SUBIECT: Agenda Item — Interlocal Agreement with Jefferson Healthcare, Port
Townsend School District, and Chimacurn School District for School
Based Health Center; September 1, 2014 — June 30, 20j% with all
services beginning and ending in the coincident school year.
STATEMENT OF ISSUE:
Jefferson County Public Health, Community Health, is requesting Board approval of the Interloclal Agreement
between Jefferson Healthcare, Port Townsend School District, and nd Chimacurn School District for
School Based Health Center; September 1, 2014 —,June 30, 20 -
A : GOALSLPRO'S and CON'S:
Jefferson Healthcare (JHC) and JCPH partner to provide clinical services in Port Townsend and Chimacurn
School Districts. The schools provide clinic space, IT, and custodial care; JHC and JCPH provide clinical
services in the high schools. The two School Boards, Student Body associations, and two advisory groups
have been supportive of this service arrangement and have volunteered hours of work to make this happen.
Studies have noted the challenges in providing needed healthcare services for adolescents. This partnership
will increase access to care for school-aged youth. The adolescent population is the least likely to access
needed mental, behavioral, oral and physical health care. Without preventive services, many health
conditions afflicting youth have developed into health care crises, resulting in not only high fiscal costs, but
also long term negative health outcomes.

Consent Auenda
School Based Health Centers (SBHQ are an effective model to provide access to preventive services and
health care for this population. Extensive research has demonstrated that school-based health centers
improve health status, and promote the health and well-being of school-age youth. Although the primary
goal of SBHC is to provide healthcare that is readily accessible to youth, there are a number of other
benefits from SBHCs, which include:
• Increased general access to care for students
• Increased access to mental health services
Increases participation in sports and other school based activities
Improved contraception use
Decreased use of acute services including emergency room visits
Decreased costs associated with asthma, diabetes and other chronic diseases
Reduction in overall healthcare costs
Reduction in teen pregnancies
Reduced high school drop-out rates
The school-based health center allows students to access care conveniently at their high school, which
facilitates a relationship' etween the health care provider and the student.
FIS ENEFIT ANALYSIS:
Clinic bills private insurance and Medicaid to cover the cost of staff time.

Interlocal Agreement
Between
Jefferson County Public Health, Jefferson Healthcare,
Chimacum School District #49 and Port Townsend School District #50
For School-Based Health Centers
This Memorandum of Understanding ("MOU") is designed to formalize the relationship between
Jefferson County Public Health ("JCPH"), Jefferson Healthcare ("W"), Chimacum School
District 449 ("CSD"), and Port Townsend School District 450 (PTSD"), regarding the operation
of a School-Based Health Center ("SBHC"). The conditions of this MOU are consistent with
RCW 39.34,
The parties have a Governance Board for the Jefferson School-Based Health Centers to provide
policy guidance. The Governance Board Members share the responsibility for the ongoing
planning of the SBHC- The parties agree to collaborate on the implementation and operation of
the SBHC,'-rhe Governance Board membership is Jefferson Healthcare CEO or designee,
Chimacurn School District Superintendent or designee, Port Townsend School District or
designee, and Jefferson County Public Health Director or designee.
Another committee called the "Advisory committee" meets regularly throughout the school year.
It consists of both school principals, clinic staff, counselors, parents, school board members,
students, and the public. This committee provides community leadership, volunteer hours,
overview of education materials, and identification of school needs.
Confidentiality: All parties to this Agreement and their employees or representatives and their
subcontractors and their employees will maintain the confidentiality of any Student Health
information. All Medical or Mental Health services are protected as required by HIPPA and
other privacy laws.
This Agreement, once executed by the parties, is and remains a Public Record and is therefore
subject to the provision of"Ch. 42.56 RCW, the Public Records Act.
School-Based Health Center 2014
Terms of Agreement
Jefferson County Public Health will:
1. Director or designee serves on the Governance Board with the four partners.
2. Assign consistent Nurse Practitioner (ARNP) to each site, providing appropriate medical
training, supervision, and malpractice/liability for County staff.
3. Provide the following scope of services for students: age appropriate primary care;
reproductive health care, including sexually transmitted infections; mental health and
substance abuse screening and referral, and coordination and referral with other medical
providers. Health education to reduce risky behaviors is in all services.
4. Provide service summary of the SBHCs to Boards of Health, Jefferson Healthcare or
School Boards as required.
5. Provide healthcare equipment and supplies for use in SBHC, equipment shall remain the
property of the County.
6. Provide maintenance of medical records per HIPAA, state and federal requirements.
Provide electronic medical recording system and encryption.
7. Provide medical oversight and guidance by JCPH Health Officer
8. Provide billing for services.
9. Provide Medical Assistant or clerical support to both clinics during ARNP hours.
10. In Advisory Committee, work with JHC, JCPH, PTSD and CSD to review health status
and school health needs and work with schools to adjust the scope of services accordingly
13, JCPH will subcontract for mental health services in the SBHC and deliverables. Funding
is from the Jefferson County Hargrove treatment funds. Request for Proposals and
contracting is done in separate agreements with MH agencies.
2. Jefferson Healthcare will:
1. Director or designee serves on the Governance Board with the four partners.
2. Provide for a consistent Nurse Practitioner (ARNP), either through contract or
employment, for services in each school. Employer is responsible for providing
appropriate medical training, supervision., and malpractice/liability for its staff.
3. Provide the following scope of services for students: age appropriate primary care;

7. In Advisory committee, work with RIC, JCPH, PTSD and CSI to review health status
and school health needs and work with schools to adjust the scope of services
accordingly.
3. port Townsend School District will:
I . Superintendent or designee serves on governance board with the four partners. Building
principal attends and partners with the advisory board.
2. Actively promote and integrate SBHCs into school settings. The building principal or
her/his designee acts as liaison between school and SBHC personnel.
3, Provide space and facilities support for SBHC.
4. provide for all utilities, routine maintenance, repairs, and custodial services.
5. Provide for distribution of SBHC enrollment/consent of services forms into school
education forms requiring parental review and signature. Invite SBHC staff to parent
nights and school events.
6. Internet access.
4. Chintacum School District will:
I. Superintendent or designee serves on governance board with the four partners. Building
principal attends and partners with the advisory board.
2. Actively promote and integrate Sl3HCs into school settings. The building principal or
her/his designee acts as liaison between school and SBHC personnel.
3. Provide space and facilities support for SBI-ICs.
4, Provide for all utilities, routine maintenance, repairs, and custodial services.
5, Provide For distribution of SBHC enrollment/consent of services forms into school
education forms requiring parental review and signature, Invite S1311C staff to parent
nights and school events.
6. Internet access.
5. The parties agree to work cooperatively to maximize staff support and enrollment in the
SBHC to increase students' access to primary healthcare:
a) Information received at the SBHC will be kept confidential accordance with applicable
healthcare information and federal privacy laws. (HIPPA)
b) A signed parental consent form is required before a student can receive medical
primary health care. Confidential health care is exempted from the parental

authorization if the student so requests. Mental Health and Family Planning services
can be provided without parental consent according RCW 9,02,100(2) and RCW
7134.530,
Ic) JCPH will make available sample materials to provide parents with accurate
information about confidentiality, insurance enrollment, services, and appropriate
consent options about school-based health services.
6. All services provided will start and end with current the school year. Services will not be
provided during the summer. This agreement continues unless terminated by a party to this
Agreement pursuant to Section 7 below, Unless otherwise modified by written agreement of
all the parties, this Agreement shall terminate on June 30, 2019 or the end of the 2018-2019
school year, whichever date is earlier.
7. Any party may terminate this Agreement for any reason upon at least sixty (60) days written
notice, such notice to termination shall not be effective until completion of said semester,
Either party may also terminate this Agreement at any time if the other party/parties default in
any of its material obligations hereunder, but only if such defaults shall have continued for a
period often (10) days after the receipt of a written notice thereof from the other party/parties.
Upon termination of the Agreement, JCPH and JHC will make a good-faith effort to refer
students who are receiving services to an alternative healthcare provider.
8. This Agreement may be amended by mutual written consent by parties.
9. Nothing herein shall create or be deemed to create any relationship of agency, joint venture or
partnership between parties to this Agreement. Neither shall any party have the power to bind
or obligate the other in any manner except as expressly provided in this Agreement.
10, Any waiver, express or implied, by any party of any rights, terms or conditions of the
Agreement shall not operate to waive such right, terms or conditions or any other rights,
terms, or conditions beyond the specific instance of waiver.
I I . No party shall discriminate or permit discrimination against any person or group of persons
on the basis of race, color, creed, national origin, age, gender, sexual orientation, religion,
material status, or qualified individuals with disabilities. All parties shall comply with the
Americans with Disabilities Act and all regulations interpreting or enforcing such Act.
12, The parties shall separately maintain their own appropriate liability and casualty insurance
policies as they, in their sole discretion, deem appropriate. The parties further agree that no
indemnification shall be provided for except for specifically set forth below and that the
respective liability of the parties to each other and to third persons shall be determined in
accordance with the laws of the State of Washington.
13, The parties to this Agreement shall indemnify, defend and hold harmless the County,
Jefferson Healthcare, Chimacum School District, Port Townsend School District, its officers,
agents and employees, from and against any and all claims, lawsuits, demands for money
damages, losses or liability, or any portion thereof, including attorney's fees and costs, arising

from any injury to person or persons (including the death or injury of any party to this
Agreement or damage to personal property) if said injury or damage was caused by the
negligent acts or omissions of the signing party. In the event of concurrent liability, the
parties shall have the right of contribution in proportion to the respective liability of each
party. Nothing contained in this section shall be deemed to waive immunities established
pursuant to state statute or to create third-party right or immunities.
14. The parties to this contract shall obtain and keep in force during the terms of the
AGREEMENT or as otherwise required the following insurance with companies or through
sources, e.g., Risk Pools, approved by the State Insurance Commissioner pursuant to Ch.
48.05 RCW:
a) Worker's compensation and employer's liability insurance as required by the State of
Washington.
b) commercial Automobile Liability Insurance providing bodily injury and property
damage liability coverage for all owned and non-owned vehicles assigned to or used
in the performance of the work for a combined single limit of not less than
$ 1,o00,000 each occurrence with the COUNTY named as an additional insured in
connection with the SUBCONTRACTOR'S performance of the contract.
c) General Commercial Liability Insurance in an amount not less than a single limit of
one million dollars ($1,000,000.00) per occurrence and a aggregate of not less than
two (2) times the occurrence amount ($2,000,000.00 minimum) for bodily injury,
including death and property damage, unless a greater amount is specified in the
contract specifications. The insurance coverage shall contain no limitations on the
scope of the protection provided and include the following minimum coverage:
1) Broad Form Property Damage, with no employee exclusion;
2) Personal Injury Liability, including extended bodily injury;
3) Broad Form Contractual/Commercial Liability - including completed
operations
4) Premises - Operations Liability (M&C);
5) Independent;
6) Blanket Contractual Liability.
15, All employees or parties to this agreement who are required to be professionally licensed or
certified by the State in the performance of services under this agreement shall maintain
professional liability insurance in the amount of not less than one million dollars
($1,000,000), In no case shall such professional liability to third parties be limited in any
way.
16, It shall be the responsibility of all parties to this agreement to insure that any and all persons
engaged in the performance of any work or service required under this Agreement, shall
comply with the same insurance requirements.
17. All cost for insurance shall be considered incidental to and included in the unit contract
prices and no additional payment will be made.

All insurance shall be obtained from an insurance company authorized to do business in the
State of Washington. The parties to this agreement shall submit a verification of insurance as
outlined herein within 14 days of the execution of this Agreement to the COUNTY.
19.1 his Agreement does not contemplate the joint acquisition of property by the parties. At
termination, each party will remain the sole owner of its own property.
20. This Agreement together with attachments or addenda represents the entire and integrated
agreement between the County and the said parties and supersedes all prior negotiations,
representations, or agreements written or oral between the parties. This agreement may be
amended only by written instrument signed by both County and parties.
