The size determines whether a Stormwater Site Plan is required in conjunction with a stand-alone stormwater management permit application, building permit application, or other land use approval application that involves stormwater review. The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on October 20, 2014 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the following ESAs were found to be present on the subject property: Intermediate shoreline slope stability, marine waterbody, Heritage Point: Progne subis(purple martin), Priority Habitat bay/estuary, moderately protected marine embayment, reach substrates, marshes, eelgrass beds, intertidal habitats, Flood Zone A, and High Risk Saltwater Intrusion Protection Zone. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(3) Repair, remodeling and maintenance activities. The following activities shall be categorically exempt: The repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, recreation, and transportation facilities involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt(examples include repair or replacement of piling, ramps, floats, or mooring buoys, or minor repair, alteration, or maintenance of docks).. 4.) The site plan as submitted with the Repair of Existing Ramp and Moorage Float application on October 7, 2014 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated December 11, 2014 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) This approval is for a Repair of Existing Ramp and Moorage Float only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there -Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. CONDITIONS: 1.) The project is exempt from a Shoreline Development Permit as found in 18.25.560(2) Maintenance and Repair. Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. Normal maintenance includes those usual acts to prevent a decline, lapse or cessation from a lawfully established condition. Normal repair means to restore a development to a state comparable to its original condition within a reasonable period after decay or partial destruction except where repair causes substantial adverse effects to the shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or the environment. 2.) The project shall adhere to the Best Management Practices (BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 3.) Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information. 4.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code(Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. 5.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 6.) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department. 7.) The development shall be essentially the same as the original in location, size, configuration, and external appearance. 8.) This parcel is within the Port Ludlow no shooting area per JCC 8.50. 9.) No fill or other material may be placed in the waters or intertidal areas of Jefferson County. 10.) All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife. 11.) Vessel maintenance activities which may cause water pollution, including hull chipping and painting, shall be performed at designated facilities. 12.) The proponents shall comply with all relevant state and federal regulations pertaining to the discharge of oil. 13.) The design, location, and construction of docks, piers, and floats, as well as their subsequent use, shall avoid adverse effects on fish, shellfish, wildlife, marine vegetation,water quality, and geohydraulic processes. Project Description There is an existing fixed pile pier with a ramp down to a moorage float that is secured by six creosote treated piles. The float mooring piles have worn and are in need of repairs. Upper portion of piles are to be removed and remaining portion are to be sleeved with steel. C. Construction Technique & Sequencing 1. PRE-CONSTRUCTION If required by Jefferson County, a pre-construction site meeting will be scheduled with County staff and construction crew. 2. SITE PREPARATION Examine the tidelands waterward of pier to ensure safe access corridor for barge to reach piles without risk of hitting a rock that could damage barge hull. 3. CONSTRUCTION ACCESS Construction access to site will be from the water via the construction barge. 4. ON SITE CONSTRUCTION The proposed repairs involve the following: • Cut the existing float mooring piles 4'above the bottom; • Drive a galvanized steel pile over the remaining existing pile stub at least 5'below the bottom grade; • Secure steel pile to existing stub using '/s"galvanized lag bolts screwed through the steel pile into the timber pile stub; • Dispose of cut off piles at an approved upland disposal site. Proposed Mitigation: • Removal of the upper portion of the creosote treated timber piles and sleeving of the remaining portion of the creosote treated timber piles is the only mitigation proposed for the project. 5. EQUIPMENT USED Crane barge will be used to deliver equipment and crew to the site. Piles will be cut with a pneumatic chainsaw. Piles sleeves to be driven with the barge mounted construction crane. Small power tools and hand tools will also be used to complete the project. 6. MATERIALS USED Material consists of 14"galvanized steel pipe piles and 1/2"galvanized lag bolts. 7. WORK CORRIDOR The barge would operate offshore during construction to avoid disturbances on beach material. 8. STAGING AREA AND EQUIPMENT WASHOUTS All staging area activities will occur on the barge and within the work corridor approved by WDFW. Once the project has been completed equipment will be loaded on the barge and transported to contractor's yard where washouts will occur in a contained area of the contractor's yard. 9. STOCKPILING AREAS Construction debris will be loaded onto the barge and held on the barge for offsite, upland disposal at an approved site. 10. RUNNING OF EQUIPMENT DURING CONSTRUCTION Equipment will be running off and on throughout the on-site construction phase. CONSTRUCTION ACCESS Construction access to site will be from the water via the construction barge. 4. ON SITE CONSTRUCTION The proposed repairs involve the following: • Cut the existing float mooring piles 4' above the bottom; • Drive a galvanized steel pile over the remaining existing pile stub at least 5' below the bottom grade; • Secure steel pile to existing stub using 1/2" galvanized lag bolts screwed through the steel pile into the timber pile stub; • Dispose of cut off piles at an approved upland disposal site. Proposed Mitigation: • Removal of the upper portion of the creosote treated timber piles and sleeving of the remaining portion of the creosote treated timber piles is the only mitigation proposed for the project. 5. EQUIPMENT USED • • Crane barge will be used to deliver equipment and crew to the site. Piles will be cut with a pneumatic chainsaw. I have contacted building plans reviewer Frank Benskin on 11/5 to request a status update but he has not had time to respond. FYI- I submitted the application to the Army Corps of Engineers on 9/26/2014 and Corps PM Rafael Lopez told me on 10/22/2014 that he is reviewing the project. It takes about 2-4 months to complete the Corps review process so I may have a Corps permit by the end of the year or early 2015. Please provide a status update on the SHEX & SEPAEX review as soon as you have time. When you have approved the SHEX & SEPAEX please email me a copy so I can submit to WDFW for the Hydraulic Project Approval, thanks.
