The project shall adhere to the Best Management Practices (BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 2.) Construction of the wireless telecommunication facilities is subject to the requirements of the County Building Code, Chapter 15.05 JCC, and all Building Code (UBC), the Electrical Code (NEC), the requirements of the National Electronics Industries Association/Telecommunications Industries Association (EIA/TIA)222 Revision F Standard entitled "Structural Standards for Steel Antenna Supporting Structures" and any additional applicable standards published by the Electronics Industries Association, the Uniform Fire Code and the Jefferson County Critical Areas Ordinance. 3.) If the FAA requires that lighting be placed at the top of the new communication facility tower, the applicant shall provide documentation from the FAA verifying that the tower will be required to be lit. 4.) Noise generated by the wireless telecommunication facility shall not exceed the maximum environmental noise levels established in Chapter 173-60, Washington Administrative Code, as it is now in effect or in effect or hereafter amended. In the event the applicant adds an emergency generator in the future, the applicant shall notify Jefferson County and provide noise generation data for the installed generator. All noise emitting equipment that cannot in any way operate below the maximum permitted noise level shall be housed in a sound-attenuating structure, unless otherwise stipulated in the project approval. The applicant may be required to submit sound attenuation plans for review and approval by the department. 5.) Security lighting for the equipment enclosure shall be minimized. Any newly installed security lighting shall be oriented downward and shielded so that light falls only within the boundaries of the property and shall be triggered only by a motion sensor. 6.) Signs, symbols, flags, banners or other devices shall not be attached to or painted or inscribed upon any tower or antenna. A telephone number and person to call for information or in the event of an emergency shall be posted at the site. 7.) The applicant shall protect the facility from unauthorized access consistent with the purpose of protecting the public health, safety and welfare. The applicant shall maintain the facility in a good and safe condition and preserve its original appearance and concealment or camouflage elements incorporated into the design at the time of approval. Maintenance shall include, but not be limited to, such items as painting, structural repair, repair of equipment and maintenance of landscaping. 8.) If the applicant transfers, assigns, or subleases a wireless communication facility, a copy of the land use agreement and FCC license shall be submitted in writing to the Director, as well as the name and telephone number of a person responsible for the facility, who is capable of responding immediately. 9.) The applicant shall be responsible for all direct and indirect expenses incurred related to review and compliance with conditions of approval. All fees shall be as authorized by County Ordinance. 10.) Prior to operation of the telecommunication facilities, the applicant shall document that the system has been integrated into the County's Emergency Response System as required by Section 18.42.050 Jefferson County Code. The applicant shall off icia certify that they have the capacity to meetSC mandate that all the industry must be able to locate a wireless telephone when it dials 911. 11.) In the event the wireless telecommunication facility is unused for a period of 180 consecutive days will be declared abandoned by the County. The property owner shall remove abandoned facilities within 180 days from the date of abandonment. Failure to remove an abandoned facility shall be considered a public nuisance subject to penalties. 12.) Upon written application, prior to the expiration of the 180-day period, the Director shall in writing grant a 180-day extension for reuse of the facility. Additional extensions beyond the first 180 day extension may be granted by the Director, subject to any conditions required to bring the project or facility into compliance with current law(s) and make it compatible with surrounding development. 13.) If an abandoned facility is not removed within 180 days or a longer period of time determined in writing by the Director, the County shall have the authority to enter the property and remove the facilities. All reasonable and documented costs of such removal shall be charged to the provider and/or landowner of record. 14.) Wireless communications facilities including attached or colocated antennas, towers, and equipment enclosures shall be painted a non-reflective color that blends with the surroundings. Appropriate colors may include earth tones and muted grays, blues, and greens in broken patterns. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on July 14, 2008 for the potential presence of Environmentally Sensitive Areas(ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Type N Stream, Landslide Hazard Area-Slight and Moderate, Susceptible Aquifer Recharge Area (SUSC). The proposal is for a colocation of 3 additional antennas and 2 equipment cabinets to an existing cell tower within an existing leased area. No impact to the above critical areas is expected. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(25(ii). 4.) The site plan as submitted with the building permit application on June 27, 2008 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 15, 2008 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) This approval is for adding 3 antennas and 2 equipment cabinets to an existing cell tower within an existing leased area only. Any future permits on this site are subject to review for consistency with applicable codes anc ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The parcel has been designated as Commercial Forest(CF-80) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 7.) A land use permit application (ZON99-00057)for a 150-foot lattice wireless telecommunication tower was issued 10/6/00 and finalled 7/26/01. A building permit application (BLD00-00359)for a 150-foot lattice tower was issued November 17, 2000 and finalled February 20, 2001. NOTICE: This permit does not excuse the proponent from complying with other local,state, and federal ordinances, regulations,or statutes applicable to the proposed development. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted,and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA,any person may bring lawsuit against any individual or agency that"takes"listed species(defined as causing harm,harassing,or damaging habitat for the listed species). In addition,the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are induded as"critical habitat"fora listed species. Development of property along any marine shoreline,freshwater shoreline,or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat,all property owners developing adjacent to marine shoreline,freshwater shoreline, or floodplains are advised to do the following: -Set back buildings,utilities and roads as far as ssible from surface waters(streams, rivers,lakesikine waters),or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes,wetlands,and forested areas near surface waters -Remove minimal vegetation for site development,especially large trees -Allow trees that have fallen into surface waters to remain there -Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group,or agency can bring suit for a listed species"taking,"even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. This approval is for a 15-foot extension to an existing Voice Stream lattice tower AND an Antenna Upgrade/Replacement on an Existing Wireless Facility located at 1219 Center Road, Chimacum Washington (parcel #901-231-004)only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 5.) It has been approved by Jefferson County Department of Community Development.
