Based on the findings, parcel number 701174007 can be considered two (2) separate parcel as described in the legal descriptions on the survey submitted with the application. 2.) The survey and legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest, conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 4.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations. 5.) The parcel has been designated as Rural Residential, RR1:5 under the Jefferson County Comprehensive Land use Map effective August 28, 1998 6.) On April 26, 2011, Pat Perry man in the Assessor's GIS department commented as follows: After reviewing the revisions submitted to us on April 23, 2011 I have no further comments concerning this proposed action. 7.) On May 1, 2012, Sherrie Shold's in the Assessor's commented by phone as follows: After reviewing the revisions submitted to us on April 23, 2012 I have no further issue with this Lot Certification. 8.) The application was reviewed by the Jefferson County Department of Community Development staff on May 1, 2012, for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review, the following ESAs were confirmed to be present on the subject property: Shoreline designation conservancy, "F"fish bearing stream, wetlands, seismic hazardous area, fish and wildlife conservation area, moderate and high landslide hazardous area, erosion hazardous area, susceptible aquifer recharge areas, unstable and unstable recent landslide shoreline slope stability, at risk seawater intrusion protection zone, . 9.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as "critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term"take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service(http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. This process is ready to move forward. All taxes must be paid prior to issuance or recording of the survey. The following is the process for the issuance of the permit and recording of the document. • Submit the Mylar and the 4 paper copies to DCD along with a $133 check for recording the survey payable to the auditor's office. The Mylar has to signed by the owners and notarized. • $222 additional fees for DCD review. I will be sending the invoice in the mail this week. • DCD will get the required signatures, issue the permit and record the survey. Submit the Mylar and recording fee of$133 ($128 plus$5 for additional pages payable to the Jefferson County Auditor)to the Department of Community Development for department signatures and recording of the Mylar and copies. Once the survey has been recorded and permit issued you will contact the Assessor's office at time of sale to have additional parcel numbers assigned. Please contact Sherrie, 379-9106 at the Assessor's office for details on parcel assignments. I will forward a copy of the permit to the Assessor's office. You mention the 711 and 528.59 distances. These are along the west line of government lot 4 (711) and a portion of the north line of Tract 4. Both of these are from the 1974 survey by Millpointer (vol 1, pg 50 and vol 2, pg 1). Mr Millpointer monumented the SW and NW corner of GL 4. The positions of these monuments determine these two distances you mentioned. In 1991, the DNR recorded a survey (vol 12, pgs 90-93) of the west line of government lot 4. This survey shows that the DNR found the two Millpointer mons at the sw and nw corner of GL 4 to be out of position. They contacted Mr Millpointer and he agreed that he had set the two corners in ERROR by about a foot. I accepted the two DNR mons at the sw and nw corner of GL 4 (also agreed to by Mr. Millpointer) to determine the west line of Golinski. This makes the 1974 distance of 528.59 distance longer as shown on my survey (529.66). The 711 distance was prorated between the two original Millpointer mons we found along this line. so instead of 711 it is 710.86. I appreciate your level of throughness, but at some point you have to trust the professionals to do their job. The new legal for the NWI parcel as written is correct.
