PROJECT LOCATION: Pracel Number: 601072009 Site Address: 2510 Bee Mill Rd CONDITIONS: 1.) The applicant shall apply for and obtain a building permit prior to beginning any work approved under this SPAAD. 2.) The applicant shall apply for and obtain a septic permit prior to beginning any work approved under this SPAAD. 3.) The applicant shall apply for a shoreline exemption for single-family residential development at the time of building application. 4.) At the time of building application, a stormwater plan in compliance with the Stormwater Management Manual for Western Washington shall be submitted. If the proposal cannot meet the prescriptive requirements of the stormwater manual, an engineered stormwater plan shall be required. 5.) The applicant shall fully implement the November 2013 Habitat Management Plan and February 27, 2014 addendum. The mitigation proposal begins with the issuance of this SPAAD (i.e., SPAAD approval date is used to determine mitigation success at the time of building application). In the event that native plants do not establish as indicated in the February 27, 2014 addendum, five native plants(species to be approved by DCD prior to planting) shall be installed for each year that the performance standard is not met, for a maximum of 25 plants to be installed by the applicant by Year 5. The building permit shall be conditioned such that all mitigation work is to be completed prior to building final. A CERTIFICATE OF OCCUPANCY SHALL NOT BE ISSUED UNTIL DCD HAS REVIEWED AND APPROVED THE MITIGATION PROJECT RELATIVE TO THE APPROVED HMP AND ADDENDUM. 6.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 7.) VOLUNTARY MEASURES OF COASTAL&AT RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three(3) gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. 8.) VOLUNTARY MEASURES OF COASTAL &"AT RISK SIPZ: 1. Installation of a flow meter. 2. On-going well monitoring for chloride concentration. 3. Submittal of monitoring data to County. 9.) MANDATORY MEASURES FOR COASTAL SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirement: a. Chloride concentration of a laboratory-certified well water sample submitted with building permit application. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 10.) The property owner shall comply with Water Conservation Measures(per list maintained by the UDC Administrator). 11.) A flow meter shall be installed prior to final sign off of the building permit. 12.) A vegetative buffer of 30 feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top or toe of the Landslide Hazard Area. 13.) Construction activities shall not encroach upon the fish and wildlife habitat conservation area buffers. This includes the storage or preparation of materials. 14.) The identified Fish and Wildlife Habitat Area (Type N Stream), shall maintain a vegetative buffer setback of 50 feet plus a 5-foot building setback. The buffer shall be measured horizontally from the Ordinary High Water Mark (OHWM). 15.) An additional setback of five (5)feet is required from the edge of the fish and wildlife habitat conservation area buffers to the proposed residential structures. 16.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 17.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk(or salvage)yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk(or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 18.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 19.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5)year period, the Site Plan Approval Advance Determination (SPAAD) cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval-Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD)and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under Article VII, Chapter 18.40 JCC shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Article VII, Chapter 40 JCC for criteria pertaining to modifications). 20.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface, which includes roofs, driveways, concrete, etc. _ 21.) The setback from adjacent residential lots is 5 feet, the setback from the stream is 50 feet(plus 5-foot building setback), the setback from Bee Mill Road is 20 feet, and the shoreline setback is 30 feet from top of bank. The site plan shows a building envelope that is at least 117.5 feet from ordinary high water mark. Construction activities shall be no closer than 117.5 feet from Dabob Bay and no closer than 50 feet from the stream. 22.) Building height shall not exceed 35 feet. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) This Site Plan Approval Advance Determination (SPAAD) is for future construction of a single-family residence on a parcel along Dabob Bay. The shoreline designation in this area is Conservancy. This permit vest the proposal to shoreline requirements in Chapter 18.25 JCC, but is not a shoreline permit. The applicant is to apply for a shoreline exemption for single-family residential development at the time of building application. 3.) The application was reviewed by the Jefferson County Department of Community Development staff for the potential presence of Critical Areas under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: geologically hazardous areas(intermediate shoreline slope stability, seismic hazards); fish and wildlife habitat conservation areas (Type N stream, listed species in marine water and terrestrial habitats); aquifer recharge areas (susceptible); and seawater intrusion protection zones(coastal). 4.) Special Reports were submitted as part of this application to address geologically hazardous areas and critical areas. A Geology Hazard Assessment report prepared by Stratum Group (dated November 1, 2013)was submitted on December 10, 2013. This report recommends a setback of at least 25 feet from the top of the bluff. A Habitat Management Plan (dated November 2013) and addendum (dated February 27, 2014)were prepared by Ecological Land Services, Inc. The report and addendum address a 25% administrative buffer reduction from Dabob Bay. No buffer reduction is proposed for the Type N stream. 5.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 6.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 7.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 8.) A Type N Stream(Fish and Wildlife Habitat Conservation Area) has been identified on the subject property. The stream will require a buffer of 50 feet and a 5-foot building setback. The buffer shall be measured horizontally from the Ordinary High Water Mark (OHWM). 9.) Buffers are areas that shall be maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished. 10.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge (primarily through rainfall) and the rate of groundwater withdrawals(primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 11.) The parcel is located within a coastal SIPZ (seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Polic} (Resolution 44-22, effective September 23,2002)that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 12.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 13.) The site plan, as submitted with the SPAAD application on December 31, 2014 (with note added by project representative for potable water on May 12, 2014), has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 25, 2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 14.) This approval is for a site plan approval advance determination for a future residence only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 15.) The parcel has been designated as rural residential one dwelling unit per five acres (RR 1:5) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 16.) The proposal was reviewed against the site plan determination criteria of Article VII, Chapter 18.40 JCC. The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan and the provisions of the Unified Development Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The parcel is approximately 1.7 acres in size. The site plan, as submitted on December 31, 2013 and stamped on May 25, 2014, complies with Jefferson County Code Table 6-1: Density, Dimension and Open Space Standards. This application is for a Site Plan Approval Advance Determination to eventually construct a single-family residence. Jefferson County Department of Environmental Health reviewed the application and approved it based on the site plan received December 31, 2013. This SPAAD was not reviewed for fire flow due to the application, as proposed, is indicating that a one-party well on an adjacent parcel will eventually be used as a two-party well that includes the subject parcel. This SPAAD application is not vested for potable water and it is the responsibility of the applicant to demonstrate that potable water is available for this parcel. Jefferson County has no specific adopted fire flow requirements for permitting. Application of a Coordinated Water System Plan for fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source and storage. The'applicant shall provide proof of potable water at the time of building application. This application does not vest the parcel for potable water. Access to this parcel is proved by Bee Mill Road. The approved site plan has not been reviewed for stormwater requirements. JCC 18.30.060 and JCC 18.30.070 require the applicant to prepare a stormwater plan in compliance with the Washington Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion, and sediments during construction; address permanent measures to stabilize soil exposed during construction; and in the design and operation of stormwater and drainage control systems. At the time of building application, a stormwater plan in compliance with the Stormwater Management Manual for Western Washington shall be submitted. If the proposal cannot meet the prescriptive requirements of the Stormwater Manual, an engineered stormwater plan shall be required. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing the provisions contained within Section 8 of this Code and Chapter 43.21C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 17.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments, are included as "critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. We are removing the view clearing from the proposal in the HMP. Mr. Danielson will consult with Jefferson County about removal of trees or other vegetation blocking the view when the time comes. Are there any special requirements that he should be aware of when proposing view clearing? 2. At this point, Mr. Danielson is not proposing to mow the buffer area but he will install mesh fencing around the individual plants or groupings of native plants if he does decide to mow the tall grasses in the buffer. Please be assured that he fully intends to allow native plants to inhabit the buffer and will take measures to ensure their growth and survival. 3. Invasive species, including Himalayan blackberry,Scot's broom, ivy, etc.will be removed as they encroach into the buffer area. There is not much in the way of invasive cover at this time so mechanical means of removal are not necessary. Invasive species will most likely be removed by hand as they are found growing in the buffer area. 4. The contingency measures proposed for this project area will include installation of 5 Nootka rose plants from one-gallon containers. Mr. Danielson may decide to also utilize native plants transplanted from the future building site as part of this contingency measure. I anticipate that you would like to see some performance standards and monitoring for 5 years. We are proposing performance standards to track the success of the native re-vegetation similar to the other project that we recently discussed because conditions on this site are very similar. • Year 1—native plants establishing in the grass portion of the buffer 5 feet of the native plant community; • Year 2- native plants establishing in the grass portion of the buffer 10 feet of the native plant community; • Year 3- native plants establishing in the grass portion of the buffer 15 feet of the native plant community; • Year 4- native plants establishing in the grass portion of the buffer 20 feet of the native plant community; • Year 5- native plants establishing in the grass portion of the buffer 25 feet of the native plant community. The performance standard will be a presence/absence observation within each incremental area and documented using photographs and a tape measure. If native plants are expanding and establishing anywhere within the areas identified above,then the performance standard is met. There is good spread of plants currently in the buffer and if there is spread of plants within 25 feet of the native plant community before the 5 year monitoring period ends, I am proposing that no additional yearly monitoring be required. Maximum of 10 percent invasive species for Years 1—5 in the 25-foot-wide re-vegetation area. Monitoring information in the form of photos and measurements showing the expansion of native plant growth will be submitted to Jefferson County DCD in September or October of each monitoring year. While it understandable that the difference has led to confusion,the Zenovic report should not be considered a geology hazard assessment report as it was prepared an engineer and did not fully evaluate the geologic conditions of the site. The Stratum Group report was prepared as a geologic hazard assessment by a licensed engineering geologist. The difference in setback is based on using a different assumed erosion rate and a different approach to an additional safety setback. Stratum Group setback determination used a bluff recession rate of 4 inches per year and an additional setback of 10 feet to account for additional top of bluff failures of 10 feet.The Stratum Group set back was also established for an expected life of the structure of 100 years. Zenovic used a bluff recession rate erosion rate of 8 inches per year and instead of characterizing the types of bluff failures simply nearly doubled the setback calling it a safety factor of 2. Zenovic used a life of the structure of 75 years. Hence: Stratum Group: 0.33 feet/year x 100 years+ 10 feet = 43 feet rounded shifted to a more conservative 50 feet Zenovic: 0.67 feet/year x 75 years x 2 safety factor = 100 feet April 21,2014 2530 East Marrowstone Road,Norland,WA Geology Hazard Assessment Set Back Discussion Obviously the primary difference is Zenovic is used a bluff recession rate that is twice as high and utilized what he termed a safety factor that simply multiplied the result by 2 which would be a very high safety factor. In regards to erosion and bluff recession,the utilization of a bluff erosion rate of 8 inches used by Zenovic is not consistent with information regarding bluff retreat in similar settings.Krueger (1988)estimated a bluff retreat rate of 10 centimeters (3 inches) for a location on the northern tip of Marrowstone Island exposed to large fetch and very high wave energy and shoreline transport. Krueger(1988)provided no specific bluff retreat values along the shore reach of the subject property other than designating the reach as an area of relatively slow wave erosion. Shipman (http://www.snocomrc.org/uoloads/Information%20for%20Coastal%20Landowners/5%20DOE- Shore%20Eros%20and%20lmpacts.pdf) indicates on less exposed shoreline reaches,"the erosion rates are often much less than 4 inches per year." My own review of historic aerial images, historic maps,as well as observation of vegetation on the bluff slope suggests a bluff retreat rate at the property and vicinity that is likely much less than 4 inches per year.This is consistent with Shipman's observation and Johannessen(personal communication).Hence, it is my professional opinion that the use of 4 inches per year(0.33 feet/year)is a conservatively high rate and the actual rate is likely significantly less. If Zenovic had used the same bluff retreat rate as I had his setback would have been 50 feet. (0.33 feet/year x 75 years x 2 safety factor = 50 feet). Jefferson Code does not set a standard life of the structure value.I use 100 years in all of my reports establishing a home setback,a more conservative value than the 75 years used by Zenovic. Using bluff retreat alone does not recognize that the scale of top of bluff failures may extend the failure deeper into the setback. I utilized a distance of 10 feet which is consistent with a conservative estimate for the size of bluff top failures observed in the vicinity and at other sites with similar geologic conditions. While it is my opinion that the setback I used is adequately conservative,Zenovic clearly used a much more conservative approach by simply multiplying his result by 2. (ELS) has completed this Habitat Management Plan on behalf of the property owner, John Danielson, for the construction of a single family home within the 150 ' foot buffer of a Fish and Wildlife Habitat Conservation Area (FWHCA). The FWHCA adjacent to this property is a saltwater shoreline within Hood Canal. The subject property consists of Tax Parcel Nos. 601072009, which totals 1.99 acres. An ELS biologist conducted a site visit on November 13, 2013 to inventory site conditions in preparation of this Habitat Management Plan as required under Jefferson County Code (JCC), Unified Development Code Chapter 18.22 Critical Areas,Article VI; Fish and Wildlife Habitat Conservation Area. PROJECT DESCRIPTION PROJECT LOCATION ' The subject property is located at the end of Bee Mill Road near Brinnon, Washington, within Section 7, Township 26 North, Range 1 West of the Willamette Meridian (Figure 1). It is situated west of Point Whitney along the southern shore of Quilcene Bay. ' CONSTRUCTION ACTIVITIES ' The proposed project consists of construction of a single family home and installation of a septic system in the southern half of the property (Figure 2). The homesite will be situated east of the existing access road and just north of the septic system, which is proposed along the south edge ' of the property. This location for the home will also provide the best view of Quilcene Bay from the homesite. Most of the buildable area mapped on Figure 2 is composed of open grassland with scattered deciduous shrubs throughout (Photoplates 1-3). Because the property is ' constrained by FWHCA and buffer, the project is proposing to reduce the required 150-foot buffer to 117.5 feet to accommodate the building site (Figure 2). Reducing the buffer doubles the size of the building site, which is also constrained by the existing road and septic system ' areas, while maintaining most of the FWHCA buffer. SITE CONDITIONS ' This property is irregularly shaped due to the historic subdivision of properties and is composed of a relatively square south half with a roughly 160-foot wide finger extending north to the shoreline of Quilcene Bay (Figure 2). The land slopes gradually down to the north to the top of the short, steep shoreline bank. The eastern finger extends north down the shoreline bank to the tidelands in Quilcene Bay while the western portion of the property ends at the top of a Type N stream ravine. Most of the land is composed of open grassland with scattered small trees and shrubs with areas of conifer forest along the east and west edges and near the northwest corner (Photoplates 1 and 2). A small shed is located on the property and an existing access road crosses the west half(Figure 2). The existing road provides access to this property as well as to ' the property immediately north. The moderately sloping shoreline bank is very well vegetated with native low growing ' vegetation and some conifer trees, some of which appear to be removed or cut back to maintain the view (Photoplates 4 and 5). A narrow path cuts across the shoreline bank and provides foot access to the beach from the property. The I bank down into the stream is very steep and well vegetated with trees and a dense low shrub understory (Photoplate 7). The stream flows from slopes west of the property and drains into Quilcene Bay; however, water goes underground before the start of the shoreline channel (Photoplate 6). The shoreline channel was dry during the November 13, 2013 site visit but began filling in as the tide was coming in (Photoplate 5 . The Department of Ecology Coastal Shore g g ( P ) P gY Photo website (WDOE, CSP, 2013) was consulted to provide a site photo (Figure 6) and this li I photo shows buildings that appear to be within the 150 foot FWHCA buffer required from Quilcene Bay. The site development plan proposed for this project will construct the home south of the buildings, so will provide a greater buffer than was provided to the FWHCA historically. IThe south shore of Quilcene Bay lies along the north edge of the property and because Quilcene Bay is part of Hood Canal, it supports federally listed fish species and a 150 foot buffer is required from the ordinary high water mark of the shoreline community. HABITAT AND CRITICAL AREAS MAPPING JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING I The Jefferson County Critical Area and Habitat Maps viewed through the on-line mapping website were used to determine the shoreline designation, identify the extent of wetlands mapped I in the area, identify whether fish and wildlife habitat areas were present and to determine the extent of the floodplain designation. I The shoreline designation map (Figure 3) indicates that the shoreline along this property is primarily designated as Conservancy with Suburban designation beginning just north of the property. The Jefferson County maps indicate that the shoreline area is comprised of wetland and I a Type N stream lies just north of the property(Figure 3). The Fish and Wildlife Habitat mapping module (Figure 4) maps habitat across this parcel as part of habitat associated with Quilcene Bay and Point Whitney per the orange polygons. The FEMA designation maps (Figure 5) indicate I there is a Type A flood zone across the northeastern portion of the property. WASHINGTON DEPARTMENT OF FISH AND WILDLIFE,PRIORITY HABITATS AND SPECIES I The Washington Department of Fish and Wildlife Priority and Habitat Maps (WDFW, 2013) indicate the presence of several priority habitat and species areas within 1 mile of the property. The maps indicate no spawning areas for surf smelt, sand lance and Pacific herring on the shoreline adjacent to this property but there are spawning areas immediately north and east. The Imap indicates a break in spawning areas for these species in the shoreline area along this property. Eagle nests are mapped greater than 1/4 mile to the north and Y2 mile to the south and the property Idoes not lie within the buffer areas required around the nests. A bald eagle communal roosting area is also mapped greater than t/z mile south of the property. The property is in close proximity old growth forest within the Olympic National Park but the WDFW maps indicate that this area Ito is not within a spotted owl management circle (map notes indicate there is insufficient evidence to establish territory within this area). There are also no marbled murrelet occupancy sites within 2 miles and the property is outside the 1.5 mile buffer required around an occupancy site. There are I no seal or sea lion haul-out areas mapped on or adjacent to this property with the closest haul-out site more than 1 mile to the south. The stream that flows just north of the property is shown on the WDFW maps but no fish usage is noted within the stream system. IBee Mill Road Property Ecological Land Services,Inc. Habitat Management Plan 2 November 2013 I 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 DEPARTMENT OF ECOLOGY COASTAL MAPPING ' According to the Department of Ecology Coastal Atlas, patchy eelgrass beds are present along the shoreline of this property. Eelgrass was observed in the wrack on the subject property but beds could not be seen from the beach during the November 13, 2013 site visit. Beds are presumed present near the property based on the contents of the wrack. A coastal shore photo from the Department of Ecology website (Figure 6) is included to show the conditions of the property. LISTED SPECIES AND HABITATS IN THE PROJECT VICINITY ' The potential presence of listed species, including fish, bird, and mammals that have a primary association with the habitat on or adjacent to the project area was evaluated by a site visit, aerial photographs, the WDFW Priority Habitats and Species data search (WDFW 2013), the U.S. Fish ' and Wildlife Service (USFWS 2013) website, the National Marine Fisheries Service website (NMFS 2011), and the Washington Department of Natural Resources Natural Heritage website (WDNR 2013). Listed fish, bird and mammals were not noted within the immediate area of the ' subject property during the November 13, 2013 site visit. The listed species are known within the area of Hood Canal so are assumed present at sometimes of the year despite not being seen during the field visit. Twenty eight species of rare plants are listed in Jefferson County but none of the listed species occur on or in the vicinity of the subject property. Habitat Management Plan 3 November 2013 FISH AND WHALES ' According to the National Marine Fisheries Service (NMFS) website, there are four listed ESUs/DPSs of salmon, steelhead, and bull trout in the project area. These species are found with the marine waters of Hood Canal and Quilcene Bay, which lies to the north and east of this property. Maps were not consulted to identify the use of the area by these fish species as they are known to occur within the marine waters of Hood Canal. There is no freshwater spawning or rearing areas on or adjacent to this property. The stream offsite to the north does not have any ' fish usage per the WDFW PHS maps obtained for this project and observations made during the site visit. Hood Canal and Puget Sound have usage by whale species listed in this area and whales are also likely present in Quilcene Bay at some time of the year. BIRDS Research conducted for this project shows that the property is not within the management circle for spotted owl and there are no marbled murrelet occupancy sites within 2 miles (WDFW-PHS, 2013). The listed bird species are not likely found in the vicinity of the subject property because there are no old growth forested immediately adjacent to the property and no other specific habitat features are available in the vicinity, except marine waters for marbled murrelet. PLANTS The Washington Department of Natural Resources, Natural Heritage Program (WANHP 2013), lists 28 rare plant species that occur within Jefferson County. Most of these species are at high elevations (montane to alpine) or are associated with freshwater systems such as rivers, streams and lakes, and some are associated with bogs. None of the species listed have potential to occur on or near the subject property. Patchy eelgrass beds are mapped by the Washington Department of Ecology Coastal Atlas (DOECA, 2013) along the shoreline adjacent to the subject property. Eelgrass was observed in ' the wrack on the beach but no beds were observed during the field visit. CRITICAL HABITAT ' Critical habitat for Chinook, steelhead, bull trout and orcas is present within the Hood Canal (Federal Register 2005 and NMFS 2011). ' POTENTIAL EFFECTS OF THE PROJECT ON LISTED SPECIES AND HABITAT DIRECT EFFECTS AND INDIRECT EFFECTS A portion of the property is mapped within a FEMA flood zone (Figure 5) but because of the height of the shoreline bank, there is no potential for tidal flooding on the upland portion of the property. Therefore, the proposed buffer reduction will not have a negative impact on habitat ' within the mapped flood zone area. The subject property does not represent habitat nor does it have habitat features for any of the listed species because it is composed mostly of open grassland with areas of relatively young conifer forest on and immediately adjacent to the ' property. Project activities will take place landward of the ordinary high water line so will not affect habitat within the marine waters of Quilcene Bay or Hood Canal. 111 Bee Mill Road Property Ecological Land Services,Inc. Habitat Management Plan 4 November 2013 1 I I No effects on listed species and critical/priority habitats are anticipated with the construction of a I single family home on this property. All components of this project will be at least 117.5 feet from the ordinary high water mark and will take place in the cleared portion of the property so will not require removal of significant native vegetation coverage. The existing forested areas, I which lie along portions of the shoreline and stream buffers will be maintained so will continue to provide high quality buffer for the critical areas adjacent to the property. ' There will be no surface water impact to Quilcene Bay or Hood Canal as a result of this project because the project will maintain at least 117.5 feet of vegetated buffer between the critical area and the future homesite. There will be no change to the noise levels generated on the property as I the site activities will not change as a result of this project. Noise levels will be higher during homesite construction but once the home is completed, the noise level will return to normal and will not have significant noise impact on the adjacent critical areas. IIMPACT AVOIDANCE AND MINIMIZATION MEASURES I Impact avoidance and minimization measures include sighting the homesite within the existing grassland portion of the property where there is little native vegetation coverage. Therefore, very little native vegetation cover will require removal for construction of the future home. Although this area lies within the 150 foot shoreline buffer required from Hood Canal, the project will I avoid all impacts to the fish and wildlife habitat areas. Ground disturbance will be limited to only that necessary to install the home and septic system. Construction equipment will be staged outside the reduced FWCHA buffer so will not affect any existing vegetated portion of the 1 buffer. HABITAT MANAGEMENT RECOMMENDATIONS IThe proposed building site and most of the shoreline buffer is composed of grassland with scattered shrubs and small trees. Over a period of many years, it appears that a view has been I maintained between groups of conifer trees growing atop the shoreline bank (Photoplate 3). Some conifer trees are growing at the bottom of the shoreline bank but do not appear to have been cut back. Much of the bank is covered with dense salal with scattered ocean sprays and ' sword ferns. The grassland portion of the buffer has been regularly mowed so is mostly dominated by grass that has grown taller since the last mowing activity. There are many Nootka rose starts growing up in the grass as well as a few salal starts. IThe habitat management recommendations focus on maintaining the view corridor as it currently exists and will proposes removal of taller trees and transplanting smaller trees to other locations I of the property. The Nootka rose and salal starts will be allowed to grow up naturally and will not be mowed along with the tall grasses. Prior to each mowing, the new rose and salal starts will be flagged so that they are not mowed. Since Nootka rose spreads rapidly through I underground root systems, it will quickly improve the vegetation within the buffer without having to install additional plants. In addition, there are sword ferns growing in the future building site and those that require removal to construct the home or install the septic system will be transplanted into the reduced buffer to further improve the native vegetation coverage. Prior to each mowing, the area will be examined to identify new roses and salals, which will need to be flagged so that they can be easily seen when the grass is mowed. After a period of three to five years, the reduced shoreline buffer should be well I vegetated with a dense rose community. The trees growing from the base of the shoreline bank should not be removed because their lower branches are providing high quality shading and predation protection along the ordinary high water mark of the beach(Photoplate 5). IBecause this project does not propose plant installation, monitoring is not proposed to track the changes that occur over time. Jefferson County Department of Community Development I (JCDCD) may request some documentation of the spread of Nootka rose and salal across this property. Residents of this property can provide this information to JCDCD upon request. ICONCLUSION This ro'ect involves reducing the FWCHA buffer from 150 feet to 117.5 feet to accommodate P J g construction of a single family home and septic system. The property is constrained by the 150- Ifoot buffer and the existing access road so the reduction is necessary to accommodate the future homesite. The project should have minimal impact on the FWCHA because most of the buffer is being maintained and construction activities will not require removal of significant native Ivegetation. The buffer will be maintained as it currently exists except that the spreading Nootka rose and salal plants will be allowed to continue their spread across the reduced buffer to encourage replacement of the existing grasses with native shrubs. Any native plant removed I from the building site area, including Nootka rose and sword ferns, shall be transplanted into the reduced buffer area. Small trees will also be transplanted from the view corridor and the trees growing at the bottom of the shoreline bank will be retained because the lower branches are I providing good shoreline habitat. The buffer from the stream lies within the reduced FWCHA buffer so there is a wider buffer for the stream than is required by the JCC. No changes will take place to the stream buffer area so there will be no impact to the stream. Best management I practices will be in place prior to, and for the duration of construction to ensure that there are no impacts to the adjacent critical areas. A home is located on parcel 601072010 and shed building is located on parcel 601072009. Based on my investigation of the site and vicinity, it is my opinion that the existing home and shed are not at risk from landslides and will not be at risk from landslides or erosion over the next 100 years. Any new building development should be located at least 25 feet back from the edge of any steep slopes (greater than 40%) on the site. This assessment included a visual inspection of the property, slopes on and in the vicinity of the property, review of available geologic mapping in the area, and investigation of the shoreline at the base of the bluff. GENERAL GEOLOGY The (Geologic Map of Surficial Deposits in the Seattle 30'x 60'Quadrangle, Washington (Yount, Minard and Dembrof, 1993) indicates the subject property and vicinity is underlain by glacial till and undifferentiated pre-Fraser glaciation deposits. Glacial till consists of a poorly sorted mix of gravel, sand silt and clay in varying proportions. The till was deposited directly by glacial ice. The undifferentiated pre-Fraser glaciation deposits are described as consisting of interbedded oxidized brown, red-brown, and gray gravel, sand, silt, and clay. The layers are moderately to well sorted and the unit contains minor amounts of ice-contact deposits and outwash gravel and sand. Generally the unit is nonglacial and has abundant peat and woody debris. These sediments were deposited sometime prior to the last glacial event and include deposits of the Whidbey and Olympia nonglacial periods. The sediments have been overridden and consolidated by glacial ice. The bedrock mapped to the south consists primarily of basalt; however,Yount and Grower(1991) indicate that siltstone is present in the upper portions of the unit. My observations on the bluff face and within road cuts and test pits on the on property and on the bluff face on and in the vicinity of the property are consistent with the site being underlain by very pre-Fraser glaciation deposits and glacial till. The upland area of the site had units that are November 1,2013 Parcels 601072010 and 701072009,Jefferson County,WA Geology Hazard Assessment consistent with glacial till. Sediments exposed at the base of the shoreline bluff slope on and in the vicinity of the property consists of very hard compact sand and silty sand consistent with preglacial sediments. SPECIFIC SITE OBSERVATIONS The property consists of two tax parcels: Parcel 601072010 is the northwest parcel and has an existing home and Parcel 601072009 is the southeast parcel and has an existing shed. The location of the property is indicated on Figure 1. The property is accessed via a gravel road that reaches the western side of Parcel 601072009. The road continues and angles down into an unnamed stream valley west of Parcel 601072009 and south of Parcel 601072010 and then accesses Parcel 601072010 from the south. A spur road angles off of this road and parallels the stream coarse to the shoreline on the eastern side of Parcel 601072010. Northwest Parcel 601072010 A home is located on the upland area of Parcel 601072010. The upland area has an overall gentle slope to the east. A steep shoreline bluff slope is located to the northeast and steep slope down to the stream valley is located to the southeast of this upland area. The home site itself appears to have been located on an area that was leveled by partially cutting into the slope to the west. The existing home is located at its closest location is 29 feet from the top edge of the steep shoreline bluff slope. The shoreline bluff slope is approximately 30 feet high at the subject property and as an overall slope of approximately 60 degrees. The bluff slope is covered with a variety of brush and trees. Some mature trees are located along the top edge of the bluff. Geologic units underlying the steep bluff slope are consistent with preglacial deposits that are very hard and near the base of the bluff are nearly rock like in hardness and resistance to erosion. The shoreline bluff to the east of the home and west of the stream valley is traversed by a trail/road that was constructed many years ago by cutting into the slope and angling down the slope to the base of the bluff. The trail is approximately 10 feet wide. Most of the trail is on a full bench cut, but there are portions of the outer edge of the trail that appear to be built up from sidecast material from the cut slope or from soils imported onto the slope. Some fractures indicative of pending shallow surface failures are present. I had visited this road a few years ago and had noted the cracks at that time and the condition of the road has not changed. The shoreline beach is a gravel and cobble beach. Erosion along the base of the bluff is evident Stratum Group File:9.19.13 2 November 1,2013 Parcels 601072010 and 701072009,Jefferson County,WA Geology Hazard Assessment along most of this shoreline reach; however, the base of the bluff is very hard and resistant to erosion. Due to the very compact sediments on the bluff,the toe of the bluff slope is fairly erosion resistant; however, over steep slopes are evident throughout much of the shoreline bluff reach in this area. The bluff is eroded by a combination of wave action that undermines the base of the bluff, and periodic shallow topsoil failures from portions of the bluff that have become over steep. The material eroded from the bluff face is removed from the base of the bluff and transported along the shore towards the east by wave action.Slides appear to be very thin soil slides. Based on tree coverage of most of the slopes on this bluff, it appears the recurrence interval of shallow slides that impact the uppermost part of the bluff is on the order of at least 50 years or more. The beach is in good condition and is built up enough that waves reaching the toe of the slope only take place during very high tides or storm surges. A step slope is located to the east of the upland area down to a stream valley on the east side of the property. This slope is on the order of 38 to 40 degrees and is covered with a mix of trees, brush and English ivy. An access road to the beach runs along the base of the slope between the small stream and the base of the slope. Access Driveway The access driveway to the home on Parcel 60107201 passes across a property located to the south. The road dips down into a small unnamed stream valley, crosses the creek via a culvert pipe and then ascends the northwest side of the stream valley onto to Parcel 601072010 and the existing home site. The access driveway appears to be located on a full bench cut into very compact sands and gravels and glacial till. No drainage problems or unstable slopes other than minor surficial raveling were present along the driveway access. The stream at the crossing contained a trickle of water at the time of my October 11, 2013 site visit. The flow of water appeared to be related to seeps and springs upstream from the crossing. The stream channel is not deeply eroded and there was no sign of recent rapid erosion or debris flow activity within the stream valley. Old growth cedar stumps are present immediately adjacent to the stream indicating no severe flooding has taken place along the stream channel for a long time. Periodic high flood flows can not be ruled out, but based on the existing channel the risk of a flood impacting the road at the crossing appears to be very low. Southeast Parcel 601072009 Stratum Group File:9.19.13 3 November 1,2013 Parcels 601072010 and 701072009,Jefferson County,WA Geology Hazard Assessment The southeast parcel consists of a broad very gentle sloped upland area that is mostly grass and brush covered and appears to be a former small rural farm/home site. The northern portion of the upland is bound buy a shoreline bluff and a slope down to the unnamed stream. The slopes vary between 45 degrees and 30 degrees. The beach at the base of the shoreline slope is a fan line deposit associated with an accreting shore area and as such the base of the bluff is not and has not been subject to erosion. As noted in the above section,the stream at the base of the slope is general not eroding the slopes. The area of the slopes is underlain by very compact sand and gravel units and glacial till. CONCLUSIONS AND RECOMMENDATIONS Based on my visual inspection of the subject properties and vicinity, I conclude that the existing home on the northwest parcel is not at risk from landslides or erosion over the expected life of the structure (100 years) my recommendations are followed. If new structures are built on either parcel, they should be set back at least 25 feet from the top edge of any steep slopes. It is my opinion from an engineering geology and geology standpoint that this distance will be adequate to allow for expected shallow surface failures that will result from the continued erosion of the base of the bluff by wave action and ravelling of the exposed soils on the bluff face as well as likely shallow soil failures along the upper portion of the proposed building area. The Jefferson County Shoreline Master Program indicates that the setback from the top of the steep shoreline bluff slope should be one foot for each foot of bank height(1:1). As such the setback distance may be greater than the 25-foot setback depending on the height of the shoreline bluff where any proposed structures will be built. Based on LiDAR data and field measurements with a clinometer the bluff height varies from 40 feet to 25 feet high with the height increasing to the west. The existing trail that angles down to the beach from the home site does have a section that will likely fail and the loss of the outer edge of the trail should be expected. Maintaining a drainage path along the inside area of the trail or preventing drainage from flowing down the trail at the top of the bluff will reduce this risk and will minimize the area impacted. The use of the trail as foot path will not cause stability problems, but vehicles should not be driven on the path. Shoreline Because the bluff is an eroding bluff, slope failures should be expected to occur on a periodic Stratum Group File:9.19.13 4 November 1,2013 Parcels 601072010 and 701072009,Jefferson County,WA Geology Hazard Assessment basis. The only way to prevent continued erosion of the base of the bluff is to construct hard armoring at the shoreline at the base of the bluff. However, the eroding bluff acts as a feeder bluff(erosion of the bluff provides sediment) for the beach both at the site and to the east, and any shoreline armoring will have a negative impact on properties down drift from the bluff. The construction of shoreline armoring on other properties may cause an increase of erosion of the subject property. The owner of the subject property should contact Jefferson County officials regarding any proposed shoreline protection projects along the bluff or any shoreline protection construction. There are currently no shoreline-armored areas along this stretch of coastline and substantial sediment inputs from debris flows within streams up drift to the north such that beach conditions should remain very good as long as natural geologic processes are allowed to continue. Storm and Septic Drainage Soils on the upland portion of the property appear to be relative well drained. The soils appear to consist primarily of coarse grained ice-contact deposits; however, siltier zones may have somewhat poorer drainage. Roof drains for any new construction and any other drainage should be directed into a level dispersion/infiltration trench excavated perpendicular to the slope. Septic drainfields should not cause any problems for slope stability as long as they are set back at least 30 feet or more from the steep slopes on the site. Vegetation Site grading soils or debris, landscape debris, or any other material should not be disposed of over the shoreline bluff face or placed at the top of bluff. Over time debris will break down and form an unstable mass that will slide damaging the slopes below. Native vegetation, particularly tress and low native brush on the slope and at the top of the bluff should be disturbed as little as possible. If trees are thinned or limbed for view purposes on the bluff face or at the top of the bluff, all debris should be removed from the bluff face. Some thinning of small trees should not cause any problems as long as the native brush understory is left in place. These are risks that the building owner should recognize and be willing to accept.
