The application was reviewed by the Jefferson County Department of Community Development staff on May 28, 2003 for the potential presence of Environmentally Sensitive Areas(ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Type 4 Stream; Bald Eagle Habitat; Spotted Owl; Harlequin Duck; Slight and Moderate Landslide Hazard Area; and Susceptible Aquifer Recharge Area. 2.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 3.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 4.) Washington State Department of Fish and Wildlife Area Habitat Biologist reviewed the proposal for potential adverse impacts from the development pertaining to Spotted Owl and Harlequin Duck. WDFW in an e-mail dated June 9, 2003 commented that the surrounding forested areas show what habitat was likely on the property. WDFW also stated that it is difficult to assess impacts on the spotted owl and Harlequin duck. WDFW indicated that they would prefer to evaluate potential impacts on a property prior to clearing and grading of the site. 5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 6.) This approval is for a Pole Building Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 7.) A Boundary Line Adjustment(EXM96-0015)was reviewed and approved for the property to adjust common property boundaries with adjacent property. The BLA was approved March 21, 1996 and recorded under AFN 389624 with the Jefferson County Auditor's Office. 8.) The parcel is a legal non-conforming lot that is designated as Rural Residential (RR 1:5) under the Jefferson County Comprehensive Plan Land Use Map effective Aug. 28, 1998. 9.) A site visit was conducted by staff on June 30, 2003. The area of the property proposed for development is well beyond a defined landslide hazard area. A geotechnical report was not required or submitted for the new pole building garage. 10.) The identified Fish and Wildlife Habitat Area(Type 4 Stream), shall maintain a vegetative buffer setback of 100-feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM)to the pole building garage. 11.) An additional setback of five(5)feet is required from the edge of the buffer area to the proposed (enter proposal). 12.) The applicant has entered into an Eagle Management Plan with the Washington State Department of Fish and Wildlife. The plan was dated June 27, 2003. 13.) The applicant shall implement the conditions contained in the Bald Eagle Management Plan with the Washington State Department of Fish and Wildlife for parcel#702-272-023, dated June 27, 2003. 14.) The applicant is proposing to create or add 864 square feet of impervious surface and 900 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Stormwater Calculation Sheet. The applicant submitted a calculation sheet. 15.) The project shall adhere to the Best Management Practices(BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 16.) This parcel was created through the Log Cabin Inn Short Plat as recorded October 20, 1980, under Auditor's File Number 268536. Several surveys with boundary line adjustments were recorded, and the configuration of the parcel was recorded December 29, 1999 in Volume 21, Page 13, under Auditor's File Number 430019. 17.) Prior to and during approved nstruction activities, the perimeter of the laude hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer-Do not Remove or Alter Existing Vegetation." 18.) All construction activities shall not encroach upon the buffer. This includes the storage or preparation of materials. 19.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 20.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices(BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin (see attached). 21.) Minimum setback for structures from the easement line for Cougar Run shall be 20 feet.Minimum setback from the edge of the ingress/egree easement along the eastern property boundary that crosses through the parcel shall be 20-feet. Minimum setback from the northern property line not located next to an easement and the western parcel boundaries shall be 5-feet. 22.) The applicant shall follow WAC 222-10-042 in the Washington Forest Practices Rules, Board Manual, and RCW's is logging large portions of the parcel. 23.) This approval is for a Pole Building Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 24.) The site plan as submitted with the building permit application on May 19, 2003 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 19, 2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 25.) Maximum impervious surface area(a surface area that creates a barrier to the entry of water into the soil in comparision with natural conditions prior to development, or that causes water to runoff in greater quantitie4s or at an increased rate of flow in comparision withthe flow prior to development. Common impervious surfaces may or may not include roofs, driveways, patios, packed earth, and oiled surfaces; however, open uncovered retention/detention facilities are not considered as impervous surfaces)for parcel 702-272-023 shall be 5 feet. 26.)
