I know this is difficult for everyone involved, especially regulators who had this dumped in their laps. I have attached the WSLCB plan we have submitted and will be constrained to abide by. Please note that this plan does not include extraction of THC or CBDs via hydrocarbons or another method. We also have eliminated any edibles or other products that would need to be created in a kitchen. We also do not intend to make these products at 453 Otto Street in the future. The kitchen is too small, the regulations are too onerous (or not consistent), the WA Department of Agriculture is understaffed and unable to provide timely oversight, and that particular part of our operation has never been a key part of the business plan. I wanted it there"just in case,"but that desire seems to have put us into a time and expense bind that I believe will hurt our main objective: growing and packaging dried smokeable marijuana for wholesale distribution. When we reach capacity where extraction and/or the creation of edible products makes sense, we hope to have identified a more appropriate site in Jefferson County. The floor drain that opens to storm water system will be dealing with rain water only in our operation. No grape washing, no other use designated or planned Please let Larry and I know if this information means you can move the application along without further delay. Thanks for your help. The following g questions will help determine whether the proposed project is considered development or redevelopment. DEVELOPMENT v. REDEVELOPMENT / Divide the total existing impervious surface above by the size of the parcel and convert to a percentage: Lit/ Does the site have 35%or more of existing impervious surface? Circle: No FURTHER INSTRUCTIONS: If the answer is yes, the proposal is considered redevelopment and the attached Figure 2 should be used to determine the applicable Minimum Requirements. If the answer is no, the proposal is considered new development and the attached Figure 1 should be used. At this juncture, the applicant should refer to the applicable Flow Chart to determine the Minimum Requirements for stormwater management. DCD staff will help verify the classification of the project and the application requirements. For proponents of "small" projects who must comply only with Minimum Requirement #2—Construction Stormwater Pollution Prevention—an additional submittal is not required. The proponent is responsible for employing the 12 Elements to control erosion and prevent sediment and other pollutants from leaving the site during the construction phase of the project. Pick up the Construction Stormwater Pollution Prevention(SWPP) Best Management Practices(BMPs) Packet. Proponents of"medium"projects—those that must meet only Minimum Requirements #1 through #5—and for "large" projects—those that must meet all 10 Minimum Requirements—are required to submit a Stormwater Site Plan. DCD has prepared a submittal template of a Stormwater Site Plan, principally for rural residential projects. Complete the template in the Stormwater Site Plan Instructions and Submittal Template or prepare a Stormwater Site Plan using the step-by-step guidance in the Stormwater Management Manual. The findings and conclusions below support Jefferson County's comment that we do not object to the Marijuana Producer Tier 2 license and Marijuana Processor license. Findings: 1. License 417355-7A requests approval for designation as Marijuana Producer Tier 2 and Marijuana Processor. 2. Per the WSLCB website,a Marijuana Producer Tier 2 license allows the applicant at a specific location, "To produce marijuana for sale at wholesale to marijuana processor licensees and to other marijuana producer licensees. Tier 2 allows for between two thousand square feet and ten thousand square feet of dedicated plant canopy. Any entity and/or principals within an entity are limited to no more than three marijuana producer licenses." 3. Per the WSLCB website,a Marijuana Processor license allows the applicant at a specific location,"To process, package, and label usable marijuana and marijuana-infused products for sale at wholesale to marijuana retailers.Allowed to blend tested useable marijuana from multiple lots into a single package for sale to a marijuana retail licensee providing the label requirements for each lot used in the blend are met and the percentage by weight of each lot is also included on the label. Any entity and/or principals within an entity are limited to no more than three marijuana processor licenses. No licensee is allowed more than thirty-three percent of the allowed licenses in any county or city." 4. The subject property located at 543 Otto St Ste B, Port Townsend, WA 98368 is assigned the Assessor's Parcel Number,APN 001212021. 5. A portion of the subject property for the proposed license(s) is not within a possible exclusion zone based on the criteria of "The distance shall be measured as the shortest straight line distance from the property line of the licensed premises to the property line of an elementary or secondary school, playground, recreation center or facility, child care center, public park, public transit center, library or arcade where admission is not restricted to those age 21 and older." • • t s 11."" ¢tom, 6. The subject parcel located is zoned Light Industrial (LI.) 7. Agriculture activities including growing marijuana are an allowed use under any of the Comprehensive Plan land use designations, subject to the provisions of this JCC 18.20.030, except that "processing," "packing," and "sales" are regulated under JCC 18.20.030(3)Accessory Uses. 8. Per JCC 18.20.030(3)(c) Proposals that would be classified accessory uses in agricultural lands, such as processing, packing, and sales of agricultural products, may be considered and approved in other land use districts under different and appropriate land use classifications, such as commercial use, light industrial use, home business, cottage industry, or small-scale recreation and tourist use, subject to allowed and prohibited uses per land use district subject p p ct and the associated permit processes and approval criteria. 9. Accessory agricultural activities including marijuana processing, packaging and labeling in the LI Light Industrial zoning district may be allowed subject to a change of permit with a consistency g e use p tency review with SEPA as applicable and compliance with the Jefferson County Code. 10.Jefferson County has no record of application or issuance of a change of use permit with consistency review for the subject parcel located at 543 Otto St Ste B, Port Townsend, WA 98368. 11.Any structures proposed for processing, packaging or labeling of marijuana shall comply with Jefferson County Code including but not limited to critical area buffer and setback requirements per Chapter JCC 18.22 and building code standards per Chapter JCC 15.05. 12.Jefferson County has no record of application or issuance of a permit for construction or use of a structure for processing, packaging or labeling of marijuana. 13.All operations shall obtain all applicable permits and comply with all local and state requirements, including but not limited to building permits, land use approvals, water and septic approvals, and ORCAA air permit. 14.Given the security measures required by WAC 314-55-083 and multiple uses within multiple structures on the subject parcel, it is unclear how fencing and other security measures will be provided. It shall be the responsibility of the licensee to comply with all state standards. Conclusions: 1. Jefferson County has no objection to issuance of the Marijuana Producer Tier 2 license at 543 Otto St Ste B, Port Townsend,WA 98368. 2. Jefferson County has no objection to issuance of the Marijuana Processor license at 543 Otto St Ste B, Port Townsend, WA 98368. Jefferson County's comments are based upon information on record with Jefferson County Department of Community Development and provided by the Washington State Liquor Control Board to date. The County continues to be interested in the outcome of this project and requests the WSLCB continue to include Jefferson County as an interested party.
