KBCA 1760 KALA POINT DR PORT TOWNSEND WA 98368 DATE ISSUED: November 05,2014 DATE EXPIRES: November 05,2015 MLA NUMBER:MLA14-00084 PROJECT PLANNER:Anna Bausher PROJECT DESCRIPTION: TREE TRIMMING PROJECT LOCATION: Parcel Number: 965 300 099, Section 26, Township 30N, Range 1W, located off of Kala Point Drive, Port Townsend, WA 98368 CONDITIONS: 1.) All recommendations as set forth in the Arbortist Report prepared by Dan Field,submitted on October 13, 2014, shall be conditions of this permit.The report numerically specified the two proposed trees for vegetation removal as followes: "Both trees can be pruned as requested. (Removal of 2-3 limbs from the 2 trees in question)After, no further limbing should be done on Tree 1 for at least a couple of years since it was limbed last year". 2.) The project shall adhere to the Best Management Practices(BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on October 27, 2014 for the potential presence of Environmentally Sensitive Areas(ESAs)under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Stable and Unstable Shoreline Slope Stability, Slight Landslide Hazard, Susceptible and Special Aquifer Recharge Protection Area,At Risk Seawater Intrusion Zone. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge(primarily through rainfall)and the rate of groundwater withdrawals (primarily through wells).The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 7.) The parcel is located within an At Risk SIPZ (seawater intrusion protection zone)according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy (Resolution 61-02, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. An At Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses between 100 mg/L and 200 mg/L(milligrams per liter). 8.) Critical Aquifer Recharge Areas are defined as Seawater Intrusion Areas, and Special Aquifer Recharge Protection Areas and the following land uses located within Susceptible Aquifer Recharge Areas (1)All Industria Land Uses (2)All Commercial Uses (3)All Rural Residential Land Uses requiring a Discretionary Use or Conditional Use Permit(4)All Rural Residential Land Uses with nonconforming uses that would otherwise require a Discretionary Use or Conditional Use Permit(5) Unsewered Planned Rural Residential Developments (6) Unsewered residential development with gross densities greater than one unit per acre. All of the above listed uses shall be subject to the applicable requirements and standards of the Jefferson County Unified Development Code. 9.) The site plan as submitted with the Tree Vegetation Removal Permit application on October 13, 2014 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated November 5, 2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) This approval is for tree pruning only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 11.) A Special Report(Arborist Report)was submitted in conjunction with the application to address the tree pruning and vitility of the trees in question. Given the level of pruning requested in this application, the Arborist Report as submitted on October 13, 2014 prepared by Dan Field is acceptable. 12.) This parcel is within a no shooting area per JCC 8.50. 13.) The parcel has been designated as RR1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 14.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. The intention is to restore water views for owners within Kala Bluff Condominium Association (KBCA) through what we term view "Corridor C." KBCA is a sub-association within Kala Point. CONTINUED ON THE BACK OF THIS PAGE. ALSO SEE ATTACHED ORIGINAL CAM MAPS. • Location of trees: See attached Map 1 for approximate locations. Both trees are on KBCA property associated with parcel #965300025. Tree #2 is approximately 2 feet within KBCA's property, which abuts Kala Point's parcel #965000348 (See Photo 1). And Tree #1. is approximately 15' further landward and approximately 20' from the edge of the KBCA condominium deck (See Photos 2 and 3). Vegetation in this area is considerable, as the Geotech report also underscores. 'j�6es /06.__44c4/4/ Cfv S 30do et 9 Anna Bausher's previous review of the shoreline: On 9/16/14 Anna Bausher completed a preliminary CAM review (see attached) and concluded that the KBCA parcel #965300025 "appears to be outside shoreline jurisdiction (200 feet from the ordinary high water mark)...." However, it also appears that this parcel is "at least partially within a geologically hazardous area or the buffer." The relevant geological assessment addresses this issue. The geological report on Zone 5: Regarding geological hazardousness, Kala Point's geotech report from March, 2012, by Shannon & Wilson, Inc. and Coastal Geologic Services (See relevant pages attached) confirms that the hazard in the area of the trees is very low. The conclusion on p. 19 reads: "We did not observe evidence of recent instability in this zone" (Bluff Zone 5) and "only minor toe erosion was observed in the north end of Zone 5 as it nears the more active Zone 4." Vegetation is "heavy on bluff face" (see Table 1, Zone 5, table attached) The trees for limbing are at the southern end of Zone 5, one of the most, if that the most, stable area on the Kala Point bluff shoreline. (See all 5 zone locations on the site plan by Shannon & Wilson attached) The trees' locations are at the southern end of Zone 5, the least hazardous part of that zone. The arborist report: In October of this year Dan Field, certified arborist, (See attached report) concluded that "both trees can be pruned as requested." Given this information, we believe the County's decision to allow light limbing of the two trees should be an easy one to make. Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 5.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drilled on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge(primarily through rainfall)and the rate of groundwater withdrawals(primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 6.) The parcel is located within an At Risk SIPZ(seawater intrusion protection zone)according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy(Resolution 61-02, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. An At Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses between 100 mg/L and 200 mg/L(milligrams per liter). 7.) All of the above listed uses shall be subject to the applicable requirements and standards of the Jefferson County Unified Development Code. 8.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code(UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 9.) Bluff Zone 4 appears to be the most unstable of the five zones;recent landslides extend between about 50 to 100 feet above beach level along nearly the entire length of this zone. The landslides extend nearly to the top of the bluff in places along this zone. We observed recent block fall from the Qgl layer, sloughing of sand units,as well as active erosion of exposed sand in the toe of the bluff face. Toe erosion is prevalent in Bluff Zone 4. 5.4.5 Bluff Zone 5 Bluff Zone 5 includes the area south of Bluff Zone 4 to the southern limit of the Kala Point development. Aside from minor sloughing of exposed faces at the far northern portion of Bluff Zone 5,we did not observe evidence of recent instability in this zone. The zone is mostly a barrier beach and encompasses the backshore coastal wetland and the spit at Kala Point. Dunegrass and small and large drift logs are present along this section of shoreline. Only very minor toe erosion was observed in the north end of Zone 5 as it nears the more active Zone 4. 6.0 FACTORS CONTROLLING SLOPE STABILITY AT KALA POINT Coastal bluffs of the Puget Lowland are in various states of instability owing to four primary factors that have been ongoing since the disappearance of glacial ice about 14,000 years ago and subsequent sea level rise to its present level about 4,500 to 5,000 years ago. • At the end of the Vashon stade, slopes were left in a steep and unstable condition when the ice buttressing the uplands melted. • The glacial sediments deposited prior to and during the last glacial episode contained interbedded layers of high and low permeability,resulting in the perching of groundwater and its delivery to steep slopes. • Climatic conditions result in a pronounced five-month winter wet season from November through March. ■ Shorelines are attacked by waves, causing erosion at the toe of steep slopes. In addition to the natural factors of slope destabilization,the imprint of human development has had an impact on the frequency of landsliding in the Puget Lowland.
