HomeMy WebLinkAbout120814_ra01JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners Philip Morley, County Administrator FROM: Carl Smith, Director, Department of Community Development DATE: October 6, 2014 SUBJECT: Deliberations regarding the public hearing on Ordinance No. 07- 0811 -14: marijuana moratorium STATEMENT OF ISSUE: On October 6, 2014 the Board of County Commissioners held a public hearing regarding Ordinance No. 07- 0811-14, which had previously been adopted on August 11. The October 6 hearing created a record of public testimony on Ordinance No. 07- 0811 -14, both verbal (with an audio recording) and written (copies were kept on file). All three Commissioners have studied the hearing record. It is proposed that the Board of County Commissioners conclude its deliberations on the Ordinance No. 07- 0811 -14 public hearing record. ANALYSIS: On August 11, 2014, the Board of County Commissioners (BoCC) adopted Ordinance # 07- 0811 -14, establishing a six month moratorium on accepting or processing applications for recreational marijuana businesses in certain land use zones. Pursuant to State law, a public hearing regarding Ordinance No. 07- 0811-14 was conducted on October 6, 2014. There were numerous verbal public testimony made at the hearing, which was recorded. In addition, some testimony was submitted in writing before and during the hearing. Commissioner Phil Johnson had voted on August 11 to enact the moratorium ordinance, but was not able to attend its October 6 public hearing. Commissioner Johnson and the other Commissioners have now thoroughly reviewed the verbal and written testimony from the public hearing. Officially closing the period of deliberations will signal that the Commissioners have had sufficient time to review the record to their satisfaction. No further action on Ordinance No. 07- 0811 -14 is necessary. And closing deliberation on the original ordinance does not signal any position or future action by the Board regarding recreational marijuana. RECOMMENDATION: Pass a motion to conclude BoCC deliberations on the public testimony from the public hearing on Ordinance No. 07- 0811 -14, with no further action on Ordinance No. 07- 0811 -14.
