HomeMy WebLinkAbout011215_ra01Regular Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners Philip Morley, County Administrator FROM: Carl Smith, Director, Department of Community Development DATE: January 12, 2015 SUBJECT: Setting a public hearing date and notice for publication regarding extending Ordinance No. 07- 0811 -14: marijuana moratorium STATEMENT OF ISSUE: Ordinance # 07- 0811 -14, establishing a six month moratorium on accepting or processing applications for recreational marijuana businesses in certain land use zones, will expire on February 11, 2015. The Board of County Commissioners intends to consider two possible alternatives for extending the moratorium for a limited time. Pursuant to State law, a public hearing is required to be held within 60 days of a moratorium. The public hearing is proposed to be held on Monday, January 26, 2015 at 10:30 a.m. in the Board Chambers, at 1820 Jefferson Street, Port Townsend, WA 98368. ANALYSIS: The attached Hearing Notice will be advertised in the Port Townsend Leader newspaper on January 14 and 21, 2015, prior to the public hearing on January 26. The Board will hear public testimony regarding the moratorium at that time. Written testimony on the moratorium extension will be accepted until the close of the public hearing. Box 1220 Port Townsend, WA 98368 NOTICE OF PUBLIC HEARING BEFORE THE JEFFERSON COUNTY BOARD OF COMMISSIONERS ON TWO ALTERNATIVES FOR EXTENDING ORDINANCE # 07- 0811 -14; MORATORIUM ON ACCEPTING OR PROCESSING OF PERMITS FOR RECREATIONAL MARIJUANA IN CERTAIN ZONES NOTICE IS HEREBY GIVEN that the Jefferson County Board of County Commissioners will hold a public hearing to consider two alternatives for extending Ordinance # 07- 0811 -14. That Ordinance enacted a moratorium on accepting or processing of permits for recreational marijuana in certain zones. One version would extend the moratorium unaltered for four months. The second version would extend the moratorium for four months AND would amend the moratorium to authorize recreational marijuana applications upon certain rural residential parcels. The public hearing will be held on Monday January 26, 2015 at 10:30am at the Commission Chambers located at 1820 Jefferson Street, Port Townsend, WA 98368. Written public comments will also be accepted any time up through the close of the public hearing, addressed to the BoCC at P.O. Box 1220, Port Townsend, WA 98368 or by email at jeffbocc o,co.jefferson.wa.us. The public hearing is to take comments from all interested persons for or against two alternatives for extending moratorium # 07- 0811 -14. The first alternative would extend the moratorium as it now exists. In the second alternative, the moratorium would contain the additional provision of not including in the moratorium parcels of land greater than 5 acres in size and designated either rural residential 1:10 or rural residential 1:20. In both alternatives, the time period for the extension is proposed to be four months.
