HomeMy WebLinkAbout061 14)t In t at r of - )t Dowans Creek Road County Road No. 146809 as a primitive road STATE OF WASHINGTON COUNTY OF JEFFERSON RESOLUTION NO. 61 -14 WHEREAS, Dowans Creek Road is not classified as part of the county primary road system, as provided for in RCW 36.86.070, and WHEREAS, Dowans Creed Road has a gravel driving surface, and WHEREAS, Dowans Creek Road has an average annual daily traffic of one hundred or fewer vehicles, and WHEREAS, Dowans Creek Road has been posted and has functioned as a primitive road for at least the past 20 years, IT IS HEREBY RESOLVED that said Dowans Creek Road, including the planned road realignment between milepost 0.85 and milepost 1.53, be classified and designated as a primitive road in accordance with RCW 36.75.300. The legislative authority of each county may by resolution classify and designate portions of the county roads as primitive roads where the designated road portion: (1) Is not classified as part of the county primary road system, as provided for in RCW 36.86.070; (2) Has a gravel or earth driving surface; and (3) Has an average annual daily traffic of one hundred or fewer vehicles. Any road designated as a primitive road shall be marked with signs indicating that it is a primitive road, as provided in the manual of uniform traffic control devices, at all places where the primitive road portion begins or connects with a highway other than another primitive road. No design or signing or maintenance standards or requirements, other than the requirement that warning signs be placed as provided in this section, apply to primitive roads. The design of a primitive road, any discretionary maintenance, and the location, placing, or failing to place road signs, other than the requirement that warning signs be placed as provided in this section, shall not be considered in any action for damages brought against a county, or against a county employee or county employees, or both, arising from vehicular traffic on the primitive road. Agenda Date: December 15, 2014 Subject: Resolution to Designate Dowans Creek Road, County Road Number 146809, as a Primitive Road Statement of Issue: A Resolution is necessary to designate Dowans Creek Road, County Road Number 146809, as a Primitive Road, in accordance with RCW 36.75.300. Analysis /Strategic Goals /Pro's Et Con's: Dowans Creek Road has been posted and has functioned as a primitive road for at least the past 20 years. It has an average annual daily traffic of 41 vehicles. Dowans Creek Road meets all of the criteria in RCW 36.75.300 to be classified and designated as a primitive road, however no record of a resolution could be located. Per RCW 36.75.300 a primitive road must meet all of the following criteria: 1. The road is not classified as part of the county primary road system, as provided in RCW 36.86.070. 2. The road has a gravel or earth driving surface. 3. The road has an average annual daily traffic of one hundred or fewer vehicles. A planned road realignment project between milepost 0.85 and milepost 1.53 will also meet the primitive road criteria. A resolution is necessary in order to officially classify and designate Dowans Creek Road, including the planned road realignment, as a primitive road. Primitive roads have no design, signing, or maintenance standards or requirements. Fiscal Impact /Cost Benefit Analysis: There is no cost associated with this resolution. Recommendation: The Board is requested to sign one original of the Resolution to classify and designate Dowans Creek Road as a primitive road.
