PROJECT LOCATION:

CONDITIONS:
1.) To process this segregation, you will need to submit a wrttten request and a copy of the recorded legal
descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of
this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office
(360-385-9105)with any questions regarding this process.
FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other
applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use
map.
2.) The administrator determined on January 7, 2009 &September 14, 2010 that no survey is required when
following existing section lines.
3.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not
required. It is the property owner's responsibility to identify and rectify any security interest, conveyances,
encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed
exemption.
4.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the
on-site sewage code, the building codes and local development regulations.
5.) Based on the findings, parcel number 712183001 can be considered two (2)separate parcel as described in
the legal descriptions submitted with the application. This Parcel is segregated by Highway 101.
6.) The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's
office
7.) On February 27, 2012, Sherrie Shold's in the Assessor's Office commented as follows: I have completed my
review on this lot certification an have no comments
8.) On February 15, 2012, Pat Perryman in the Assessor's GIS department commented as follows: After reviewing
the revisions submitted to us on February 13, 2012 via e-mail, I have no further comments concerning this
proposed action. All of my previous concerns pertaining to the action have been addressed. If you have any
questions or comments, please do not hesitate to contact me.
9.) Contact the Jefferson County Environmental Health Department at(360) 379-9444 to determine potential
limitations with regard to wells and on-site sewage requirements.
10.) RCW 58.17 requires regulation of the division of land and was passed in 1969
11.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4):
(4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but
not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption
shall not be construed to include acquisitions of easements.
12.) The parcel has been designated as RR 1:10 Rural Residential under the Jefferson County Comprehensive
Land use Map effective August 28, 1998
13.) The application was reviewed by the Jefferson County Department of Community Development staff on
12-22-11 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the
Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the
following ESAs were confirmed to be present on the subject property: "F"stream, spotted owl, wetlands, special
aquifer recharge protection areas and susceptible aquifer recharge area.
14.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58.
Development pursuant to this permit shall be undertaken subject to the applicable policies and performance
standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified
Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon
became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the
ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as
causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries
Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species.
Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if
protective measures are not taken. To minimize the potential to damage habitat, all property owners developing
adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following:
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
- Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an
eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald
eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take"
occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a
permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and
Wildlife Service(http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project.
Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by the
biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and
Wildlife Service.
15.) On 12-19-2011, Christine Moline, WSDOT, commented as follows:
I have attached the Right of Way plan sheet of SR 101 the runs through Section 18 T27N R12W in Jefferson
County along with the deed for the land purchased from Rayonier Incorporated dated August 7, 1950. The legal
for this area is Parcel "C" in the documents.
16.) Jefferson County determined that this proposal is categorically exempt from review under the State
Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a).
APPEALS:
Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court
within twenty-one(21)calendar days of the date of issuance of this land use decision. For more information related to judical

Pat and I have discussed her concerns with the legal descriptions and together I believe we came
to an alternative.
For revised Parcel A:
Instead of And between the descriptions it should read—together with that portion; also,the 2°d
portion should be the NE NE.
However,a better way to describe this parcel would be
**Northeast Quarter lying northerly of the northerly right of way line of State Highway 101,
Except that portion lying within the Westerly 200' of the Northwest Quarter of the Northeast
Quarter lying northerly of the northerly right of way line of State Highway 101.**
And, for Parcel B we thought the following would be a better description and less room for
errors.

After reviewing this proposed action, I have the following comment(s):
1. Revised Parcel A has the description of"That portion of the Northwest Quarter
of the Northeast Quarter... lying northerly of the northerly right of way line of
State Highway 101 Excepting the North 433 feet of West 200 feet thereof. AND
That portion of the Northeast Quarter... lying northerly of the northerly right of
way line of State Highway 101". There is an overlap on the legal description since
there is no portion of the Northwest Quarter of the Northeast Quarter that
would not fall within the boundary of the Northeast Quarter.
2. The two Excepts under Revised Parcel B could/should be combined into one
exception since the exceptions equal all of the Northeast Quarter north of the
State Highway as stated in the second Exception.
3. There is a survey(Vol.23 P. 56)that shows the exception parcel that is described
as being"the North 433 feet of the West 200 feet". This survey shows that
distance as being 388.86 feet(at the longest point). The distance of 433 feet
does not seem to be an accurate distance call.
SURVEYORS PLEASE NOTE: This office tries to catch all errors and inconsistencies in the
survey and legal descriptions submitted for our review but do not always find every issue.
Please be sure to re-review you work so that we all have less frustration in trying to get these
projects through to completion.

I'm hoping to gain some information about the history for a portion of Hwy 101 in Jefferson County.
The portion I'm interested in at this time is where Hwy 101 segregated parcel 712183001(S18 T27N R12W-see
Jefferson County Assessor's quarter map, below).
I need to know what date that particular portion of Hwy 101 was established. Was it before 1969?

As I understand your questions whether parcel portion of 712183001 lying North of HWY 101 can be segregated.
The parcel is zoned RR 1:20. A road segregation is the process to segregate the parcel. Comp Plan NRP 3.3
would not allow a road segregation in Commercial or Rural forest designations. I have attached a road
segregation handout for your review.
The lot certification process for a road segregation will take more than a few days. WSDOT will comment on the
history of this portion of HWY 101 and the Assessor's office will comment on relevant history.
Application for road certification consist of:
• MLA application
• Site plan.
• Original lot certification statement of intent, which consist of existing and new legal descriptions.
• Brief written outline of proposal.
• Fee of$284 at time of submittal
Make appointment with Lisa Keller 379-4452 to submit application.
Review Process steps:
1. After the departments review of application and legal descriptions, county may approve or deny.

UNDERGROUND STORAGE TANK REMOVAL
1.) The application was reviewed by the Jefferson County Department of Community Development staff on August 3,
2001 for the potential presence of Environmentally Sensitive Areas(ESAs) under the provisions of the Unified
Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property: Numerous Wetland Areas;
Spotted Owl; and Type 3 and 4 Streams.
2.) A Type 3/4 Stream (Fish and Wildlife Habitat Area) has been identified on the subject property. The stream will
require a setback of 100-feet. The setback shall be measured horizontally from the Ordinary High Water Mark
(OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established.
3.) The Washington State Department of Fish and Wildlife was contacted by letter and requested to review for any
impacts this proposal may cause for Spotted Owl. Based on a telephone call from Jeff Davis, Area Habitat Biologist,
there is little chance that any adverse impact would result to habitat for Spotted Owl as a result of this proposal.
4.) A setback of 50-feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer.
No filling, grading, clearing, or other alteration of the wetland or its buffer is allowed.
5.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100)
feet, whichever is less. Signs shall contain the following statement: "Wetland & Buffer- Do Not Remove or Alter
Existing Vegetation."

activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit
a Stormwater Calculation Sheet. The applicant submitted a completed Stormwater Calculation Sheet.
9.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment
during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in
the design and operation of stormwater and drainage control systems.
10.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental
Policy Act(SEPA) pursuant to WAC 197-800-11(2)(f).
11.) This approval is for removal of existing underground storage tank(s) only. Any future permits on this site are subject
to review for consistency with applicable codes and ordinances and does not preclude review and conditions which
may be placed on future permits.
12.) The site plan as submitted with the building permit application/master land use permit application on July 27, 2001 has
been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of
Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated
July 27, 2001 with a stamped approval August 17, 2001 approval date shall be resubmitted for review and approval by
Jefferson County Department of Community Development.
13.) A Class Ill Forest Practice Approval (FPA2601385)was issued March 6, 1998 and finaled April 1, 1998.
14.) A Forest Practice Approval (FPA2603645)for a Class Ill timber harvert, was issued October 17, 2000 and finaled
