Parcel Number: 001 073 008 & 007, Location: East side of Cape George just south east of the Cape George Wye Cape George Pit. Parcel(s): 001 073 307 & 001 073 008, Section 07, Township 30, Range 01W, WM. Site Conditions: The subject parcels (2) encompasses approximately 26.41 acres, of which one acre will be used as the storage/stockpile area. The site is flat and is currently abandoned as a gravel surface mine. ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 2 of 11 Some reclamation has been done to DNR specs such as grading, hydro seeding and the application of herbicide to control invasive species such as Scotch Broom, Poison Hemlock and Himalayan Blackberry. The site perimeter is vegetated with native/natural vegetation and native forest, is zoned Rural Residential and adjoins residential property of RR 1:5 and 1:10 on all sides. Access to the site is via Cape George Road by way of Hastings Ave West or Discovery Road. Comprehensive Plan Designation: The Jefferson County Comprehensive Plan designates the Subject property and surrounding properties as Rural Residential 1:10 (RR1:10). The purpose of this district is to allow for continued residential development in areas of Jefferson County consisting of relatively high density pre-existing patterns of development, along the county's coastal areas, and within areas within or adjacent to rural centers and rural crossroads. In addition,this district seeks to support and foster Jefferson County's existing rural residential landscape and character by restricting new land divisions to a base density of one unit per ten acres. DATE OF APPLICATION: A Conditional Discretionary Use Permit Application (ZON14-00017)was submitted June 12, 2014 and determined substantially complete June 30, 2014. STATE ENVIRONMENTAL POLICY ACT (SEPA): This proposal is exempt from SEPA review under 197-11-800(1)(b)(v). Though technically not fill or excavation, but store of material, the applicant does not anticipate exceeding the 500 cubic yards of stored material on-site at any one time. JEFFERSON COUNTY DEVELOPMENT APPROVALS AND PERMITS REQUIRED: • Jefferson County Unified Development Code APPLICABLE JEFFERSON COUNTY ORDINANCES: • Jefferson County Unified Development Code, adopted December 18, 2000, and effective January 16, 2001, as amended • Jefferson County Comprehensive Plan,adopted August 28, 1998, as amended NOTICE REQUIREMENTS: Public Notice was published in the Port Townsend-Jefferson County Leader newspaper: • Notice of Type II Application: July 2, 2014. Notice was posted on the property by the applicant/representative: • Affidavit of Posting for Notice of Type II Application: July 2, 2014. The applicant, the owner of subject property and property owners within 300 feet were notified by mail: • Notice of Type II Application: July 1, 2014. COMMENT: Public Response: No written comments were received from adjacent property owner,or general public. Agency Response: No agency written comments were received. ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 3 of 11 PROPOSED FINDINGS AND CONCLUSIONS: This section constitutes staff's findings and conclusions regarding the applicant's consistency with the Jefferson County Comprehensive Plan and the Jefferson County Unified Development Code. 1. Parcel numbers 001 073 307 & 001 073 008, Section 07, Township 30, Range 01W, WM, located on Cape George Road south of intersection of Hastings Ave West and Cape George Road. 2. The current property owner is Jefferson County. 3. The site is zoned Rural Residential 1:10. 4. The site is designated as a Mineral Resource Land Overlay. 5. The site is currently an abandoned defunct surface mine. 6. A pre-application conference was held on March 11, 2014. 7. The pre-application conference determined that a Type II Conditional Discretionary Use permit would be required to convert the property to a Public Works Maintenance and Equipment Storage Area under JCC 18.15.040 Table 3-1, in the Rural Residential zone. 8. This proposal is an application for a Type II Conditional Discretionary Use Permit (MLA14- 00042/ZON14-00017)to establish a Public Works Maintenance and Equipment Storage Area. 9. As part of the Conditional Discretionary Use permit process under JCC 18.40.520, the UDC Administrator determined that the proposal shall be processed as a Conditional Administrative Use permit. 10. Staff conducted a site visit on August 6, 2014. 11. No building or other permits are required or anticipated as part of this project. 12. No water or septic required since no personnel will be manning the site. 13. Some reclamation has been done to DNR specs such as grading, hydro seeding and the application of herbicide to control invasive species such as Scotch Broom, Poison Hemlock and Himalayan Blackberry. 14. The proposal shall comply with the Conditional Use Criteria under JCC 18.40.530. 15. Jefferson County Comprehensive Plan: The proposal is subject to the goals and policies of the Jefferson County Comprehensive Plan. The following Plan goals and policies apply to the proposal: Public Purpose Land Use Policies: LNP16.2 Whenever practical, site essential public facilities, such as airports, large-scale transportation facilities, state educational facilities,correctional facilities, solid waste treatment facilities, substance abuse facilities,mental health facilities and group homes, so as to avoid potential adverse impacts to surrounding land uses and critical areas. ZON13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 4 of 11 Essential Public Facilities Policies: EPP 1.8 Ensure that new essential public facilities or the expansion of existing essential public facilities sited outside of Urban Growth Areas are self supporting and do not require the extension or construction of urban services and facilities unless no practicable alternative exists. 16. Jefferson County Unified Development Code: The proposal is subject to review to determine consistency with the Jefferson County Unified Development Code. JCC 18.40.530 - Approval Criteria for All Conditional Uses is discussed below. (1) The conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity of the subject property and with the physical characteristics of the subject property; Staff Comment: The site is an abandoned mining site on County owned property and has been in existence since the current zoning took effect in 1998, and used as a storage area since the mine was abandoned many years prior. The site is adequately sized to accommodate, and will not expand the scale of the development, which will not exceed one acre,or 500 cubic yards of material at any one time. The proposal is consistent with this criterion. (2) The conditional use will be served by adequate infrastructure including roads,fire protection, water, wastewater disposal, and storm water control; Staff Comment: No expansion of services is required. No water, septic, buildings or fire protection is required. Stormwater will be fully dispersed into the surrounding native landscape. The proposal is consistent with this criterion. (3) The conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel; Staff Comment: As state above in(1),the scale of development will not expand the abandoned mining area and will be contained and screened from uses or property in the vicinity on one acre of a twenty one acre site. No comments of concern were received from the adjacent property owners. The proposal is consistent with this criterion. (4) The conditional use will not introduce noise, smoke, dust,fumes, vibrations, odors, or other conditions or which unreasonably impact existing uses in the vicinity of the subject parcel; Staff Comment: Except for minor temporary noise or exhaust from heavy equipment to deposit or remove the materials on a periodic basis, ongoing impacts are not anticipated and will not unreasonably impact existing uses in the vicinity of the subject parcel. The proposal is consistent with this criterion. (5) The location, size, and height of buildings, structures, walls and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties; Staff Comment: No buildings, structures,walls,fences or additional screening are required or proposed. The proposed use is screened from view by native vegetation from surrounding properties and will not unreasonably interfere with the allowable development or use of neighboring properties. The proposal is consistent with this criterion. ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 5 of 11 (6) The pedestrian and vehicular traffic associated with the conditional use will not be hazardous to existing and anticipated traffic in the vicinity of the subject parcel; Staff Comment: No pedestrian traffic is associated with this proposal,and although vehicular traffic will utilize the site, it will be on-site and not increase,nor be of a scale that will be hazardous to existing and anticipated traffic in the vicinity of the subject parcel. The proposal is consistent with this criterion. (7) The conditional use complies with all other applicable criteria and standards of this Code and any other applicable local, state or federal law; and more specifically, conforms to the standards contained in Chapters 18.20 and 18.30 JCC; Applicable UDC code sections include: JCC 18.20.220 Industrial Uses—Standards for site development(1): (a) The use of chemicals, industrial solvents, or other noxious or hazardous substances shall comply with all federal, state, and county safety,fire, structural, storage, and disposal standards. Staff Comment: No hazardous substances are proposed. The proposal meets this standard as a condition of approval. JCC 18.20.220 Industrial Uses—Standards for site development(1): (b) Water supplies, wastewater, and sewage disposal facilities adequate to serve the proposed use shall be provided. Industrial wastewaters shall not be discharged into an on-site septic system and are subject to waste discharge permit requirements established by the water quality program of the Washington Department of Ecology. Staff Comment: Not applicable to this proposal—only sand and gravel storage on site,not septic or water required. JCC 18.20.220 Industrial Uses—Standards for site development(1): (c)Retail sales and services incidental to a principally permitted use are allowable,provided: (i) The operations are contained within the main structure which houses the primary use; (ii)Retail sales occupy no more than 15 percent of the total building square footage; (iii)No retail sales or display of merchandise occurs outside the structure; and (iv)All products offered for retail sales on the site are manufactured, warehoused, or assembled on the premises (except for products sold at colleges or technical schools). Staff Comment: Not applicable to this proposal—no retail sales proposed or anticipated. JCC 18.20.220 Industrial Uses—Standards for site development(1): (d)No use shall be made of equipment or material which produces unreasonable vibration, noise, dust, smoke, heat, glare, odor, or electrical interference to the detriment of the quiet use and enjoyment of adjoining property. Staff Comment: The proposal meets this standard since only occasional deposits and loadings or sand and gravel will generate some of the listed effects which would not be considered unreasonable. ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 6of11 JCC 18.20.220 Industrial Uses—Standards for site development(1): (e) Use of a county access road or private road for access to new industrial development shall be permitted only if the applicant demonstrates that public health, safety and welfare will be protected, and if traffic and maintenance impacts to the private road are minimized by conditions on the permit. Staff Comment: Traffic to the site will be minimal—only an average of two trips a month will be made to deposit or load sand and gravel. JCC 18.20.220 Industrial Uses—Standards for site development(1): (f)Development standards, including parking, visual screening and landscaping requirements, shall be as specified in Chapter 1.&30 JCC, Development Standards,for rural industrial uses and as specified in Chapter 18.18 JCC(Irondale and Port Hadlock UGA Implementing Regulations)for urban industrial uses, except as otherwise provided for in this chapter. Staff Comment: See section on JCC 18.30 below. JCC 18.20.220 Industrial Uses—Standards for site development(2): Light Industrial Uses— Additional Standards. All operations other than loading and unloading shall be conducted within a fully enclosed building, except for concrete batch plants located in an urban district subject to the requirements of this chapter. Staff Comment: Only loading and unloading are proposed. JCC 18.20.280 Outdoor Storage Yards(1):All outdoor storage for vehicles, equipment, materials or products used in production,for sale on premises, awaiting shipment, or otherwise in conjunction with commercial or industrial use, shall be conducted so as to ensure public safety, health, and welfare and to minimize detrimental visual impact upon neighboring property and public rights-of-way. Staff Comment: As per the approved site plan,the stockpile area is centrally located on parcel 001 073 007, accessed by adjacent parcel 001 073 008, also owned and controlled by Jefferson County Public Works, and has in excess of 300+feet of native vegetative screening to buffer visual impacts to neighboring parcels and rights-of-way. JCC 18.20.280 Outdoor Storage Yards(2): Every reasonable effort shall be made by persons operating a commercial or industrial business to store vehicles, equipment, materials and products within an enclosed building, except: (a) Where such enclosed storage is not practical or desirable for reasons related to health, fire or safety requirements; (b) Where outside storage of merchandise, manufactured products, or raw materials is normal and standard practice, such as in the sale of automotive equipment,farm machinery, lumber, gardening materials, nursery stock, manufactured homes, and similar products, or on the site of construction projects; or (c) When materials or products are temporarily stored outside incidental to shipping, delivery, loading or unloading thereof Staff Comment: (b)and (c) apply to this proposal. ZON13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 7 of 11 JCC 18.20.280 Outdoor Storage Yards(3): Materials and products may be stored outside subject to the provisions of these performance standards and applicable development standards, but shall comply with the landscaping and screening requirements of JCC 18.30.130, as applicable. Staff Comment: The proposal is consistent with this standard as stated above and under 18.30.130 as discussed below. JCC 18.30 Development Standards: • 18.30.020 General development standards Staff Comment: No buildings will be erected on site,are proposed or anticipated. Transportation to and from the site are adequate and traffic generated is minimal. • 18.30.030 Water supplies Staff Comment: No water supply is required since the site will not be occupied by personnel or further developed. • 18.30.040 Sewage disposal Staff Comment: No sewage disposal is required since the site will not be occupied by personnel or further developed. • 18.30.050 Density, dimension and open space standards Staff Comment: No further development of site will take place beyond the storage of sand and gravel and therefore no bulk and dimensional development standards are required. • 18.30.060 Grading and excavation standards Staff Comment: Minimal grading has occurred, as well as hydro seeding(BMPs)and application of herbicides to control invasive vegetation under the specifications and as part of DNR reclamation requirements. No further excavation will take place. • 18.30.070 Stormwater management standards Staff Comment: No impervious surfaces or further land disturbing activities are proposed or anticipated. All stormwater will disperse per BMP T5.30. • 18.30.080 Roads Staff Comment: Access roads are existing. No new roads are proposed or anticipated. • 18.30.090 Pedestrian circulation Staff Comment: No pedestrian circulation required. • 18.30.100 Parking ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 8 of 11 Staff Comment: No parking required since no employees or general public will be on-site except to load and unload sand and gravel. • 18.30.110 Off street loading space requirements Staff Comment: Not applicable since there will be no buildings on-site and loading areas are in excess of 300 feet from residential areas. • 18.30.120 Landscaping/Screening Staff Comment: The proposal meets this standard under(2)General Provisions,which states, "(a)Existing trees, vegetative plantings, undisturbed open space, and/or topographic or natural features which meet or exceed these standards shall be considered to fulfill the landscaping or screening requirements of this section and any other applicable reference to these screening requirements in other sections of this code. " • 18.30.130 Lighting Staff Comment: No lighting required or proposed. • 18.30.140 Signs Staff Comment: No signs required or proposed. • 18.30.160 Archaeological and historic resources Staff Comment: No known archaeological or historic data or evidence on-site. No further excavation of site is proposed or permitted. • 18.30.170 Mining Staff Comment: No mining is proposed or permitted. • 18.30.180 On-site Sewage Disposal Staff Comment: No on-site septic system required or proposed • 18.30.190 Noise Staff Comment: On-site noise shall not exceed levels established by the Washington State Department of Ecology under Chapter 173-60 WAC. The proposal meets this standard as a condition of approval. (8) The proposed conditional use will not result in the siting of an incompatible use adjacent to an airport or airfield; Staff Comment: The parcel is not located in the vicinity of an airport or airfield. The proposal is consistent with this criterion. ZON 13-00019 Public Works Department—Cape George Pit Conditional"C(a)"Use Permit Application 9/9/2014 Page 9 of 11 (9) The conditional use will not cause significant adverse impacts on the human or natural environments that cannot be mitigated through conditions of approval; Staff Comment: No adverse impacts to the human or natural environments have been identified or are anticipated with the use the site as a sand and gravel storage area. The proposal is consistent with this criterion. (10) The conditional use has merit and value for the community as a whole; Staff Comment: The existing and proposed road maintenance and equipment storage area serves the needs of the community by providing a place to store road maintenance material essential to the upkeep of Jefferson County roads. The proposal is consistent with this criterion. (11) The conditional use is consistent with all relevant goals and policies of the Jefferson County Comprehensive Plan; Staff Comment: As stated above in#15 the proposal is consistent with all relevant goals and policies of the Jefferson County Comprehensive Plan. The proposal is consistent with this criterion. (12) The public interest suffers no substantial detrimental effect. Consideration shall be given to the cumulative effect of similar actions in the area; Staff Comment: Staff has not identified any potential or substantial detrimental effects that would result from this proposal. In fact,the proposed development is an improvement over the current abandoned use. Similar actions in the area would require consistency with the performance standards identified under the UDC and would be subject to the applicable review process. The cumulative effect of such actions would not pose a substantial detrimental effect to the public interest, as each application would be subject to individual review. The proposal is consistent with this criterion. JCC 18.40.540, Additional Conditions states, "The County may impose additional conditions on a particular use if it is deemed necessary for the protection of the surrounding properties, the neighborhood, or the general welfare of the public." Staff Comment: No unmitigated adverse impacts have been identified, and no additional conditions have been deemed necessary for this proposal. The proposal is consistent with this criterion. JCC 18.40.550, Use of Property Before Final Decision states, "No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. " Staff Comment: As conditioned,the proposal is consistent with this criterion. JCC 18.40.560,Effective Period—Expiration states the following: a. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3)years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. b. Extensions to the duration of the original permit approval are prohibited. c. The Department of Community Development shall not be responsible for noting the applicant of an impending expiration. Staff Comment: As conditioned,the proposal is consistent with this criterion. " Staff Comment: As conditioned, the proposal is consistent with this criterion. STAFF RECOMMENDATION: Based on the preceding findings and conclusions, staff recommends finding that the proposal is consistent with the applicable plans and ordinances and that it meets the Conditional Use review criteria. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3)years of the effective date (the date of the decision granting the permit)of the permit unless the permit approval provides for a greater period of time. 6. Extensions to the duration of the original permit approval are prohibited. 7. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. 8. The county may modify an approved conditional use permit as follows: the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s) who control the property without approval so as to significantly impact surrounding land uses. A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270, or may be process as a Type I permit approval under JCC 18.40.530(4)of this Code. 9. A conditional use permit granted under this JCC 18.40 shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. 10. The county may suspend or revoke an approved conditional use permit pursuant to JCC 18.50 of this Code only upon finding that: a. The use for which the approval was granted has been abandoned for a period of at least one (1)year; b. Approval of the permit was obtained by misrepresentation of material fact; or c. The permit is being exercised contrary to the terms of approval. 11. Stormwater Disposal Policy Along Marine Shorelines Pursuant to UDC section 3.6.5(c)(3) all new development activity, including single-family residential construction, located on Marrowstone Island, Indian Island and within 500 feet of any marine shoreline is required to infiltrate stormwater runoff on-site, to the maximum extent practicable. This provision is intended to prevent seawater from intruding into underground aquifers, reduce non-point source pollution to marine waters, and reduce the potential for shoreline erosion due to tightline failure. This provision is interpreted as establishing a hierarchy in which the first and best alternative is on-site infiltration using drywells or other methods, the second best alternative is upland off-site disposal, and the least preferred alternative is direct discharge into marine waters through a stormwater tightline. In order to utilize the least preferred alternative (a stormwater tightline discharging directly into marine waters) applicants must demonstrate through a geotechnical or similar report prepared by a licensed professional that both on-site infiltration and upland off-site disposal are not practicable or feasible. The report must include cost figures for comparison.
