The project shall adhere to the Best Management Practices (BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 2.) The illumination of signs shall be shaded, shielded, or directed so as not to adversely affect surrounding properties or public and private rights-of-way or create a hazard or nuisance to the traveling public, or to surrounding properties. 3.) No sign or part thereof shall consist of rotating, revolving, or moving parts; consist of banners, streamers, or spinners; or involve flashing, blinking, or alternating lights. 4.) All signs shall be continuously maintained. Signs that present a hazard shall be subject to abatement. 5.) Signs shall be incorporated into the landscaping of the site when landscaping is provided. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on August 28, 2014 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Suburban Shoreline Designation; Intermediate Shoreline Slope Stability; Osprey Habitat; Coastal SIPZ. 3.) Underlying zoning on-site is Rural Residential which limits sign square footage to 32 feet. The site is being re-developed under an existing Binding Site Plan as a commercial Marina. Also, the parcel has recieved a Comp Plan Amentment zoning designation of Master Planner Resort under Ordinance 01-0128-08. It is anticipated that a development agreement with regulations for signage will be approved to allow the proposed 54 square feet of signage. The proposed signs meet all other development criteria under JCC 18.30.100 Signs 4.) See stormwater permit ZON14-00024 for widening of the Marina entrance to address stormwater and to allow for placement of the proposed signs. 5.) The site plan as submitted with the Zoning Permit application on July 15, 2014 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated August 28, 2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 6.) This approval is for Two Entrance Signs totally 54 Square Feet only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 7.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term"take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service(http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. 8.) The proposed signs were reviewed and approved under RCW 47.42 &WAC 468-66 by Pat O'Leary with the WSDOT Highway Advertising Control Program. 9.) See BLD14-00246 for the building permit for the proposed signs. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. No sign shall hereafter be erected or used for any purpose or in any manner except as permitted by the regulations of this section or as specified elsewhere in this code.All signs subject to this section shall be subject to approval and issuance of a sign permit by the administrator according to a Type I permit approval process as specified in Chapter 18.40 JCC.The administrator may waive certain requirements of this section or require additional conditions for any sign permit,if deemed necessary to maintain consistency with the Comprehensive Plan. (1) Prohibited Signs.The following signs are prohibited: (a) Abandoned signs; (b) Billboards; (c) Flashing,revolving or moving signs,excepting clocks; (d) Off-site signs which advertise a business; (e) Signs or sign structures,which by coloring,shape,working,or location resemble or conflict with traffic-control signs or devices; (f) Signs which create a safety hazard for pedestrians or vehicular traffic;and (g) Signs attached to utility poles or traffic signs. (2) Exemptions.The following signs are exempt from the provisions of this section: (a) Traffic and standardized public signs installed by a government entity; (b) Window and merchandise displays,point of purchase advertising displays such as product dispensers and barber poles; (c) National flags,flags of a political subdivision,and symbolic flags of an institution or business; (d) Legal notices required by law; (e) Historic site plaques and markers and gravestones; (f) Personal signs on private property displaying personal messages such as"yard sale"or"no trespassing" or political messages not to exceed eight square feet; (g) Structures intended for separate use,such as recycling containers and phone booths; (h) Real estate signs;and (i) Lettering painted on or magnetically flush-mounted onto a motor vehicle operating in the normal course of business. (3) Design Standards.All signs must meet the following standards: (a) The following standards apply to the illumination and illustration of signs: (i) The illumination of signs shall be shaded,shielded,or directed so the light intensity or brightness shall not adversely affect surrounding properties or public and private rights-of-way or create a hazard or nuisance to the traveling public,or to surrounding properties. (ii) No sign or part thereof shall consist of rotating,revolving,or moving parts;consist of banners,streamers,or spinners;or involve flashing,blinking,or alternating lights.An exception to this standard is temporary signs associated with local festivals,fairs,parades,or special events pursuant to subsection(4)(a)of this section. (b) Sign size shall be regulated as follows: (i) The total square footage of signs shall not exceed 64 square feet for any business within any commercial or industrial land use district.Multitenant developments may have one freestanding sign for each access point,commonly identifying the businesses within multitenant developments provided such signs total no more than 64 square feet in aggregate.The maximum aggregate size for projection signs placed on a building is limited to one percent of the floor areas of the building,except that each occupant is allowed a sign of at least two square feet.In no case may an individual occupant's sign be larger than 15 square feet. (ii) The square footage of signs shall be calculated by the outside dimensions necessary to frame the information displayed.No sign mounted on a building shall extend above or beyond the eave,rake,or parapet of the wall on which it is mounted.Any sign projecting beyond six inches from a perpendicular wall shall be at least seven feet above grade. (iii) Directional,identification or advertising signs for any use located in any rural residential district shall not exceed 32 square feet,with the exception of institutional use signs,which shall not exceed 64 square feet. (c) Uses located in any rural commercial or industrial land use districts shall have no more than two on-premises signs,except as allowed in this section for multitenant developments. (d) Signs attached to or painted against the structure to which it relates shall be computed as a part of the overall total square footage,or number of signs allowed. (e) All signs shall be continuously maintained. Signs that present a public hazard as determined by the Jefferson County building official or department of public works shall be subject to abatement. (f) The design of freestanding signs shall include measures to restrict vehicles from passing beneath them,unless otherwise permitted by the Jefferson County department of public works.All freestanding pole signs or projecting signs shall provide pedestrian clearance to a minimum of eight feet,where applicable. (g) Signs should be incorporated into the landscaping of the site when landscaping is provided. (h) No signs,other than those related to water dependent uses,such as a marina,are permitted to face seaward,excepting signs relating to safety concerns,such as cable-crossing,construction-dredging,fuel area,etc. (i) No sign shall be placed in the public right-of-way or in the vision clearance triangle of intersections and curb cuts,unless otherwise approved by the Jefferson County department of public works. (4) Specialty Signs. Specialty signs may be established when consistent with the standards set forth below: (a) Signs and banners promoting public festivals,community or special events,and grand openings may be displayed up to 30 days prior to the event,and shall be removed no later than seven days after the event.The sponsoring entity is responsible for sign removal.Event signs may be located"off-site." (b) Signs which identify a recognized community or unincorporated place are permitted at each entrance to the community. Said signs are limited to one per entrance,and may not exceed 64 square feet or eight feet in height. Signs relating to clubs,societies,orders,fraternities and the like shall be permitted as part of the community sign. (c) Businesses may erect temporary on-site sandwich board signs subject to the following criteria: (i) No more than two sandwich board signs may be erected per business; (ii) Sandwich board signs shall not exceed four feet in height or three feet in width; (iii) Sandwich board signs shall be displayed during business hours only; (iv) Sandwich board signs shall not be placed on sidewalks;and (v) Sandwich board signs shall not be placed in public road rights-of-way unless approved by the Jefferson County department of public works. (d) Off-site signs may only be allowed when they meet all of the following standards: (i) Are directional in nature; (ii) Located on private property along a major or minor arterial; (iii) Located no more than 600 feet from an intersection;and (iv) No larger than 12 square feet. (5) Nonconforming Signs.Legally established signs in place prior to the adoption of these standards and not in conformance with these standards shall be considered legal,nonconforming signs,and may remain as provided below: (a) Nonconforming off-premises signs shall be removed within five years of adoption of this code. Until then,such signs must be continually maintained,not relocated,and not structurally altered. Nonconforming off-premises signs may be replaced by off-site directional signs as allowed in this section. (b) Nonconforming on-premises signs may remain provided they are continually maintained,not relocated,and not structurally altered. (c) Billboards which are in place prior to the adoption of the ordinance codified in this code may remain provided they are continually maintained,not relocated,and not structurally altered. Craig From: "Pat O'Leary" <OLearyP @wsdot.wa.gov> To: peckassoc @comcast.net Sent: Tuesday, August 5, 2014 11:37:20 AM Subject: RE: Pleasant Harbor Marina and Golf Resort Hello Craig, Thanks for including WSDOT in review of your sign project.WSDOT is reviewing the signs as Type 3 on premise signs as defined and regulated in WAC 468-66-050(3).The size& copy on the sign are in compliance.Type 3 signs must be located on the same underlying parcel where the advertised activity takes place.The red arrowhead on the WATER SYSTEM ends in the highway r/w, I believe that's just a drafting miscue. I have to make an assumption here, I'm assuming the 'EDGE OF HIGHWAY' called out on the Hamilton drawing is the edge of paved shoulder which in theory is located 14'from the highway centerline (11' lane+3' shoulder in this vicinity).The r/w offset is 50'from centerline, leaving+36'from the edge of paved shoulder to the r/w line.The Hamilton drawing calls out 35' 2 3/4" from the 'EDGE OF HIGHWAY'to the r/w line which is a little shy of the 36' in theory. I don't know if these very precise Hamilton measurements are based on a land survey w/stakes in the ground; if they are, WSDOT will honor any AF Land Survey. If no survey exists there, I suggest locating the northerly sign a minimum of 50' from the highway centerline. Overall,the plans show substantial compliance with state law. I've included a r/w map for this vicinity as a courtesy. If the northerly sign is located entirely on the Marina parcel,this project is good to go under consideration or RCW 47.42 & WAC 468-66, Highway Advertising Control Act. Please share this finding w/Jefferson Co. as appropriate. These are state laws that regulate advertising signs visible to most state highways. I work with sign project managers across the state and I can review your proposed sign(s) for compliance with state law. Good on the county for sending you our way, there is a shared authority along SR 101 where state law and local code both have legs; the more restrictive rule will have precedence. Typically, a sign contractor will send me a plan view (plot plan), showing the proposed sign location on a parcel, the business features on the property (business building, parking lot, main business entrance from US 101) and distances from the proposed location to the business features on the parcel. I'll also need to review an elevation view showing sign dimensions and copy. WAC 468-66-050(f)a Type 3 on-premise sign can be erected within 150'on each side of the main entrance. On-premise signs, such as Pleasant Harbor Marina (PHM) assuming PHM owns the land at the driveway entrance, are then under the jurisdiction of the local permitting authority —Jefferson County. The Scenic Vista's Act, per my understanding,just governs (i.e.generally restricts)off-premise signing. Best example is billboards, and signing like McDonalds 2 miles ahead. Look at 47.42 RCW for more information on the Scenic Vista's Act. So unless I'm wrong, and I'm asking Gerald Nelson from our Traffic office for more input. So I believe your installing Pleasant Harbor Marina signs, as long it doesn't have advertising on it,on your property at the driveway entrance is just up to you and Jefferson County and their codes and regulations. We only control out right-of-way. Now with that said it sounds like Jefferson County may have some requirements for development next to US 101. Our main concerns would be impacts to the hillside such that removal of the hillside for development could have a negative impact to the hillside and highway, and we would have concerns with zero setbacks that result in development having to use WSDOT right-of-way to walk around their building, or building roofs overhanging onto our right-of-way,or stormwater is directed onto our right-of-way, etc. But saying buildings have to be 50' from the WSDOT right-of-way is not a WSDOT condition. It is the setback of buildings from the US Hwy 101 right of way line. The building proposed on the north side of Black Point Road and east of US Hwy 101 has a corner that is approximately 47' from the right of way. I understand the DOT and Jefferson County may have an agreement that set backs should be maintained at 50' or greater. Can you allow the resort zoning requirement to deviate from that distance? See that attached drawing. Thank you.
