The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 2.) A Stromwater Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the f installation of temporary sedimentation and erosion control measures have been completed. 3.) The proponent shall contact the Jefferson County Public Works Department at(360) 385-9160 for an inspection prior to backfilling the stormwater infiltration trenches. 4.) " In order to meet the requirements of the Jefferson County Unified Development Code and the Washington Department of Ecology Stormwater Management Manual for Western Washington Minimum Requirement#10 Operation and Maintenance and to ensure that the approved stormwater management facilities are appropriately maintained for the life of the project, Jefferson County requires the proponent to enter into a Stormwater Management Facility Maintenance Agreement with the County. The Department will send a copy of the Agreement that has been signed by the Public Works Director to the proponent. Prior to final project approval, the proponent shall sign the Agreement before a notary and file it with the Jefferson County Auditor. 5.) Maximum lot coverage is not to exceed 60%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 6.) The building height is not to exceed 35 feet. 7.) Building setbacks from Lower Hadlock Road are no less than 20 feet. Side and rear setbacks are 5 feet from RVC Commercial property and 35 feet from Residential property. 8.) Exterior flashing, moving, or blinking lighting is prohibited, except as required by local, state, or federal standards. 9.) Exterior lighting for commercial and industrial uses shall not exceed thirty feet(30') in height from the finished grade. Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 10.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 11.) All ingress/egress to a parking lot containing 4 or more parking spaces shall be developed so vehicles entering and leaving the parking lot are traveling in a forward motion. 12.) All noise emitting machinery that cannot in any other way operate below the maximum permitted noise level shall be housed in a sound-attenuating structure. 13.) The intensity of sound emitted by any commercial or industrial activity shall not exceed levels estabished by the Washington State Department of Ecology under WAC 173-60, and by Jefferson County under Resolution No. 67-85, "Establishment of Environmental Designations for Noise Abatement Areas for Jefferson County." 14.) The storage and handling of inflammable liquids, liquified petroleum, gases and explosives shall comply with rules and regulations falling under the jurisdiction of the fire marshal, the laws of the state and other local ordinances. Bulk storage of inflammable liquids below ground shall be located no closer to the property line than the greatest dimension (diameter, length, or height) of the tank. 15.) A 10' separation is required between the water lines and all onsite sewage system components. 16.) The transport line permitted under SEP10-00146 shall be finaled and all conditions met prior to final approval of the building. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) See MLA10-00303 for zoning approval and Hearing Examiner Decision dated October 18, 2010 for findings. 3.) The applicant is proposing to create or add 9,000 square feet of impervious surface and 11,000 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require the project applicant submit a stormwater plan meeting Minimum Requirements#1 through#10 of the Department of Ecology Stormwater Management Manual for Western Washington. The stormwater plan shall address measures to control stormwater, erosion and sediment during construction and shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 4.) The site plan as submitted with the Building Permit application on October 13, 2010 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated December 13, 2010 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) This approval is for a New 4,800 Square Foot Boat Construction Builidng with associated Vista Parking for 37 cars only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. 7.) The existing road approach was approved under RAP04-00045. The submittal shall incude substitute pages that include all proposed changes, revised drawings showing any structural changes,and any other supporting information that explains and supports the reason for the change. Final Corrected Plan Submittal If the project included construction of conveyance systems,treatment facilities,flow control facilities, or structural source control BMPs (not standard on-site stormwater management BMPs),the applicant shall submit a final corrected plan ("as-builts")when the project is completed. These should be engineering drawings (stamped by a licensed civil engineer) that accurately represent the project as constructed. Pearson, Project Manager DATE: November 19,2010 RE: ZON10-00072 Northwest Wooden Boat School Stormwater management The Public Works Department has reviewed the referenced proposal and notes the following: • The Jefferson County Unified Development Code,Chapter 18.30.070 Stormwater Management Standards adopts the standards and minimum requirements of the Washington Department of Ecology Stormwater Management Manual for Western Washington. • The proposal will create more than 5,000 square feet of new impervious surface for the building and driveway,and parking. The Stormwater Management Manual requires proponents of developments that meet these criteria to develop and implement a Stormwater Site Plan that complies with Stormwater Manual Minimum Requirements#1-#10. • The proposal site was formerly a sand and gravel pit. • The proponent has submitted a Jefferson County Stormwater Management Site Plan template. It proposes to implement a construction stormwater pollution prevention plan and to collect stormwater runoff from the building and infiltrate it in two 40' long x 3'wide trenches adjacent to the building.The sizing of the trenches is proportionate to the sizing of the infiltration trenches that were previously installed for the adjoining RUBB shelter.Runoff from the additional driveway and parking area will be directed to adjoining ditches and infiltrated. Box 2070 Port Townsend, WA 98368 STORMWATER MANAGEMENT FACILITY MAINTENANCE AGREEMENT This MAINTENANCE AGREEMENT is made this g a day of Nadu for ,2010 by the NORTHWEST SCHOOL OF WOODEN BOAT BUILDING, hereinafter GUARANTOR and JEFFERSON COUNTY,a municipal corporation,hereinafter GUARANTEE. 1.0 RECITALS: 1.1 GUARANTOR is the owner of certain real property in Section 1,Township 29 North, Range I West,W.M.,Jefferson County,Washington;located at 163 Lower Hadlock Road, Port Hadlock, WA; identified as Tax 41 and Assessor's Parcel Number 901013016; and referred to in this agreement as the PROPERTY. 1.2 In conjunction with the GUARANTOR'S development of the PROPERTY under Jefferson County Conditional Use Permit ZON10-00072, the GUARANTEE has required and GUARANTOR has agreed to construct a stormwater management facility which includes collection, treatment, infiltration, and/or detention facilities. The stormwater management facility is described and shown on a construction drawing for the GUARANTOR'S development of the PROPERTY that is on file with the appropriate agency,division,employee,or representative of Jefferson County. 1.3 As a condition of development approval, GUARANTOR has agreed to enter into this Maintenance Agreement ensuring that the stormwater management facility will be constructed and maintained in accordance with the approved plans. 2.0 CONSTRUCTION AND MAINTENANCE: GUARANTOR agrees to construct and maintain a stormwater management facility as shown on the construction drawing described above. The stormwater management facility shall be maintained and preserved by the GUARANTOR until such time as GUARANTOR,its heirs, successors, or assigns and GUARANTEE agree that the facility should be dismantled,revised,altered or removed. If the dispute cannot be resolved at that level, the GUARANTOR may file an appeal with the Jefferson County Hearing Examiner as provided for in the Jefferson County Unified Development Code. 5.0 ENFORCEMENT: This Agreement may be enforced by GUARANTEE in law or equity against the GUARANTOR,its heirs, successors and assigns. 6.0 SUCCESSORS AND ASSIGNS: This Agreement shall run with the PROPERTY and be binding on the GUARANTOR,its heirs,successors,and assigns. 7.0 NOTICE The GUARANTOR shall file this Agreement with the Jefferson County Auditor.
