The applicant shall implement the approved HMP prepared by Ecological Land Services, Inc, as submitted on April 8, 2014. 2.) One trail that is a maximum of five (5)feet in width may be maintained to the shoreline. Any native species that become established outside of the five-foot trail shall be retained. 3.) Flagging placed by DCD staff in the mitigation area shall be retained; the applicant shall not remove the flags. 4.) Non-native species to the north and south of the previously cleared area(and within the reduced buffer)shall be removed as part of the mitigation work for this parcel.. 5.) Five native plants(based on species in the HMP) shall be required for any year that native species do not encroach into the mitigation area, for a total of up to 25 native shrubs over the five-year monitoring period. 6.) The owner shall contact DCD once the mitigation has been completed. NO FINAL BUILDING CERTIFICATE OF OCCUPANCY SHALL BE ISSUED UNTIL DCD HAS REVIEWED AND APPROVED THE MITIGATION AREA.. 7.) It is recommended, but not required, that the project biologist be onsite for removal of non-native species in the reduced buffer. NATIVE SPECIES SHALL NOT BE REMOVED FROM THE REDUCED BUFFER. 8.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 9.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk(or salvage)yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk(or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 10.) A minimum of two (2)on-site parking spaces shall be provided for the single family residence. 11.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5)year period, the Site Plan Approval Advance Determination (SPAAD) cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval-Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD) and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Section 8.7 shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by theAdministrator subject to the provisions for Type I decisions. (Please request a copy of Section 8.7 of the UDC for criteria pertaining to modifications). 12.) The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section JCC 18.25.090(5), which exempts the"construction by an owner, lessee, or contract purchaser of a single-family residence[in shoreline jurisdiction]for the owner's or owner's family's use..."from the substantial development permit (SDP) requirements under certain provisions. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements. A shoreline exemption will be required at time of building permit application for a single family residence. 13.) This approval is for a SPAAD only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 14.) MANDATORY MEASURES OF HIGH RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three(3) gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. 15.) MANDATORY MEASURES FOR HIGH RISK SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirements: a. Variance from Chapter 173 WAC standards granted by Ecology per WAC 173-160-106 for a new groundwater well within 100 feet of a sea-salt water intrusion area per WAC 173-160-171 (i.e., within 100 feet of a groundwater source showing chloride concentrations above 200mg/L or within 100 feet of the marine shoreline); or for an existing or proposed groundwater well not subject to an Ecology variance, applicant must provide evidence through a hydrogeologic assessment(relevant components of an Aquifer Recharge Area Report per UDC 3.6.10.e) of a reasonable probability that the subject aquifer will not be degraded by the proposed use of well. b. Installation of a flow meter. c. On-going well monitoring for chloride concentration. d. Submittal of flow and chloride data to the County per monitoring program. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 16.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 17.) All construction activities shall not encroach upon the 50 buffer. This includes the storage or preparation of materials. 18.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 19.) The building height is not to exceed 35 feet. 20.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 21.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 22.) Minimum building setback from Flagler Road right-of-way shall be 30 feet. Minimum side yard building setbacks shall be 5 feet. Shoreline setback shall be 117 feet 5 inches from the OHWM. 23.) A Geotechnical Report was prepared by Stratum group dated December 10, 2013 and submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. The applicant shall comply with the recommedations of the Geotechnical Report. A building setback of 10-feet and vegetative buffer of 40 foot setback shall be measured perpendicularly from the Ordinary High Water Mark for the Single Family Residence. The Septic Drain Fields shall be located at least 60 feet back from the top of the steep slope. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The applicant submitted a Habitat Management Plan (HMP) prepared by Ecological Land Services, Inc. (dated March 2014), which was submitted on April 8, 2014. The mitigation proposal for a 25%fish and wildlife habitat conservation area buffer reduction includes removal of non-native species within the reduced buffer and natural regeneration of native species. On May 8, 2014, DCD staff flagged the current limits of native vegetation, which is to be used as a baseline for measuring natural regeneration and control of non-native species. The timeframes for plant establishment begin the date this SPAAD permit is issued. 3.) The application was reviewed by the Jefferson County Department of Community Development staff on 5-12-14 for the potential presence of Environmentally Sensitive Areas(ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: fish and wildlife habitat conservation area, SARPA& SUSC aquifer recharge area, conservancy shoreline designation and high risk sipz area. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 5.) The site plan as submitted with the SPAAD application on 11-27-2013 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated 6-3-2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 6.) This approval is for a SPAAD only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 7.) The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 8.) The proposal was reviewed against the site plan determination criteria of the Unified Development Code (Section 8.7). The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan and the provisions of the Unified Development Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing the provisions contained within Section 8 of this Code and Chapter 43.21 C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 9.) NOTICE: This permit does not excuse the proponentfrom complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. Habitat Management Plan ii March 2014 INTRODUCTION Ecological Land Services, Inc. (ELS) has completed this Habitat Management Plan on behalf of the property owners, Mike and Lynne Sweeney, for the construction of a single family home within the 150-foot buffer of a Fish and Wildlife Habitat Conservation Area (FWHCA). The FWHCA adjacent to this property is a saltwater shoreline within Port Townsend Bay. The subject property consists of Tax Parcel No. 953700412, which totals 1.13 acres. An ELS biologist conducted a site visit on March 12, 2014 to inventory site conditions in preparation of this Habitat Management Plan as required under Jefferson County Code (JCC), Unified Development Code Chapter 18.22 Critical Areas, Article VI; Fish and Wildlife Habitat Conservation Area. PROJECT DESCRIPTION PROJECT LOCATION The subject property is located on the west side of Flagler Road north of Nordland, Washington, within Section 29, Township 30 North, Range 1 East of the Willamette Meridian (Figure 1). It is situated on the west side of Marrowstone Island and faces Indian Island. CONSTRUCTION ACTIVITIES The proposed project consists of construction of a single family home and installation of a septic system in the eastern 2/3s of the property (Figure 2). The homesite will be situated along the existing driveway and just northwest of the septic system, which is proposed near the southeast corner of the property. Most of the buildable area mapped on Figure 2 is composed of upland conifer forest with a dense shrub understory (Figure 3). Because the property is constrained by FWHCA and buffer, the project is proposing to reduce the required 150-foot buffer to 117.5 feet to accommodate the building site (Figure 2). SITE CONDITIONS This property is rectangular in shape and lies west of Flagler Road. The west line abuts the shoreline of Kilisut Harbor, which lies between Indian Island and Marrowstone Island. It is currently vacant, but was previously used as a recreational property with a driveway entering the northeast corner and extending to a clearing on the west end (Figures 2 and 3, Photoplates 1 and 5). A low platform was located in the cleared area and used for tent camping. The property is level to gently undulating across the eastern 2/3s and slopes gradually down to the top of the shoreline bank in the western 1/3. The property is mostly vegetated with a dense forest dominated by Douglas fir (Pseudotsuga menziesii) and pacific madrone (Arbutus menziesii) with a dense understory of ocean spray (Holodiscus discolor) and salal (Gaultheria shallon) (Photoplates 1 and 3). The forest surrounds the clearing on three sides with the west side composed of mowed grasses beneath five large Douglas fir trees (Photoplates 2 and 3). The shoreline bank is about 20 feet high and is mostly vegetated with grasses and scattered Scot's broom (Cytisus scoparius) and Oregon grape (Mahonia nervosa) (Photoplate 4). The shoreline bank along this section of Marrowstone Island is mostly bare of vegetation or is dominated by grasses that do not provide overhanging shade cover (Figure 7). The vegetation visible on the photos in Figure 7 is growing on top of the medium bank, which provides perching Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 1 March 2014 habitat for some bird species. The beach is mostly composed of cobble across the upper tidal limits with sand at the lower limits (Photoplate 4). There is little driftwood or other features available for wildlife species along this section of beach. No other critical areas are present on or within 300 feet of this property. HABITAT AND CRITICAL AREAS MAPPING JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING The Jefferson County Critical Area and Habitat Maps viewed through the on-line mapping website were used to determine the shoreline designation, identify the extent of wetlands mapped in the area, identify whether fish and wildlife habitat areas were present, and to determine the extent of the floodplain designation. The shoreline, wetlands, and stream map (Figure 4) indicates that the shoreline along this property is designated as Conservancy and wetlands are mapped within the shoreline area adjacent to the property. The shoreline area is composed of cobble and sandy beach with no wetland areas within 300 feet of the property. There are no streams indicated on the map. The wildlife and habitat mapping (Figure 5) does not show habitat or wildlife within this area of Marrowstone Island. Habitat circles are indicated northeast, southeast, south, and west of Nordland. The FEMA designation maps (Figure 6) indicate there is a Type A flood zone within Kilisut Harbor, but no flood zones are indicated on the property. WASHINGTON DEPARTMENT OF FISH AND WILDLIFE,PRIORITY HABITATS AND SPECIES The Washington Department of Fish and Wildlife Priority and Habitat and Species Maps (WDFW 2014) indicate the presence of several priority habitat and species areas in the shoreline area along this property. The spawning areas for surf smelt, sand lance, and Pacific herring are mapped along the shoreline adjacent to this property. Diving duck and brant wintering areas are mapped within Kilisut Harbor north and south of the property. Eagle nests are mapped to the south and west with most nests located along the eastern shore of Indian Island. The property is outside the 660-foot nest buffer of all mapped nests. There are no marbled murrelet or spotted owl sites or habitat mapped in the vicinity of Indian and Marrowstone Islands. There are no seal or sea lion haul-out areas mapped on or adjacent to this property. The mapping indicates hardshell intertidal clam and Dungeness crab habitat within Kilisut Harbor. DEPARTMENT OF ECOLOGY COASTAL MAPPING According to the Department of Ecology Coastal Atlas, patchy eelgrass beds are present along the shoreline of this property. Eelgrass was not observed in the wrack on the subject property and no beds were observed during the site visit on March 12, 2014. LISTED SPECIES AND HABITATS IN THE PROJECT VICINITY The potential presence of listed species, including fish, bird, and mammals that have a primary association with the habitat on or adjacent to the project area was evaluated by a site visit, aerial photographs, the WDFW Priority Habitats and Species data search (WDFW 2014), the U.S. Fish and Wildlife Service (USFWS 2014) website, the National Marine Fisheries Service website (NMFS 2011), and the Washington Department of Natural Resources Natural Heritage website (WDNR 2014). Listed fish, bird, and mammals were not observed within the immediate area of Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 2 March 2014 the subject property during the March 12, 2014 site visit. The listed fish species are known within Kilisut Harbor are assumed present at sometimes of the year despite not being seen during the field visit. There are no habitat features available on Marrowstone Island for the listed bird and mammal species and they are not likely found on or in the vicinity of the property. A distinct group of Pacific salmon. 2)DPS—Distinct Population Unit. 3)Endangered-In danger of becoming extinct or extirpated;Threatened-Likely to become endangered within the foreseeable future throughout all or a significant portion of its range and that has been formally listed as such in the Federal Register under the Federal Endangered Species Act; Sensitive - Vulnerable or declining and could become Endangered or Threatened in the state; Species of Concern-An unofficial status,the species appears to be in jeopardy,but insufficient information to support listing. 4)NOAA 2011 FISH AND WHALES According to the National Marine Fisheries Service (NMFS) website, there are four listed ESUs/DPSs of salmon, steelhead, and bull trout in the project area. These species are found within the marine waters of Port Townsend Bay and Kilisut Harbor. Maps were not consulted to identify the use of the area by these fish species as they are known to be present. There is no freshwater spawning or rearing areas on or adjacent to this property. Kilisut Harbor lies between Marrowstone and Indian Islands and there is an isthmus at the head of the harbor that allows passage by salmonids, but the opening may be too narrow and shallow to allow access to the harbor by whales. Therefore, the likelihood of whales within Kilisut Harbor is very low. BIRDS Research conducted for this project shows that the property is not within habitat or management areas for spotted owl, marbled murrelet, and short-tailed albatross (WDFW-PHS 2014). The listed bird species are not likely found in the vicinity of the subject property because there are no Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 3 March 2014 old growth forested areas immediately adjacent to the property and no other specific habitat features are available in the vicinity, except marine waters for marbled murrelet. Short-tailed albatross is found primarily along the coast of Washington State and does not occur in the vicinity of Nordland. PLANTS The Washington Department of Natural Resources, Natural Heritage Program website (WANHP 2013) lists 28 rare plant species that occur within Jefferson County. Most of these species are at high elevations (montane to alpine) or are associated with freshwater systems such as rivers, streams and lakes, and some are associated with bogs. None of the species listed have potential to occur on or near the subject property. Patchy eelgrass beds are mapped by the Washington Department of Ecology Coastal Atlas (DOECA, 2014) along the shoreline adjacent to the subject property. Eelgrass was not observed in the wrack on the beach and no beds were observed during the field visit. The absence of eelgrass may be attributable to seasonal conditions and are likely present during the spring and summer growing season. CRITICAL HABITAT Critical habitat for Chinook, steelhead, and bull trout, and whales is present within Port Townsend Bay and Kilisut Harbor (Federal Register 2005 and NMFS 2011). Although Kilisut Harbor is part of critical habitat for humpback whale and orcas, it likely is not used by the whale species because of the isthmus at the north end and shallow waters at the head of the harbor. POTENTIAL EFFECTS OF THE PROJECT ON LISTED SPECIES AND HABITAT DIRECT EFFECTS AND INDIRECT EFFECTS FEMA flood zone is mapped along the shoreline (Figure 6), but because of the height of the shoreline bank, there is no potential for tidal flooding on this property. Therefore, the proposed buffer reduction will not have a negative impact on habitat within the mapped flood zone area. The subject property does not represent habitat nor does it have habitat features for any of the listed species as indicated in the wildlife and habitat searches and field work conducted for this project. Most of the habitat available in the vicinity of the property lies within Kilisut Harbor and on portions of Indian Island, which lies west of the harbor. Homesite activities proposed on this property will take place landward of the ordinary high water line so will not affect habitat within marine waters. No effects on listed species and critical/priority habitats are anticipated with the construction of a single family home on this property. All components of this project will be at least 117.5 feet from the ordinary high water line and while clearing of upland forest will be necessary, dense forested vegetation will remain within the reduced buffer to provide noise and light screening from the future home. Plant expansion from the adjacent forested area is expected across the buffer clearing to further improve buffer conditions. Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 4 March 2014 The proposed home will be situated further from the shoreline than homes to the north and south (Figure 2) and will maintain greater vegetation within the buffer than both adjacent properties. There will be no surface water impact to Kilisut Harbor or Port Townsend Bay as a result of this project because the project will maintain at least 117.5 feet of vegetated buffer between the critical area and the future homesite. There will be no change to the noise levels generated on the property as the site activities will not change as a result of this project. Noise levels will be temporarily higher during homesite construction, but once the home is completed, the noise level will return to normal and will not have significant noise impact on the adjacent critical areas. IMPACT AVOIDANCE AND MINIMIZATION MEASURES Impact avoidance and minimization measures include sighting the homesite at least 117.5 feet from the shoreline. Vegetation removal will be necessary to construct the home and drainfield outside the reduced buffer, but no vegetation removal will take place within the reduced buffer. Large trees will remain in the buffer and the dense vegetation in the understory will minimize potential future noise and light impacts. Trees will remain along the top of the shoreline bank to provide perching habitat for local species. One of the trees has a broken top and is likely used for perching by the local eagle population and will remain in place to allow its continued use. HABITAT MANAGEMENT RECOMMENDATIONS There will be no negative impacts to wildlife species or habitat utilized by local listed and sensitive species as a result of the reduced buffer. Therefore, habitat management recommendations focus on maintaining the existing vegetation and allowing spread of additional species within the reduced buffer to improve upon the high quality vegetation remaining in the buffer. 1. Maintain the existing Douglas fir trees along the top of the shoreline bank. These trees provide habitat for local species including perching for bald eagles as well as other predatory birds. Maintain other tall trees with the buffer including many pacific madrone. 2. Snowberry (Symphoricarpos albus) and Oregon grape were observed beneath to pacific madrona trees near the buffer edge. These species in addition to the ocean spray, salal, red flowering currant (Ribes sanguineum), Nootka rose (Rosa nutkana), and other native species, will be allowed to spread across the historic clearing. 3. English ivy (Hedera helix) and Scot's broom as well as other non-native species, shall be removed from the reduced buffer. 4. As the vegetation develops in the reduced buffer and cleared area, maintain a narrow path to access the shoreline on foot for recreational uses. A picnic table is currently located near the northwest corner of the property and this area will be maintained to allow enjoyment of the shoreline area and views from the property. The spread of vegetation across the cleared portion of the buffer is expected to occur naturally due to the extent and density of native vegetation occurring in the vegetated areas of the site and reduced buffer. Monitoring is proposed for a period of five years to track the spread of species in the reduced buffer and especially within the clearing. The monitoring plan will involve tracking the spread of native plants and low coverage/elimination of invasive plant species Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan . 5 March 2014 within the reduced buffer. The spread of plants is currently coming from all directions so the focus of the monitoring will be increasing coverage within the cleared area. The greatest source of new plant material from seeds and spread of roots comes from the forest south of the clearing so the monitoring plan will focus on the spread of new plants from the south. • Monitoring will track the expansion of native plants in increments of 5 feet per year. Native plants expected to spread from the south include ocean spray, salal, Nootka rose, snowberry, Oregon grape, and red flowering currant. The yearly spread from the south is proposed as follows: Year 1: New native plants five feet from the existing forest. Year 2: New native plants ten feet from the existing forest. Year 3: New native plants fifteen feet from the existing forest. Year 4: New native plants twenty feet from the existing forest. Year 5: New native plants twenty-five feet from the existing forest. • Monitoring will also include tracking the cover by non-native invasive plant species (Scot's broom, English ivy, Himalayan blackberry). There should be less than 10 percent cover by invasive species over the five year monitoring period. • Plant spread is difficult to predict because conditions may change over time, but if the plant spread occurs more rapidly than expected and the maximum width of 25 feet is reached before the end of year five, the monitoring requirement should be considered complete and no additional monitoring shall be required. • Any additional spread from other directions will be over and above the listed incremental increase from the south. • If plant spread is not taking place as expected, five native plants shall be obtained from a local native plant nursery and installed in the buffer area. Species for installation shall include snowberry, ocean spray, Oregon grape, salal, or red flowering currant. • Spread of shrubs is desired in the cleared buffer area and any trees within the cleared area will be removed. • The portion of the driveway within the buffer shall be maintained as a foot path and a narrow path will be maintained across the clearing. • Yearly photos and measurements will be recorded by the property owner and submitted to Jefferson County Department of Community Development by December 31st of each year. Photos will be taken to show the spread of native plants across the clearing and will mainly show the incremental spread from the south. Additional photos may be included to document spread of plants from other areas. CONCLUSION This project involves reducing the FWCHA buffer from 150 feet to 117.5 feet to accommodate construction of a single family home and septic system. The property is constrained by the 150- foot buffer and the septic system location so the reduction is necessary to accommodate the homesite. The project should have minimal impact on the FWCHA because most of the buffer is being maintained and construction activities will require removal of native vegetation only outside the reduced buffer. The reduced buffer will be maintained as it currently exists except that the spreading native plants will be allowed to continue their spread across the existing clearing to encourage development of a dense shrub layer in the entire reduced buffer. Habitat Management Plan ii March 2014 INTRODUCTION Ecological Land Services, Inc. (ELS) has completed this Habitat Management Plan on behalf of the property owners, Mike and Lynne Sweeney, for the construction of a single family home within the 150-foot buffer of a Fish and Wildlife Habitat Conservation Area (FWHCA). The FWHCA adjacent to this property is a saltwater shoreline within Port Townsend Bay. The subject property consists of Tax Parcel No. 953700412, which totals 1.13 acres. An ELS biologist conducted a site visit on March 12, 2014 to inventory site conditions in preparation of this Habitat Management Plan as required under Jefferson County Code (JCC), Unified Development Code Chapter 18.22 Critical Areas, Article VI; Fish and Wildlife Habitat Conservation Area. PROJECT DESCRIPTION PROJECT LOCATION The subject property is located on the west side of Flagler Road north of Nordland, Washington, within Section 29, Township 30 North, Range 1 East of the Willamette Meridian (Figure 1). It is situated on the west side of Marrowstone Island and faces Indian Island. CONSTRUCTION ACTIVITIES The proposed project consists of construction of a single family home and installation of a septic system in the eastern 2/3s of the property (Figure 2). The homesite will be situated along the existing driveway and just northwest of the septic system, which is proposed near the southeast corner of the property. Most of the buildable area mapped on Figure 2 is composed of upland conifer forest with a dense shrub understory (Figure 3). Because the property is constrained by FWHCA and buffer, the project is proposing to reduce the required 150-foot buffer to 117.5 feet to accommodate the building site (Figure 2). SITE CONDITIONS This property is rectangular in shape and lies west of Flagler Road. The west line abuts the shoreline of Kilisut Harbor, which lies between Indian Island and Marrowstone Island. It is currently vacant, but was previously used as a recreational property with a driveway entering the northeast corner and extending to a clearing on the west end (Figures 2 and 3, Photoplates 1 and 5). A low platform was located in the cleared area and used for tent camping. The property is level to gently undulating across the eastern 2/3s and slopes gradually down to the top of the shoreline bank in the western 1/3. The property is mostly vegetated with a dense forest dominated by Douglas fir (Pseudotsuga menziesii) and pacific madrone (Arbutus menziesii) with a dense understory of ocean spray (Holodiscus discolor) and salal (Gaultheria shallon) (Photoplates 1 and 3). The forest surrounds the clearing on three sides with the west side composed of mowed grasses beneath five large Douglas fir trees (Photoplates 2 and 3). The shoreline bank is about 20 feet high and is mostly vegetated with grasses and scattered Scot's broom(Cytisus scoparius) and Oregon grape (Mahonia nervosa) (Photoplate 4). The shoreline bank along this section of Marrowstone Island is mostly bare of vegetation or is dominated by grasses that do not provide overhanging shade cover (Figure 7). The vegetation visible on the photos in Figure 7 is growing on top of the medium bank, which provides perching Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan l March 2014 habitat for some bird species. The beach is mostly composed of cobble across the upper tidal limits with sand at the lower limits (Photoplate 4). There is little driftwood or other features available for wildlife species along this section of beach. No other critical areas are present on or within 300 feet of this property. HABITAT AND CRITICAL AREAS MAPPING JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING The Jefferson County Critical Area and Habitat Maps viewed through the on-line mapping website were used to determine the shoreline designation, identify the extent of wetlands mapped in the area, identify whether fish and wildlife habitat areas were present, and to determine the extent of the floodplain designation. The shoreline, wetlands, and stream map (Figure 4) indicates that the shoreline along this property is designated as Conservancy and wetlands are mapped within the shoreline area adjacent to the property. The shoreline area is composed of cobble and sandy beach with no wetland areas within 300 feet of the property. There are no streams indicated on the map. The wildlife and habitat mapping (Figure 5) does not show habitat or wildlife within this area of Marrowstone Island. Habitat circles are indicated northeast, southeast, south, and west of Nordland. The FEMA designation maps (Figure 6) indicate there is a Type A flood zone within Kilisut Harbor, but no flood zones are indicated on the property. WASHINGTON DEPARTMENT OF FISH AND WILDLIFE,PRIORITY HABITATS AND SPECIES The Washington Department of Fish and Wildlife Priority and Habitat and Species Maps (WDFW 2014) indicate the presence of several priority habitat and species areas in the shoreline area along this property. The spawning areas for surf smelt, sand lance, and Pacific herring are mapped along the shoreline adjacent to this property. Diving duck and brant wintering areas are mapped within Kilisut Harbor north and south of the property. Eagle nests are mapped to the south and west with most nests located along the eastern shore of Indian Island. The property is outside the 660-foot nest buffer of all mapped nests. There are no marbled murrelet or spotted owl sites or habitat mapped in the vicinity of Indian and Marrowstone Islands. There are no seal or sea lion haul-out areas mapped on or adjacent to this property. The mapping indicates hardshell intertidal clam and Dungeness crab habitat within Kilisut Harbor. DEPARTMENT OF ECOLOGY COASTAL MAPPING According to the Department of Ecology Coastal Atlas, patchy eelgrass beds are present along the shoreline of this property. Eelgrass was not observed in the wrack on the subject property and no beds were observed during the site visit on March 12, 2014. LISTED SPECIES AND HABITATS IN THE PROJECT VICINITY The potential presence of listed species, including fish, bird, and mammals that have a primary association with the habitat on or adjacent to the project area was evaluated by a site visit, aerial photographs, the WDFW Priority Habitats and Species data search (WDFW 2014), the U.S. Fish and Wildlife Service (USFWS 2014) website, the National Marine Fisheries Service website (NMFS 2011), and the Washington Department of Natural Resources Natural Heritage website (WDNR 2014). Listed fish, bird, and mammals were not observed within the immediate area of Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 2 March 2014 the subject property during the March 12, 2014 site visit. The listed fish species are known within Kilisut Harbor are assumed present at sometimes of the year despite not being seen during the field visit. There are no habitat features available on Marrowstone Island for the listed bird and mammal species and they are not likely found on or in the vicinity of the property. These species are found within the marine waters of Port Townsend Bay and Kilisut Harbor. Maps were not consulted to identify the use of the area by these fish species as they are known to be present. There is no freshwater spawning or rearing areas on or adjacent to this property. Kilisut Harbor lies between Marrowstone and Indian Islands and there is an isthmus at the head of the harbor that allows passage by salmonids, but the opening may be too narrow and shallow to allow access to the harbor by whales. Therefore, the likelihood of whales within Kilisut Harbor is very low. BIRDS Research conducted for this project shows that the property is not within habitat or management areas for spotted owl, marbled murrelet, and short-tailed albatross (WDFW-PHS 2014). The listed bird species are not likely found in the vicinity of the subject property because there are no Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 3 March 2014 old growth forested areas immediately adjacent to the property and no other specific habitat features are available in the vicinity, except marine waters for marbled murrelet. Short-tailed albatross is found primarily along the coast of Washington State and does not occur in the vicinity of Nordland. PLANTS The Washington Department of Natural Resources, Natural Heritage Program website (WANHP 2013) lists 28 rare plant species that occur within Jefferson County. Most of these species are at high elevations (montane to alpine) or are associated with freshwater systems such as rivers, streams and lakes, and some are associated with bogs. None of the species listed have potential to occur on or near the subject property. Patchy eelgrass beds are mapped by the Washington Department of Ecology Coastal Atlas (DOECA, 2014) along the shoreline adjacent to the subject property. Eelgrass was not observed in the wrack on the beach and no beds were observed during the field visit. The absence of eelgrass may be attributable to seasonal conditions and are likely present during the spring and summer growing season. CRITICAL HABITAT Critical habitat for Chinook, steelhead, and bull trout, and whales is present within Port Townsend Bay and Kilisut Harbor (Federal Register 2005 and NMFS 2011). Although Kilisut Harbor is part of critical habitat for humpback whale and orcas, it likely is not used by the whale species because of the isthmus at the north end and shallow waters at the head of the harbor. POTENTIAL EFFECTS OF THE PROJECT ON LISTED SPECIES AND HABITAT DIRECT EFFECTS AND INDIRECT EFFECTS FEMA flood zone is mapped along the shoreline (Figure 6), but because of the height of the shoreline bank, there is no potential for tidal flooding on this property. Therefore, the proposed buffer reduction will not have a negative impact on habitat within the mapped flood zone area. The subject property does not represent habitat nor does it have habitat features for any of the listed species as indicated in the wildlife and habitat searches and field work conducted for this project. Most of the habitat available in the vicinity of the property lies within Kilisut Harbor and on portions of Indian Island, which lies west of the harbor. Homesite activities proposed on this property will take place landward of the ordinary high water line so will not affect habitat within marine waters. No effects on listed species and critical/priority habitats are anticipated with the construction of a single family home on this property. All components of this project will be at least 117.5 feet from the ordinary high water line and while clearing of upland forest will be necessary, dense forested vegetation will remain within the reduced buffer to provide noise and light screening from the future home. Plant expansion from the adjacent forested area is expected across the buffer clearing to further improve buffer conditions. Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 4 March 2014 Awl The proposed home will be situated further from the shoreline than homes to the north and south (Figure 2) and will maintain greater vegetation within the buffer than both adjacent properties. There will be no surface water impact to Kilisut Harbor or Port Townsend Bay as a result of this project because the project will maintain at least 117.5 feet of vegetated buffer between the critical area and the future homesite. There will be no change to the noise levels generated on the property as the site activities will not change as a result of this project. Noise levels will be temporarily higher during homesite construction, but once the home is completed, the noise level will return to normal and will not have significant noise impact on the adjacent critical areas. IMPACT AVOIDANCE AND MINIMIZATION MEASURES Impact avoidance and minimization measures include sighting the homesite at least 117.5 feet from the shoreline. Vegetation removal will be necessary to construct the home and drainfield outside the reduced buffer, but no vegetation removal will take place within the reduced buffer. Large trees will remain in the buffer and the dense vegetation in the understory will minimize potential future noise and light impacts. Trees will remain along the top of the shoreline bank to provide perching habitat for local species. One of the trees has a broken top and is likely used for perching by the local eagle population and will remain in place to allow its continued use. HABITAT MANAGEMENT RECOMMENDATIONS There will be no negative impacts to wildlife species or habitat utilized by local listed and sensitive species as a result of the reduced buffer. Therefore, habitat management recommendations focus on maintaining the existing vegetation and allowing spread of additional species within the reduced buffer to improve upon the high quality vegetation remaining in the buffer. 1. Maintain the existing Douglas fir trees along the top of the shoreline bank. These trees provide habitat for local species including perching for bald eagles as well as other predatory birds. Maintain other tall trees with the buffer including many pacific madrone. 2. Snowberry (Symphoricarpos albus) and Oregon grape were observed beneath to pacific madrona trees near the buffer edge. These species in addition to the ocean spray, salal, red flowering currant (Ribes sanguineum), Nootka rose (Rosa nutkana), and other native species, will be allowed to spread across the historic clearing. 3. English ivy(Hedera helix) and Scot's broom as well as other non-native species, shall be removed from the reduced buffer. 4. As the vegetation develops in the reduced buffer and cleared area, maintain a narrow path to access the shoreline on foot for recreational uses. A picnic table is currently located near the northwest corner of the property and this area will be maintained to allow enjoyment of the shoreline area and views from the property. The spread of vegetation across the cleared portion of the buffer is expected to occur naturally due to the extent and density of native vegetation occurring in the vegetated areas of the site and reduced buffer. Monitoring is proposed for a period of five years to track the spread of species in the reduced buffer and especially within the clearing. The monitoring plan will involve tracking the spread of native plants and low coverage/elimination of invasive plant species Flagler Road Property Ecological Land Services,Inc. Habitat Management Plan 5 March 2014 within the reduced buffer. The spread of plants is currently coming from all directions so the focus of the monitoring will be increasing coverage within the cleared area. The greatest source of new plant material from seeds and spread of roots comes from the forest south of the clearing so the monitoring plan will focus on the spread of new plants from the south. • Monitoring will track the expansion of native plants in increments of 5 feet per year. Native plants expected to spread from the south include ocean spray, salal, Nootka rose, snowberry, Oregon grape, and red flowering currant. The yearly spread from the south is proposed as follows: Year 1: New native plants five feet from the existing forest. Year 2: New native plants ten feet from the existing forest. Year 3: New native plants fifteen feet from the existing forest. Year 4: New native plants twenty feet from the existing forest. Year 5: New native plants twenty-five feet from the existing forest. • Monitoring will also include tracking the cover by non-native invasive plant species (Scot's broom, English ivy, Himalayan blackberry). There should be less than 10 percent cover by invasive species over the five year monitoring period. • Plant spread is difficult to predict because conditions may change over time, but if the plant spread occurs more rapidly than expected and the maximum width of 25 feet is reached before the end of year five, the monitoring requirement should be considered complete and no additional monitoring shall be required. • Any additional spread from other directions will be over and above the listed incremental increase from the south. • If plant spread is not taking place as expected, five native plants shall be obtained from a local native plant nursery and installed in the buffer area. Species for installation shall include snowberry, ocean spray, Oregon grape, salal, or red flowering currant. • Spread of shrubs is desired in the cleared buffer area and any trees within the cleared area will be removed. • The portion of the driveway within the buffer shall be maintained as a foot path and a narrow path will be maintained across the clearing. • Yearly photos and measurements will be recorded by the property owner and submitted to Jefferson County Department of Community Development by December 31st of each year. Photos will be taken to show the spread of native plants across the clearing and will mainly show the incremental spread from the south. Additional photos may be included to document spread of plants from other areas. CONCLUSION This project involves reducing the FWCHA buffer from 150 feet to 117.5 feet to accommodate construction of a single family home and septic system. The property is constrained by the 150- foot buffer and the septic system location so the reduction is necessary to accommodate the homesite. The project should have minimal impact on the FWCHA because most of the buffer is being maintained and construction activities will require removal of native vegetation only outside the reduced buffer. The reduced buffer will be maintained as it currently exists except that the spreading native plants will be allowed to continue their spread across the existing clearing to encourage development of a dense shrub layer in the entire reduced buffer. The purpose of this geology evaluation was to determine the suitability of the property for the siting of a residence, evaluate the risk of slope failures and provide general site development and maintenance recommendations for development of the property adjacent to a potentially unstable bluff. This evaluation included a visual inspection of the property and vicinity, a visual inspection of the bluff face, review of available geologic mapping in the area, and inspection of the shoreline at the base of the bluff. Based on my assessment of the site and geology,a home built on the site should be setback at least 40 feet from the top edge of the shoreline bluff. From a geologic perspective this distance will provide adequate protection to the proposed home over the life of the structure(100 years). However, as this is a shoreline property,the setback distance may be dictated by adjoining home sites so that there is limited interference with views. SCOPE OF SERVICES The scope of our services included the following: 1) Conducted a site visit to visually inspect the subject property including the bluff face slope conditions, shoreline conditions, and relevant conditions in the vicinity of the property. 2) Observed surface soil conditions on the bluff face and on the uplands above the bluff by excavating shallow hand dug test pits. 3) Prepared this report summarizing our findings, including an evaluation of the feasibility of building a residence on the subject property, a qualitative evaluation of the shoreline bluff stability, recommendations for site development, and recommendations for further investigation, if necessary. December 10,2013 Parcel Number 953700412,Flagler Road,Norland,WA Geology Hazard Assessment GENERAL GEOLOGY The Surficial Geologic Map of the Port Townsend 30 by 60 Quadrangle, Puget Sound Region, Washington(Pessl, Dethier, Booth and Minard, 1989) indicates the steep shoreline bluff exposed on the subject property is underlain by glacial till. Observations on the bluff face on the subject property and on the bluff face in the vicinity of the property are consistent with the mapping described above; however, due to map scale the soils underlying the bluff slope are not depicted and the bluff consists primarily of advance glacial outwash and ice contact deposits with no definitive till. The till consists of very poorly sorted sediments ranging from clay to boulders deposited directly by glacial ice approximately 15,000 years ago when glacial ice covered the Puget lowlands. Till at this location is somewhat sandy due to the underlying units being predominantly sand. The advance glacial outwash on the bluff face consists of poorly to well sorted sand and gravels deposited by melt water streams associated with the advancing glacial ice approximately 18,000 years ago. SPECIFIC SITE OBSERVATIONS The property consists of very gentle sloping upland area that slopes to the west from Flagler Road to the top of a shoreline bluff. The shoreline bluff is approximately 25 feet high. The upland area is covered primarily with Douglas fir with a few madrone trees and a thick understory of a variety of vegetation.A dirt road provides access to the site from Flagler Road The overall slope of the steep shoreline bluff averages approximately 45 degrees; however, there a few areas that are steeper and areas that are less steep. The bluff slopes consist of compact sand and gravel layers with the uppermost portion of the bluff consisting of silty sand and gravel that appears to be glacial drift due to the very poor sorting of sediment. The steep shoreline bluff shows evidence of recent ravel and small scale sliding and erosion that is in part from wind and in part from foot traffic including deer. Areas of bare soil and areas that are grass and brush covered are located on the slope. A set of wooden stairs traverses the lower portion of the bluff and an anchored ladder is located on the slope above the stairs. The shoreline at the base of the bluff can be accessed using this route, but there are also other steep path-like areas on the bluff slope of the subject property. The bluff is periodically eroded by wave action that undermines the base of the bluff. However, the beach at the base of the bluff is fairly built up such that high water reaching the toe of the Stratum Group File:10.31.13 2 December 10,2013 Parcel Number 953700412,Flagler Road,Norland,WA Geology Hazard Assessment steep shoreline bluff slope is very infrequent and likely occurs less often than even an annual basis based on the condition of vegetation established on the upper beach and stable drift wood. The beach consists of sand and gravel and net drift is towards the north. The beach along this reach of shoreline is in good condition and there are very few armored sections along the base of the bluff. Very little recent toe of bluff erosion is evident along this shoreline reach, but slope ravel and minor small scale slides are present. CONCLUSIONS AND RECOMMENDATIONS Based on my visual inspection of the subject property and vicinity, I conclude that a residence can be located on the upland portion of the property such that bluff erosion or landsliding would not threaten the structure within the expected life of the structure(100 years) as long as the recommendations presented below are followed. The residence should be located at least 40 feet from the top of the shoreline bluff. This distance will be adequate to provide protection for a residence for at least 100 years even if an erosion rate of 4 inches per year is used. It is my opinion that this rate of erosion is very conservative and is likely much less rapid. Please note that this setback distance may be precluded by shoreline setback regulations which may require a greater setback. I do not anticipate that the development of the subject property will cause any negative impacts on the stability of the slopes or the shoreline bluff as long as the following recommendations are followed. Because the bluff is an eroding bluff, slope failures should be expected to occur on a periodic basis. The only way to prevent continued erosion of the base of the bluff is to construct hard armoring at the shoreline at the base of the bluff. However,the eroding bluff acts as a feeder bluff(erosion of the bluff provides sediment) for the beaches north of the subject property, and any shoreline armoring will have a negative impact on properties down drift from the bluff. The construction of shoreline armoring on other properties may cause an increase of erosion of the subject property. The owner of the subject property should contact Jefferson County officials regarding any proposed shoreline protection projects along the bluff or any shoreline protection construction. There are currently few shoreline-armored areas along this stretch of coastline. All storm water drainage should be directed away from the top of the bluff and should be dispersed and infiltrated into the ground as much as practical through splash blocks or level dispersion spreaders or dispersion trenches. Bluff erosion and stability at this site is driven by shoreline process. If not for the erosion at the base of the bluff,the bluff would be reach an angle of repose and stabilize. The rate of shoreline erosion may be reduced if trees are left within the established setback from the top of the steep slope. Large trees within landslide debris can effectively protect the base of the slope from erosion for long periods of time.At least one tree per 30-foot center should be left within the geology setback area. Trees left within the setback area can be limbed for view purposes. The septic drain fields should be located at least 60 feet back from the top of the steep slope. The minor volume of water from a household drain field will not cause slope stability problems at this site. The septic drain field should not cause problems for slope stability, as the general slope direction of the upland portion of the property will not direct drainage towards the top of the bluff. Please note that there are inherent risks associated with building on lots near or adjacent to steep slopes. These are risks that the building owner should recognize and be willing to accept.
